SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-610 new

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that, subject to appropriation, the Department of Public Health shall establish and administer a program under which any individual who is not eligible to receive a free influenza vaccination through insurance, a health maintenance organization, or a similar plan shall, upon the individual's request, receive an influenza vaccination once each year to at no cost to the eligible individual. Provides that Department of Public Health shall adopt rules for the administration and operation of the program.

1     AN ACT concerning public health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 2310-610 as follows:
 
7     (20 ILCS 2310/2310-610 new)
8     Sec. 2310-610. Influenza vaccinations.
9     (a) As used in this Section, "eligible individual" means a
10 resident of Illinois who: (1) is not entitled to receive an
11 influenza vaccination at no cost as a benefit under a plan of
12 health insurance, a managed care plan, or a plan provided by a
13 health maintenance organization, a health services plan
14 corporation, or a similar entity; and (2) meets the
15 requirements established by the Department of Public Health by
16 rule.
17     (b) Subject to appropriation, the Department of Public
18 Health shall establish and administer a program under which any
19 eligible individual shall, upon the eligible individual's
20 request, receive an influenza vaccination once each year to at
21 no cost to the eligible individual.
22     (c) The Department of Public Health shall adopt rules for
23 the administration and operation of the program, including but
24 not limited to: determination of the influenza vaccine
25 formulation to be administered and the method of
26 administration; eligibility requirements and eligibility
27 determinations; and standards and criteria for acquisition and
28 distribution of influenza vaccine and related supplies. The
29 Department may enter into contracts or agreements with public
30 or private entities for the performance of such duties under
31 the program as the Department may deem appropriate to carry out
32 this Section and its rules adopted under this Section.
