    Amends the School Code. Requires each school board to establish an office of nutrition for the school district to aid in the prevention of childhood obesity. Amends the State Mandates Act to require implementation without reimbursement. Effective July 1, 2004.

1     AN ACT concerning schools.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Sections
5 10-20.39 and 34-18.30 as follows:
 
6     (105 ILCS 5/10-20.39 new)
7     Sec. 10-20.39. Office of nutrition. Each school board shall
8 establish an office of nutrition for the school district to aid
9 in the prevention of childhood obesity.
 
10     (105 ILCS 5/34-18.30 new)
11     Sec. 34-18.30. Office of nutrition. The board shall
12 establish an office of nutrition for the school district to aid
13 in the prevention of childhood obesity.
 
14     Section 90. The State Mandates Act is amended by adding
15 Section 8.28 as follows:
 
16     (30 ILCS 805/8.28 new)
17     Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8
18 of this Act, no reimbursement by the State is required for the
19 implementation of any mandate created by this amendatory Act of
20 the 93rd General Assembly.
 
21     Section 99. Effective date. This Act takes effect July 1,
22 2004.
