| AN ACT concerning schools.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The School Code is amended by adding Sections |
5 |
| 10-20.39 and 34-18.30 as follows: |

| (105 ILCS 5/10-20.39 new) |

| Sec. 10-20.39. Office of nutrition. Each school board shall |
8 |
| establish an office of nutrition for the school district to aid |
9 |
| in the prevention of childhood obesity. |

| Section 90. The State Mandates Act is amended by adding |

| Section 8.28 as
follows:

| (30 ILCS 805/8.28 new)

| Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8 |
18 |
| of this
Act, no reimbursement by the State is required for the |
19 |
| implementation of
any mandate created by this amendatory Act of |
20 |
| the 93rd General Assembly.

| Section 99. Effective date. This Act takes effect July 1, |
22 |
| 2004.
