Amends the Mental Health and Developmental Disabilities Code. Provides that a county that has established a mental health court may assess a fee of no more than $10 for the processing of criminal cases upon the conviction of an individual in that court. Provides that the fees collected shall be deposited in the Mental Health Court Fund to be used for the purpose of establishing and operating a mental health court in the State. Amends the State Finance Act to create the Mental Health Court Fund. Effective immediately.

| AN ACT concerning mental health.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Mental Health and Developmental |
| 5 |
| Disabilities Code is amended by adding Section 2-116 as |
| 6 |
| follows:
|

| Sec. 2-116. Mental health court fees. A county that has |
| 9 |
| established a mental health court may assess a fee of no more |
| 10 |
| than $10 for the processing of criminal cases upon the |
| 11 |
| conviction of an individual in that court. The fees collected |
| 12 |
| pursuant to this Section shall be deposited in the Mental |
| 13 |
| Health Court Fund, a special fund created in the State |
| 14 |
| treasury, to be used for the purpose of establishing and |
| 15 |
| operating a mental health court in the State.

| Section 10. The State Finance Act is amended by adding |

| Section
5.625 as follows:
