Creates the Firewall Protection Act. Provides that all multi-family structures containing 3 or more living units or any living units in a structure containing any type of commercial activity shall be constructed with separation walls, floors, and roofs with a minimum 2-hour fire rating. Denies home rule powers.

| AN ACT concerning fire safety.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 1. Short title. This Act may be cited as the |
5 |
| Firewall Protection Act. |
6 |
| Section 5. Firewalls. All multi-family structures |
7 |
| containing 3 or more living units or any living unit in a |
8 |
| structure containing any type of commercial activity shall be |
9 |
| constructed with separation walls, floors, and roofs with a |
10 |
| minimum 2-hour fire rating. |
11 |
| Section 10. Home rule. The regulation of firewalls is an |
12 |
| exclusive power and function of the State. A home rule unit may |
13 |
| not regulate firewalls. This Section is a denial and limitation |
14 |
| of home rule powers and functions under subsection (h) of |
15 |
| Section 6 of Article VII of the Illinois Constitution.
