1 | AMENDMENT TO HOUSE BILL 4703

2 | AMENDMENT NO. ______. Amend House Bill 4703 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
5 | changing Section 7-310 as follows:
| ||||||
6 | (625 ILCS 5/7-310) (from Ch. 95 1/2, par. 7-310)
| ||||||
7 | Sec. 7-310. Petition for discharge filed in bankruptcy. A
| ||||||
8 | petition for discharge filed in bankruptcy following the | ||||||
9 | rendering of any judgment relieves
shall
relieve the judgment | ||||||
10 | debtor from any of the requirements of this Chapter 7.
| ||||||
11 | A petition for discharge filed in bankruptcy of the owner
| ||||||
12 | or lessee of a commercial vehicle by whom the judgment debtor | ||||||
13 | is employed
at the time of the motor vehicle accident that | ||||||
14 | gives rise to the
judgment
also shall relieve the judgment | ||||||
15 | debtor so employed from any of the
requirements of this Chapter | ||||||
16 | 7 if the discharge of the owner or lessee
follows the rendering | ||||||
17 | of the judgment and if the judgment debtor
so employed
was | ||||||
18 | operating the commercial vehicle in connection with his
regular | ||||||
19 | employment or occupation at the time of the accident.
This | ||||||
20 | amendatory
act of 1985 applies to all cases irrespective of | ||||||
21 | whether the accident
giving rise to the suspension of license | ||||||
22 | or registration occurred before,
on, or after its effective | ||||||
23 | date.
