| AN ACT concerning military personnel.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Metropolitan Transit Authority Act is |
5 |
| amended by changing Section 29 as follows:
|
6 |

| Sec. 29. If the Authority acquires a transportation system |
8 |
| in operation by
a public utility, all of the employees in the |
9 |
| operating and maintenance
divisions of such public utility and |
10 |
| all other employees except executive
and administrative |
11 |
| officers and employees, shall be transferred to and
appointed |
12 |
| as employees of the Authority, subject to all rights and |
13 |
| benefits
of this Act, and these employees shall be given |
14 |
| seniority credit in
accordance with the records and labor |
15 |
| agreements of the public utility.
Employees who left the employ |
16 |
| of such a public utility to enter the
military service of the |
17 |
| United States shall have the same rights as to the
Authority, |
18 |
| under the provisions of the " Service Member's
Men's Employment |
19 |
| Tenure
Act ", approved July 17, 1941, as they would have had |
20 |
| thereunder as to
such public utility. After such acquisition |
21 |
| the authority shall be required
to extend to such former |
22 |
| employees of such public utility only the rights
and benefits |
23 |
| as to pensions and retirement as are accorded other employees
|
24 |
| of the Authority.

| Section 10. The Local Mass Transit District Act is amended |
27 |
| by changing Section 3.5 as follows:

| Sec. 3.5. If the district acquires a mass transit facility, |

| all of the
employees in such mass transit
facility shall be |

| transferred to and appointed as employees
of the district, |
2 |
| subject to all rights and benefits of this Act, and these
|
3 |
| employees shall be given seniority credit in accordance with |

| the records
and labor agreements of the mass transit facility. |

| Employees who left the
employ of such a mass transit facility |
6 |
| to enter the military service of the
United States shall have |
7 |
| the same rights as to the district, under the
provisions of the |

| Section 15. The Service Men's Employment Tenure Act is |

| amended by changing Sections 1 and 6 as follows:

| Sec. 1. Short title.
This Act shall be known and may be |

| cited as the Service Member's
Men's Employment Tenure Act.

| Sec. 6. Employer's violation of Act; penalty; employee's |
23 |
| remedies.
|
24 |
| (a) An employer's knowing violation of this Act is a |
25 |
| business offense punishable by a fine of not less than $5,000 |
26 |
| and not more than $10,000.
|
27 |
| (b) In case any employer fails or refuses to comply with
|
28 |
| this Act, the circuit court of the county in which such private |
29 |
| employer
maintains a place of business, or of the county where |
30 |
| such State employee
performs most of his duties, has power, |
31 |
| upon the filing of a complaint
by the person entitled to
the |
32 |
| benefits of this Act, to specifically require such employer to |
33 |
| comply
with this Act and to compensate such person for any loss |

| of wages or
benefits suffered by reason of such employer's |
2 |
| unlawful action, together
with a reasonable attorney's fees and |
3 |
| costs
fee . No fees or court costs shall be taxed
against any |
4 |
| person applying for the benefits of this Act.
|
5 |
| The court shall, in its sound discretion, give preference |
6 |
| to the hearing
and disposition of such cases over other matters |
7 |
| then pending before it.

| Section 99. Effective date. This Act takes effect upon |
10 |
| becoming law.
