SYNOPSIS AS INTRODUCED:

    Amends the Compensation Review Act. Provides that the Board must file a separate report concerning the salaries of judges. Provides that the recommendations of the Board concerning salaries of judges do not take effect unless approved by record vote of a majority of the members elected to each house of the General Assembly within 30 session days after the report is filed. Effective immediately.

1     AN ACT concerning compensation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Compensation Review Act is amended by
5 changing Sections 4 and 5 as follows:
 
6     (25 ILCS 120/4)  (from Ch. 63, par. 904)
7     Sec. 4. Meetings of the Board; determining compensation;
8 public hearings; reports. The Board shall meet as often as may
9 be necessary and shall determine, upon a vote requiring at
10 least 7 affirmative votes, the compensation for members of the
11 General Assembly, judges, other than the county supplement,
12 State's attorneys, other than the county supplement, the
13 elected constitutional officers of State government, and
14 certain appointed officers of State government.
15     In determining the compensation for each office, the
16 Compensation Review Board shall consider the following
17 factors:
18         (a) the skill required,
19         (b) the time required,
20         (c) the opportunity for other earned income,
21         (d) the value of public services as performed in
22     comparable states,
23         (e) the value of such services as performed in the
24     private sector in Illinois and comparable states based on
25     the responsibility and discretion required in the office,
26         (f) the average consumer prices commonly known as the
27     cost of living,
28         (g) the overall compensation presently received by the
29     public officials and all other benefits received,
30         (h) the interests and welfare of the public and the
31     financial ability of the State to meet those costs, and
32         (i) such other factors, not confined to the foregoing,

1     which are normally or traditionally taken into
2     consideration in the determination of such compensation.
3     The Board shall conduct public hearings prior to filing its
4 reports report.
5     At the public hearings, the Board shall allow interested
6 persons to present their views and comments. The Board may
7 prescribe reasonable rules for the conduct of public hearings,
8 to prevent undue repetition. The meetings of the Board are
9 subject to the Open Meetings Act.
10     The Board shall file its reports an initial report with the
11 House of Representatives, the Senate, the Comptroller, and the
12 Secretary of State. Subsequent reports shall be filed therewith
13 before April 1 in each even-numbered year. One report shall
14 state thereafter stating the annual salary for members of the
15 General Assembly, the elected State constitutional officers
16 and certain appointed State officers and compensated employees
17 and members of certain State departments, agencies, boards and
18 commissions whose terms begin in the next calendar year; the
19 annual salary for State's attorneys; and the annual salary for
20 the Auditor General. The annual salary and for Supreme Court,
21 Appellate Court, Circuit Court, and Associate judges shall be
22 stated in a separate report. If the report increases the
23 annual salary of judges, State's attorneys, and the Auditor
24 General, such increase shall take effect as soon as the time
25 period for disapproval or reduction, as provided in subsection
26 (b) of Section 5, has expired. If the report recommends an
27 increase in the annual salary of judges, that increase shall
28 not take effect unless approved as provided in subsection (c)
29 of Section 5.
30     The salaries in the report or as reduced by the General
31 Assembly, other than for judges, State's attorneys, and the
32 Auditor General, shall take effect as provided by law.

35     Sec. 5. (a) If the Board fails to recommend a change in

1 salary or the General Assembly disapproves the report as
2 provided in subsection (b) or fails to approve a report as
3 provided in subsection (c), and a new term for any officer
4 provided for in this Act begins, the salary for the new term
5 shall be the same as the salary in effect when the previous
6 term ended.
7     (b) Except with respect to the salaries of judges, the The
8 General Assembly may disapprove the report of the Board in
9 whole, or reduce it in whole proportionately, within 30 session
10 days after each house of the legislature next convenes after
11 the report is filed, by adoption of a resolution by a record
12 vote of the majority of the members elected in each house
13 directed to the Board. Such resolution shall be binding upon
14 the Board.
15     (c) With respect to the salaries of judges, the General
16 Assembly may approve the report of the Board in whole, or as
17 reduced in whole proportionately, within 30 session days after
18 each house of the legislature next convenes after a report
19 concerning salaries of judges is filed, by adoption of a
20 resolution by a record vote of the majority of the members
21 elected in each house directed to the Board. If the General
22 Assembly does not so approve a report concerning salaries of
23 judges, the recommendations of the Board do not take effect.
24 The action or non-action of the General Assembly is binding
25 upon the Board.
26     For the initial report filed by the Board after this Act
27 takes effect, the General Assembly may, by January 9, 1985,
28 disapprove the report of the Board in whole, or reduce it in
29 whole proportionately, after the report is filed, by the
30 adoption of a resolution by a record vote of the majority of
31 the members.

33     Section 99. Effective date. This Act takes effect upon
34 becoming law.
