AMENDMENT TO HOUSE BILL 4218

2     AMENDMENT NO. ______. Amend House Bill 4218 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Clinical Psychologist Licensing Act is
5 amended by changing Section 7 as follows:
 
6     (225 ILCS 15/7)  (from Ch. 111, par. 5357)
7     (Section scheduled to be repealed on January 1, 2007)
8     Sec. 7. Board. The Director shall appoint a Board that
9 shall serve in an advisory capacity to the Director.
10     The Board shall consist of 7 persons, 4 of whom are
11 licensed clinical psychologists, and actively engaged in the
12 practice of clinical psychology, 2 of whom are licensed
13 clinical psychologists and are full time faculty members of
14 accredited colleges or universities who are engaged in training
15 clinical psychologists, and one of whom is a public member who
16 is not a licensed health care provider. In appointing members
17 of the Board, the Director shall give due consideration to the
18 adequate representation of the various fields of health care
19 psychology such as clinical psychology, school psychology and
20 counseling psychology. In appointing members of the Board, the
21 Director shall give due consideration to recommendations by
22 members of the profession of clinical psychology and by the
23 State-wide organizations representing the interests of
24 clinical psychologists and organizations representing the

1 interests of academic programs as well as recommendations by
2 approved doctoral level psychology programs in the State of
3 Illinois. The members shall be appointed for a term of 4 years.
4 No member shall be eligible to serve for more than 2 full
5 terms. Any appointment to fill a vacancy shall be for the
6 unexpired portion of the term. A member appointed to fill a
7 vacancy for an unexpired term for a duration of 2 years or more
8 may be reappointed for a maximum of one term and a member
9 appointed to fill a vacancy for an unexpired term for a
10 duration of less than 2 years may be reappointed for a maximum
11 of 2 terms shall be eligible for reappointment to only one full
12 term. The Director may remove any member for cause at any time
13 prior to the expiration of his or her term.
14     The Board shall annually elect one of its members as
15 chairperson and vice chairperson.
16     The members of the Board shall be reimbursed for all
17 authorized legitimate and necessary expenses incurred in
18 attending the meetings of the Board.
19     The Director shall give due consideration to all
20 recommendations of the Board. In the event the Director
21 disagrees with or takes action contrary to the recommendation
22 of the Board, he or she shall provide the Board with a written
23 and specific explanation of his or her actions.
24     A majority of the Board members currently appointed shall
25 constitute a quorum. A vacancy in the membership of the Board
26 shall not impair the right of a quorum to perform all of the
27 duties of the Board.
28     Members of the Board shall have no liability in any action
29 based upon any disciplinary proceeding or other activity
30 performed in good faith as a member of the Board.
31     The Director may terminate the appointment of any member
32 for cause which in the opinion of the Director reasonably
33 justifies such termination.

1     Section 10. The Electrologist Licensing Act is amended by
2 changing Section 30 as follows:
 
3     (225 ILCS 412/30)
4     (Section scheduled to be repealed on January 1, 2014)
5     Sec. 30. Qualifications for licensure. A person shall be
6 qualified for licensure as an electrologist if that person has
7 met all of the following requirements:
8         (1) Has applied in writing on the prescribed forms and
9 has paid the required fees.
10         (2) Has not violated any of the provisions of Section
11 75 of this Act or the rules promulgated under this Act. The
12 Department shall take into consideration any felony
13 conviction of the applicant, but a conviction shall not
14 operate as an absolute bar to licensure.
15         (3) Is at least 18 years of age.
16         (4) Has received his or her high school diploma or
17 equivalent.
18         (5) Has completed a total of 600 hours in the study of
19 electrology over a period of not less than 16 weeks nor
20 more than 2 consecutive years at a program approved by the
21 Department. If an applicant completed a program before
22 December 31, 2003, the program may be less than 600 hours
23 if it is approved by the Department.
24         (6) Has successfully completed an examination approved
25 by the Department that tests the applicant's knowledge of
26 the theory and clinical practice of electrology.

28     Section 99. Effective date. This Act takes effect upon
29 becoming law.".
