SYNOPSIS AS INTRODUCED:
 
20 ILCS 2605/2605-390   was 20 ILCS 2605/55a in part

    Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Eliminates the provision that the duty of the Department of State Police to collect and disseminate information relating to hate crimes is contingent upon the availability of State or federal funds to revise and upgrade the Illinois Uniform Crime Reporting System. Provides that the information must be collected and disseminated regardless of State or federal fund availability.

1     AN ACT concerning hate crimes.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of State Police Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 2605-390 as follows:
 
7     (20 ILCS 2605/2605-390)  (was 20 ILCS 2605/55a in part)
8     Sec. 2605-390. Hate crimes.
9     (a) To collect and disseminate information relating to
10 "hate crimes" as defined under Section 12-7.1 of the Criminal
11 Code of 1961 contingent upon the availability of State or
12 federal funds to revise and upgrade the Illinois Uniform Crime
13 Reporting System. All law enforcement agencies shall report
14 monthly to the Department concerning those offenses in the form
15 and in the manner prescribed by rules and regulations adopted
16 by the Department. The information shall be compiled by the
17 Department and be disseminated upon request to any local law
18 enforcement agency, unit of local government, or State agency.
19 Dissemination of the information shall be subject to all
20 confidentiality requirements otherwise imposed by law.
21     (b) The Department shall provide training for State Police
22 officers in identifying, responding to, and reporting all hate
23 crimes. The Illinois Law Enforcement Training Standards Board
24 shall develop and certify a course of such training to be made
25 available to local law enforcement officers.
