4 | "Section 5. The Liquor Control Act of 1934 is amended by | ||||||
5 | changing Section 6-15 as follows:
| ||||||
6 | (235 ILCS 5/6-15) (from Ch. 43, par. 130)
| ||||||

| ||||||
8 | Sec. 6-15. No alcoholic liquors shall be sold or delivered | ||||||
9 | in any
building belonging to or under the control of the State | ||||||
10 | or any political
subdivision thereof except as provided in this | ||||||
11 | Act. The corporate
authorities of any city, village, | ||||||
12 | incorporated town or township may provide by
ordinance, | ||||||
13 | however, that alcoholic liquor may be sold or delivered in any
| ||||||
14 | specifically designated building belonging to or under the | ||||||
15 | control of the
municipality or township, or in any building | ||||||
16 | located on land under the
control of the municipality; provided | ||||||
17 | that such township complies with all
applicable local | ||||||
18 | ordinances in any incorporated area of the township.
Alcoholic | ||||||
19 | liquor may be delivered to and sold under the authority of a | ||||||
20 | special use permit on any property owned by a conservation | ||||||
21 | district organized under the Conservation District Act, | ||||||
22 | provided that (i) the alcoholic liquor is sold only at an event | ||||||
23 | authorized by the governing board of the conservation district, | ||||||
24 | (ii) the issuance of the special use permit is approved by the |

| |||||||
1 | governing board of the county in which the property is located, | ||||||
2 | and (iii) the special use permit authorizes the sale of | ||||||
3 | alcoholic liquor for one day or less. Alcoholic liquors may be | ||||||
4 | delivered to and sold at any airport belonging to
or under the | ||||||
5 | control of a municipality of more than 25,000 inhabitants, or
| ||||||
6 | in any building or on any golf course owned by a park district | ||||||
7 | organized under
the Park District
Code, subject to the approval | ||||||
8 | of the governing board of the district, or
in any building or | ||||||
9 | on any golf course owned by a forest preserve district
| ||||||
10 | organized under the Downstate Forest Preserve District Act, | ||||||
11 | subject to the
approval of the governing board of the district, | ||||||
12 | or on the grounds
within 500 feet of any building owned by a | ||||||
13 | forest preserve district
organized under the Downstate Forest | ||||||
14 | Preserve District Act during
times when food is dispensed for | ||||||
15 | consumption within
500 feet of the building from which the food | ||||||
16 | is dispensed,
subject to the
approval of the
governing board of | ||||||
17 | the district, or in a building owned by a Local Mass
Transit | ||||||
18 | District organized under the Local Mass Transit District Act, | ||||||
19 | subject
to the approval of the governing Board of the District, | ||||||
20 | or in Bicentennial
Park, or
on the premises of the City of | ||||||
21 | Mendota Lake Park
located adjacent to Route 51 in Mendota, | ||||||
22 | Illinois, or on the premises of
Camden Park in Milan, Illinois, | ||||||
23 | or in the community center owned by the
City of Loves Park that | ||||||
24 | is located at 1000 River Park Drive in Loves Park,
Illinois, | ||||||
25 | or, in connection with the operation of an established food
| ||||||
26 | serving facility during times when food is dispensed for | ||||||
27 | consumption on the
premises, and at the following aquarium and | ||||||
28 | museums located in public
parks: Art Institute of Chicago, | ||||||
29 | Chicago Academy of Sciences, Chicago
Historical Society, Field | ||||||
30 | Museum of Natural History, Museum of Science and
Industry, | ||||||
31 | DuSable Museum of African American History, John G. Shedd
| ||||||
32 | Aquarium and Adler Planetarium, or at Lakeview Museum of Arts | ||||||
33 | and Sciences
in Peoria, or in connection with the operation of | ||||||
34 | the facilities of the
Chicago Zoological Society or the Chicago |
| |||||||
| |||||||
1 | Horticultural Society on land
owned by the Forest Preserve | ||||||
2 | District of Cook County,
or on any land used for a golf course | ||||||
3 | or for recreational purposes
owned by the Forest Preserve | ||||||
4 | District of Cook County, subject to the control
of the Forest | ||||||
5 | Preserve District Board of Commissioners and applicable local
| ||||||
6 | law, provided that dram shop liability insurance is provided at
| ||||||
7 | maximum coverage limits so as to hold the
District harmless | ||||||
8 | from all financial loss, damage, and harm,
or in any building
| ||||||
9 | located on land owned by the Chicago Park District if approved | ||||||
10 | by the Park
District Commissioners, or on any land used for a | ||||||
11 | golf course or for
recreational purposes and owned by the | ||||||
12 | Illinois International Port District if
approved by the | ||||||
13 | District's governing board, or at any airport, golf course,
| ||||||
14 | faculty center, or
facility in which conference and convention | ||||||
15 | type activities take place
belonging to or under control of any | ||||||
16 | State university or public community
college district, | ||||||
17 | provided that with respect to a facility for conference
and | ||||||
18 | convention type activities alcoholic liquors shall be limited | ||||||
19 | to the
use of the convention or conference participants or | ||||||
20 | participants
in cultural, political or educational activities | ||||||
21 | held in such facilities,
and provided further that the faculty | ||||||
22 | or staff of the State university or
a public community college | ||||||
23 | district, or members of an organization of
students, alumni, | ||||||
24 | faculty or staff of the State university or a public
community | ||||||
25 | college district are active participants in the conference
or | ||||||
26 | convention, or in Memorial Stadium on the campus of the | ||||||
27 | University of
Illinois at Urbana-Champaign during games in | ||||||
28 | which the
Chicago Bears professional football team is playing | ||||||
29 | in that stadium during the
renovation of Soldier Field, not | ||||||
30 | more than one and a half hours before the
start of the game and | ||||||
31 | not after the end of the third quarter of the game,
or by a | ||||||
32 | catering establishment which has rented facilities
from a board | ||||||
33 | of trustees of a public community college district, or, if
| ||||||
34 | approved by the District board, on land owned by the |
| |||||||
| |||||||
1 | Metropolitan Sanitary
District of Greater Chicago and leased to | ||||||
2 | others for a term of at least
20 years. Nothing in this Section | ||||||
3 | precludes the sale or delivery of
alcoholic liquor in the form | ||||||
4 | of original packaged goods in premises located
at 500 S. Racine | ||||||
5 | in Chicago belonging to the University of Illinois and
used | ||||||
6 | primarily as a grocery store by a commercial tenant during the | ||||||
7 | term of
a lease that predates the University's acquisition of | ||||||
8 | the premises; but the
University shall have no power or | ||||||
9 | authority to renew, transfer, or extend
the lease with terms | ||||||
10 | allowing the sale of alcoholic liquor; and the sale of
| ||||||
11 | alcoholic liquor shall be subject to all local laws and | ||||||
12 | regulations.
After the acquisition by Winnebago County of the | ||||||
13 | property located at 404
Elm Street in Rockford, a commercial | ||||||
14 | tenant who sold alcoholic liquor at
retail on a portion of the | ||||||
15 | property under a valid license at the time of
the acquisition | ||||||
16 | may continue to do so for so long as the tenant and the
County | ||||||
17 | may agree under existing or future leases, subject to all local | ||||||
18 | laws
and regulations regarding the sale of alcoholic liquor. | ||||||
19 | Each
facility shall provide dram shop liability in maximum | ||||||
20 | insurance coverage
limits so as to save harmless the State, | ||||||
21 | municipality, State university,
airport, golf course, faculty | ||||||
22 | center, facility in which conference and
convention type | ||||||
23 | activities take place, park district, Forest Preserve
| ||||||
24 | District, public community college district, aquarium, museum, | ||||||
25 | or sanitary
district from all financial loss, damage or harm. | ||||||
26 | Alcoholic liquors may be
sold at retail in buildings of golf | ||||||
27 | courses owned by municipalities in
connection with the | ||||||
28 | operation of an established food serving facility
during times | ||||||
29 | when food is dispensed for consumption upon the premises.
| ||||||
30 | Alcoholic liquors may be delivered to and sold at retail in any | ||||||
31 | building
owned by a fire protection district organized under | ||||||
32 | the Fire Protection
District Act, provided that such delivery | ||||||
33 | and sale is approved by the board
of trustees of the district, | ||||||
34 | and provided further that such delivery and
sale is limited to |
| |||||||
| |||||||
1 | fundraising events and to a maximum of 6 events per year.
| ||||||
2 | Alcoholic liquor may be delivered to and sold at retail in | ||||||
3 | the
Dorchester Senior Business Center owned by the Village of | ||||||
4 | Dolton if the
alcoholic liquor is sold or dispensed only in | ||||||
5 | connection with organized
functions for which the planned | ||||||
6 | attendance is 20 or more persons, and if
the person or facility | ||||||
7 | selling or dispensing the alcoholic liquor has
provided dram | ||||||
8 | shop liability insurance in maximum limits so as to hold
| ||||||
9 | harmless the Village of Dolton and the State from all financial | ||||||
10 | loss,
damage and harm.
| ||||||
11 | Alcoholic liquors may be delivered to and sold at retail in | ||||||
12 | any
building used as an Illinois State Armory provided:
| ||||||
13 | (i) the Adjutant General's written consent to the | ||||||
14 | issuance of a
license to sell alcoholic liquor in such | ||||||
15 | building is filed with the
Commission;
| ||||||
16 | (ii) the alcoholic liquor is sold or dispensed only in | ||||||
17 | connection
with organized functions held on special | ||||||
18 | occasions;
| ||||||
19 | (iii) the organized function is one for which the | ||||||
20 | planned attendance
is 25 or more persons; and
| ||||||
21 | (iv) the facility selling or dispensing the alcoholic | ||||||
22 | liquors has
provided dram shop liability insurance in | ||||||
23 | maximum limits so as to save
harmless the facility and the | ||||||
24 | State from all financial loss, damage or harm.
| ||||||
25 | Alcoholic liquors may be delivered to and sold at retail in | ||||||
26 | the Chicago
Civic Center, provided that:
| ||||||
27 | (i) the written consent of the Public Building | ||||||
28 | Commission which
administers the Chicago Civic Center is | ||||||
29 | filed with the Commission;
| ||||||
30 | (ii) the alcoholic liquor is sold or dispensed only in | ||||||
31 | connection with
organized functions held on special | ||||||
32 | occasions;
| ||||||
33 | (iii) the organized function is one for which the | ||||||
34 | planned attendance is
25 or more persons;
|
| |||||||
| |||||||
1 | (iv) the facility selling or dispensing the alcoholic | ||||||
2 | liquors has
provided dram shop liability insurance in | ||||||
3 | maximum limits so as to hold
harmless the Civic Center, the | ||||||
4 | City of Chicago and the State from all
financial loss, | ||||||
5 | damage or harm; and
| ||||||
6 | (v) all applicable local ordinances are complied with.
| ||||||
7 | Alcoholic liquors may be delivered or sold in any building | ||||||
8 | belonging to
or under the control of any city, village or | ||||||
9 | incorporated town where more
than 75% of the physical | ||||||
10 | properties of the building is used for commercial
or | ||||||
11 | recreational purposes, and the building is located upon a pier | ||||||
12 | extending
into or over the waters of a navigable lake or stream | ||||||
13 | or on the shore of a
navigable lake or stream. Alcoholic liquor | ||||||
14 | may be sold in buildings under
the control of the Department of | ||||||
15 | Natural Resources when written consent to
the issuance of a | ||||||
16 | license to sell alcoholic liquor in such buildings is
filed | ||||||
17 | with the Commission by the Department of Natural Resources.
| ||||||
18 | Alcoholic liquor may be served or delivered in buildings and | ||||||
19 | facilities under
the control
of the Department of Natural | ||||||
20 | Resources upon the written approval of the
Director of
Natural | ||||||
21 | Resources acting as the controlling government authority. The | ||||||
22 | Director
of
Natural Resources may specify conditions on that | ||||||
23 | approval, including but not
limited to
requirements for | ||||||
24 | insurance and hours of operation.
Notwithstanding any other | ||||||
25 | provision of this Act, alcoholic liquor sold by a
United States | ||||||
26 | Army Corps of Engineers or Department of Natural
Resources
| ||||||
27 | concessionaire who was operating on June 1, 1991 for | ||||||
28 | on-premises consumption
only is not subject to the provisions | ||||||
29 | of Articles IV and IX. Beer and wine
may be sold on the | ||||||
30 | premises of the Joliet Park District Stadium owned by
the | ||||||
31 | Joliet Park District when written consent to the issuance of a | ||||||
32 | license
to sell beer and wine in such premises is filed with | ||||||
33 | the local liquor
commissioner by the Joliet Park District. Beer | ||||||
34 | and wine may be sold in
buildings on the grounds of State |
| |||||||
| |||||||
1 | veterans' homes when written consent to
the issuance of a | ||||||
2 | license to sell beer and wine in such buildings is filed
with | ||||||
3 | the Commission by the Department of Veterans' Affairs, and the
| ||||||
4 | facility shall provide dram shop liability in maximum insurance | ||||||
5 | coverage
limits so as to save the facility harmless from all | ||||||
6 | financial loss, damage
or harm. Such liquors may be delivered | ||||||
7 | to and sold at any property owned or
held under lease by a | ||||||
8 | Metropolitan Pier and Exposition Authority or
Metropolitan | ||||||
9 | Exposition and Auditorium Authority.
| ||||||
10 | Beer and wine may be sold and dispensed at professional | ||||||
11 | sporting events
and at professional concerts and other | ||||||
12 | entertainment events conducted on
premises owned by the Forest | ||||||
13 | Preserve District of Kane County, subject to
the control of the | ||||||
14 | District Commissioners and applicable local law,
provided that | ||||||
15 | dram shop liability insurance is provided at maximum coverage
| ||||||
16 | limits so as to hold the District harmless from all financial | ||||||
17 | loss, damage
and harm.
| ||||||
18 | Nothing in this Section shall preclude the sale or delivery | ||||||
19 | of beer and
wine at a State or county fair or the sale or | ||||||
20 | delivery of beer or wine at a
city fair in any otherwise lawful | ||||||
21 | manner.
| ||||||
22 | Alcoholic liquors may be sold at retail in buildings in | ||||||
23 | State parks
under the control of the Department of Natural | ||||||
24 | Resources,
provided:
| ||||||
25 | a. the State park has overnight lodging facilities with | ||||||
26 | some
restaurant facilities or, not having overnight | ||||||
27 | lodging facilities, has
restaurant facilities which serve | ||||||
28 | complete luncheon and dinner or
supper meals,
| ||||||
29 | b. consent to the issuance of a license to sell | ||||||
30 | alcoholic liquors in
the buildings has been filed with the | ||||||
31 | commission by the Department of
Natural Resources, and
| ||||||
32 | c. the alcoholic liquors are sold by the State park | ||||||
33 | lodge or
restaurant concessionaire only during the hours | ||||||
34 | from 11 o'clock a.m. until
12 o'clock midnight. |
| |||||||
| |||||||
1 | Notwithstanding any other provision of this Act,
alcoholic | ||||||
2 | liquor sold by the State park or restaurant concessionaire | ||||||
3 | is not
subject to the provisions of Articles IV and IX.
| ||||||
4 | Alcoholic liquors may be sold at retail in buildings on | ||||||
5 | properties
under the control of the Historic Sites and | ||||||
6 | Preservation Division of the
Historic Preservation
Agency or | ||||||
7 | the Abraham Lincoln Presidential Library and Museum provided:
| ||||||
8 | a. the property has overnight lodging facilities with | ||||||
9 | some restaurant
facilities or, not having overnight | ||||||
10 | lodging facilities, has restaurant
facilities which serve | ||||||
11 | complete luncheon and dinner or supper meals,
| ||||||
12 | b. consent to the issuance of a license to sell | ||||||
13 | alcoholic liquors in
the buildings has been filed with the | ||||||
14 | commission by the Historic Sites and
Preservation Division
| ||||||
15 | of the Historic
Preservation Agency or the Abraham Lincoln | ||||||
16 | Presidential Library and Museum,
and
| ||||||
17 | c. the alcoholic liquors are sold by the lodge or | ||||||
18 | restaurant
concessionaire only during the hours from 11 | ||||||
19 | o'clock a.m. until 12 o'clock
midnight.
| ||||||
20 | The sale of alcoholic liquors pursuant to this Section does | ||||||
21 | not
authorize the establishment and operation of facilities | ||||||
22 | commonly called
taverns, saloons, bars, cocktail lounges, and | ||||||
23 | the like except as a part
of lodge and restaurant facilities in | ||||||
24 | State parks or golf courses owned
by Forest Preserve Districts | ||||||
25 | with a population of less than 3,000,000 or
municipalities or | ||||||
26 | park districts.
| ||||||
27 | Alcoholic liquors may be sold at retail in the Springfield
| ||||||
28 | Administration Building of the Department of Transportation | ||||||
29 | and the
Illinois State Armory in Springfield; provided, that | ||||||
30 | the controlling
government authority may consent to such sales | ||||||
31 | only if
| ||||||
32 | a. the request is from a not-for-profit organization;
| ||||||
33 | b. such sales would not impede normal operations of the | ||||||
34 | departments
involved;
|
| |||||||
| |||||||
1 | c. the not-for-profit organization provides dram shop | ||||||
2 | liability in
maximum insurance coverage limits and agrees | ||||||
3 | to defend, save harmless
and indemnify the State of | ||||||
4 | Illinois from all financial loss, damage or harm;
| ||||||
5 | d. no such sale shall be made during normal working | ||||||
6 | hours of the
State of Illinois; and
| ||||||
7 | e. the consent is in writing.
| ||||||
8 | Alcoholic liquors may be sold at retail in buildings in | ||||||
9 | recreational
areas of river conservancy districts under the | ||||||
10 | control of, or leased
from, the river conservancy districts. | ||||||
11 | Such sales are subject to
reasonable local regulations as | ||||||
12 | provided in Article IV; however, no such
regulations may | ||||||
13 | prohibit or substantially impair the sale of alcoholic
liquors | ||||||
14 | on Sundays or Holidays.
| ||||||
15 | Alcoholic liquors may be provided in long term care | ||||||
16 | facilities owned or
operated by a county under Division 5-21 or | ||||||
17 | 5-22 of the Counties Code,
when approved by the facility | ||||||
18 | operator and not in conflict
with the regulations of the | ||||||
19 | Illinois Department of Public Health, to
residents of the | ||||||
20 | facility who have had their consumption of the alcoholic
| ||||||
21 | liquors provided approved in writing by a physician licensed to | ||||||
22 | practice
medicine in all its branches.
| ||||||
23 | Alcoholic liquors may be delivered to and dispensed in | ||||||
24 | State housing
assigned to employees of the Department of | ||||||
25 | Corrections.
No person shall furnish or allow to be furnished | ||||||
26 | any alcoholic
liquors to any prisoner confined in any jail, | ||||||
27 | reformatory, prison or house
of correction except upon a | ||||||
28 | physician's prescription for medicinal purposes.
| ||||||
29 | Alcoholic liquors may be sold at retail or dispensed at the | ||||||
30 | Willard Ice
Building in Springfield, at the State Library in | ||||||
31 | Springfield, and at
Illinois State Museum facilities by (1) an
| ||||||
32 | agency of the State, whether legislative, judicial or | ||||||
33 | executive, provided
that such agency first obtains written | ||||||
34 | permission to sell or dispense
alcoholic liquors from the |
| |||||||
| |||||||
1 | controlling government authority, or by (2) a
not-for-profit | ||||||
2 | organization, provided that such organization:
| ||||||
3 | a. Obtains written consent from the controlling | ||||||
4 | government authority;
| ||||||
5 | b. Sells or dispenses the alcoholic liquors in a manner | ||||||
6 | that does not
impair normal operations of State offices | ||||||
7 | located in the building;
| ||||||
8 | c. Sells or dispenses alcoholic liquors only in | ||||||
9 | connection with an
official activity in the building;
| ||||||
10 | d. Provides, or its catering service provides, dram | ||||||
11 | shop liability
insurance in maximum coverage limits and in | ||||||
12 | which the carrier agrees to
defend, save harmless and | ||||||
13 | indemnify the State of Illinois from all
financial loss, | ||||||
14 | damage or harm arising out of the selling or dispensing of
| ||||||
15 | alcoholic liquors.
| ||||||
16 | Nothing in this Act shall prevent a not-for-profit | ||||||
17 | organization or agency
of the State from employing the services | ||||||
18 | of a catering establishment for
the selling or dispensing of | ||||||
19 | alcoholic liquors at authorized functions.
| ||||||
20 | The controlling government authority for the Willard Ice | ||||||
21 | Building in
Springfield shall be the Director of the Department | ||||||
22 | of Revenue. The
controlling government authority for Illinois | ||||||
23 | State Museum facilities shall
be the Director of the Illinois | ||||||
24 | State Museum. The controlling government
authority for the | ||||||
25 | State Library in Springfield shall be the Secretary of State.
| ||||||
26 | Alcoholic liquors may be delivered to and sold at retail or | ||||||
27 | dispensed
at any facility, property or building under the | ||||||
28 | jurisdiction of the
Historic Sites and Preservation Division of | ||||||
29 | the
Historic Preservation Agency
or the Abraham
Lincoln | ||||||
30 | Presidential Library and Museum
where the delivery, sale or
| ||||||
31 | dispensing is by (1)
an agency of the State, whether | ||||||
32 | legislative, judicial or executive,
provided that such agency | ||||||
33 | first obtains written permission to sell or
dispense alcoholic | ||||||
34 | liquors from a controlling government authority, or by (2) a
|
| |||||||
| |||||||
1 | not-for-profit organization provided that such organization:
| ||||||
2 | a. Obtains written consent from the controlling | ||||||
3 | government authority;
| ||||||
4 | b. Sells or dispenses the alcoholic liquors in a manner | ||||||
5 | that does not
impair normal workings of State offices or | ||||||
6 | operations located at the
facility, property or building;
| ||||||
7 | c. Sells or dispenses alcoholic liquors only in | ||||||
8 | connection with an
official activity of the not-for-profit | ||||||
9 | organization in the facility,
property or building;
| ||||||
10 | d. Provides, or its catering service provides, dram | ||||||
11 | shop liability
insurance in maximum coverage limits and in | ||||||
12 | which the carrier agrees to
defend, save harmless and | ||||||
13 | indemnify the State of Illinois from all
financial loss, | ||||||
14 | damage or harm arising out of the selling or dispensing of
| ||||||
15 | alcoholic liquors.
| ||||||
16 | The controlling government authority for the
Historic | ||||||
17 | Sites and Preservation Division of the
Historic Preservation | ||||||
18 | Agency
shall be the Director of the Historic Sites and | ||||||
19 | Preservation, and the
controlling
government authority for the | ||||||
20 | Abraham Lincoln Presidential Library and Museum
shall be the | ||||||
21 | Director of the Abraham Lincoln Presidential Library and | ||||||
22 | Museum.
| ||||||
23 | Alcoholic liquors may be sold at retail or dispensed at the | ||||||
24 | James R.
Thompson Center in Chicago, subject to the provisions | ||||||
25 | of Section 7.4 of the
State Property Control Act, and 222 South | ||||||
26 | College Street in Springfield,
Illinois by (1) a commercial | ||||||
27 | tenant or subtenant conducting business on the
premises under a | ||||||
28 | lease or sublease made pursuant to Section 405-315 of the
| ||||||
29 | Department of Central Management Services Law (20 ILCS | ||||||
30 | 405/405-315), provided
that such tenant or subtenant who
sells | ||||||
31 | or dispenses alcoholic liquors shall procure and maintain dram | ||||||
32 | shop
liability insurance in maximum coverage limits and in | ||||||
33 | which the carrier
agrees to defend, indemnify and save harmless | ||||||
34 | the State of Illinois from
all financial loss, damage or harm |
| |||||||
| |||||||
1 | arising out of the sale or dispensing of
alcoholic liquors, or | ||||||
2 | by (2) an agency of the State, whether legislative,
judicial or | ||||||
3 | executive, provided that such agency first obtains written
| ||||||
4 | permission to sell or dispense alcoholic liquors from the | ||||||
5 | Director of
Central Management Services, or by (3) a | ||||||
6 | not-for-profit organization,
provided that such organization:
| ||||||
7 | a. Obtains written consent from the Department of | ||||||
8 | Central Management
Services;
| ||||||
9 | b. Sells or dispenses the alcoholic liquors in a manner | ||||||
10 | that does not
impair normal operations of State offices | ||||||
11 | located in the building;
| ||||||

under Article VII, Section 6, subsection (h) of the | ||||||

of the power of a home rule municipality |

21 | Sec. 6-15. No alcoholic liquors shall be sold or delivered | ||||||
22 | in any
building belonging to or under the control of the State | ||||||
23 | or any political
subdivision thereof except as provided in this | ||||||
24 | Act. The corporate
authorities of any city, village, | ||||||
25 | incorporated town or township may provide by
ordinance, | ||||||
26 | however, that alcoholic liquor may be sold or delivered in any
| ||||||
27 | specifically designated building belonging to or under the | ||||||
28 | control of the
municipality or township, or in any building | ||||||
29 | located on land under the
control of the municipality; provided | ||||||
30 | that such township complies with all
applicable local | ||||||
31 | ordinances in any incorporated area of the township.
Alcoholic | ||||||
32 | liquor may be delivered to and sold under the authority of a | ||||||
33 | special use permit on any property owned by a conservation |

1 | district organized under the Conservation District Act, | ||||||
2 | provided that (i) the alcoholic liquor is sold only at an event | ||||||
3 | authorized by the governing board of the conservation district, | ||||||

27 | district, or members of an organization of

28 | faculty or staff of the State university or a public

29 | college district are active participants in the conference
or | ||||||
30 | convention, or in Memorial Stadium on the campus of the | ||||||
31 | University of
Illinois at Urbana-Champaign during games in | ||||||
32 | which the
Chicago Bears professional football team is playing | ||||||
33 | in that stadium during the
renovation of Soldier Field, not | ||||||
34 | more than one and a half hours before the
start of the game and |

| |||||||
1 | not after the end of the third quarter of the game,
or by a | ||||||
2 | catering establishment which has rented facilities
from a board | ||||||
3 | of trustees of a public community college district, or, if
| ||||||
4 | approved by the District board, on land owned by the | ||||||
5 | Metropolitan Sanitary
District of Greater Chicago and leased to | ||||||
6 | others for a term of at least
20 years. Nothing in this Section | ||||||
7 | precludes the sale or delivery of
alcoholic liquor in the form | ||||||
8 | of original packaged goods in premises located
at 500 S. Racine | ||||||
9 | in Chicago belonging to the University of Illinois and
used | ||||||
10 | primarily as a grocery store by a commercial tenant during the | ||||||
11 | term of
a lease that predates the University's acquisition of | ||||||
12 | the premises; but the
University shall have no power or | ||||||
13 | authority to renew, transfer, or extend
the lease with terms | ||||||
14 | allowing the sale of alcoholic liquor; and the sale of
| ||||||
15 | alcoholic liquor shall be subject to all local laws and | ||||||
16 | regulations.
After the acquisition by Winnebago County of the | ||||||
17 | property located at 404
Elm Street in Rockford, a commercial | ||||||
18 | tenant who sold alcoholic liquor at
retail on a portion of the | ||||||
19 | property under a valid license at the time of
the acquisition | ||||||
20 | may continue to do so for so long as the tenant and the
County | ||||||
21 | may agree under existing or future leases, subject to all local | ||||||
22 | laws
and regulations regarding the sale of alcoholic liquor. | ||||||
23 | Each
facility shall provide dram shop liability in maximum | ||||||
24 | insurance coverage
limits so as to save harmless the State, | ||||||
25 | municipality, State university,
airport, golf course, faculty | ||||||
26 | center, facility in which conference and
convention type | ||||||
27 | activities take place, park district, Forest Preserve
| ||||||
28 | District, public community college district, aquarium, museum, | ||||||
29 | or sanitary
district from all financial loss, damage or harm. | ||||||
30 | Alcoholic liquors may be
sold at retail in buildings of golf | ||||||
31 | courses owned by municipalities in
connection with the | ||||||
32 | operation of an established food serving facility
during times | ||||||
33 | when food is dispensed for consumption upon the premises.

34 | Alcoholic liquors may be delivered to and sold at retail in any |
| |||||||
| |||||||
1 | building
owned by a fire protection district organized under | ||||||
2 | the Fire Protection
District Act, provided that such delivery | ||||||
3 | and sale is approved by the board
of trustees of the district, | ||||||
4 | and provided further that such delivery and
sale is limited to | ||||||
5 | fundraising events and to a maximum of 6 events per year.

6 | Alcoholic liquor may be delivered to and sold at retail in | ||||||

Dorchester Senior Business Center owned by the Village of | ||||||
8 | Dolton if the
alcoholic liquor is sold or dispensed only in | ||||||
9 | connection with organized
functions for which the planned | ||||||
10 | attendance is 20 or more persons, and if
the person or facility | ||||||
11 | selling or dispensing the alcoholic liquor has
provided dram | ||||||
12 | shop liability insurance in maximum limits so as to hold
| ||||||
13 | harmless the Village of Dolton and the State from all financial | ||||||
14 | loss,
damage and harm.
| ||||||
15 | Alcoholic liquors may be delivered to and sold at retail in | ||||||
16 | any
building used as an Illinois State Armory provided:
| ||||||
17 | (i) the Adjutant General's written consent to the | ||||||
18 | issuance of a
license to sell alcoholic liquor in such | ||||||
19 | building is filed with the
Commission;
| ||||||
20 | (ii) the alcoholic liquor is sold or dispensed only in | ||||||
21 | connection
with organized functions held on special | ||||||
22 | occasions;
| ||||||
23 | (iii) the organized function is one for which the | ||||||
24 | planned attendance
is 25 or more persons; and
| ||||||
25 | (iv) the facility selling or dispensing the alcoholic | ||||||
26 | liquors has
provided dram shop liability insurance in | ||||||
27 | maximum limits so as to save
harmless the facility and the | ||||||
28 | State from all financial loss, damage or harm.
| ||||||
29 | Alcoholic liquors may be delivered to and sold at retail in | ||||||
30 | the Chicago
Civic Center, provided that:
| ||||||
31 | (i) the written consent of the Public Building | ||||||
32 | Commission which
administers the Chicago Civic Center is | ||||||
33 | filed with the Commission;
| ||||||
34 | (ii) the alcoholic liquor is sold or dispensed only in |
| |||||||
| |||||||
1 | connection with
organized functions held on special | ||||||
2 | occasions;
| ||||||
3 | (iii) the organized function is one for which the | ||||||
4 | planned attendance is
25 or more persons;
| ||||||
5 | (iv) the facility selling or dispensing the alcoholic | ||||||
6 | liquors has
provided dram shop liability insurance in | ||||||
7 | maximum limits so as to hold
harmless the Civic Center, the | ||||||
8 | City of Chicago and the State from all
financial loss, | ||||||
9 | damage or harm; and
| ||||||
10 | (v) all applicable local ordinances are complied with.
| ||||||
11 | Alcoholic liquors may be delivered or sold in any building | ||||||
12 | belonging to
or under the control of any city, village or | ||||||
13 | incorporated town where more
than 75% of the physical | ||||||
14 | properties of the building is used for commercial
or | ||||||
15 | recreational purposes, and the building is located upon a pier | ||||||
16 | extending
into or over the waters of a navigable lake or stream | ||||||
17 | or on the shore of a
navigable lake or stream. Alcoholic liquor | ||||||
18 | may be sold in buildings under
the control of the Department of | ||||||
19 | Natural Resources when written consent to
the issuance of a | ||||||
20 | license to sell alcoholic liquor in such buildings is
filed | ||||||
21 | with the Commission by the Department of Natural Resources.
| ||||||
22 | Alcoholic liquor may be served or delivered in buildings and | ||||||
23 | facilities under
the control
of the Department of Natural | ||||||
24 | Resources upon the written approval of the
Director of
Natural | ||||||
25 | Resources acting as the controlling government authority. The | ||||||
26 | Director
of
Natural Resources may specify conditions on that | ||||||
27 | approval, including but not
limited to
requirements for | ||||||
28 | insurance and hours of operation.
Notwithstanding any other | ||||||
29 | provision of this Act, alcoholic liquor sold by a
United States | ||||||
30 | Army Corps of Engineers or Department of Natural
Resources
| ||||||
31 | concessionaire who was operating on June 1, 1991 for | ||||||
32 | on-premises consumption
only is not subject to the provisions | ||||||
33 | of Articles IV and IX. Beer and wine
may be sold on the | ||||||
34 | premises of the Joliet Park District Stadium owned by
the |
| |||||||
| |||||||
1 | Joliet Park District when written consent to the issuance of a | ||||||
2 | license
to sell beer and wine in such premises is filed with | ||||||
3 | the local liquor
commissioner by the Joliet Park District. Beer | ||||||
4 | and wine may be sold in
buildings on the grounds of State | ||||||
5 | veterans' homes when written consent to
the issuance of a | ||||||
6 | license to sell beer and wine in such buildings is filed
with | ||||||
7 | the Commission by the Department of Veterans' Affairs, and the
| ||||||
8 | facility shall provide dram shop liability in maximum insurance | ||||||
9 | coverage
limits so as to save the facility harmless from all | ||||||
10 | financial loss, damage
or harm. Such liquors may be delivered | ||||||
11 | to and sold at any property owned or
held under lease by a | ||||||
12 | Metropolitan Pier and Exposition Authority or
Metropolitan | ||||||
13 | Exposition and Auditorium Authority.
| ||||||
14 | Beer and wine may be sold and dispensed at professional | ||||||
15 | sporting events
and at professional concerts and other | ||||||
16 | entertainment events conducted on
premises owned by the Forest | ||||||
17 | Preserve District of Kane County, subject to
the control of the | ||||||
18 | District Commissioners and applicable local law,
provided that | ||||||
19 | dram shop liability insurance is provided at maximum coverage
| ||||||
20 | limits so as to hold the District harmless from all financial | ||||||
21 | loss, damage
and harm.
| ||||||
22 | Nothing in this Section shall preclude the sale or delivery | ||||||
23 | of beer and
wine at a State or county fair or the sale or | ||||||
24 | delivery of beer or wine at a
city fair in any otherwise lawful | ||||||
25 | manner.
| ||||||
26 | Alcoholic liquors may be sold at retail in buildings in | ||||||
27 | State parks
under the control of the Department of Natural | ||||||
28 | Resources,
provided:
| ||||||
29 | a. the State park has overnight lodging facilities with | ||||||
30 | some
restaurant facilities or, not having overnight | ||||||
31 | lodging facilities, has
restaurant facilities which serve | ||||||
32 | complete luncheon and dinner or
supper meals,
| ||||||
33 | b. consent to the issuance of a license to sell | ||||||
34 | alcoholic liquors in
the buildings has been filed with the |
| |||||||
| |||||||
1 | commission by the Department of
Natural Resources, and
| ||||||
2 | c. the alcoholic liquors are sold by the State park | ||||||
3 | lodge or
restaurant concessionaire only during the hours | ||||||
4 | from 11 o'clock a.m. until
12 o'clock midnight. | ||||||
5 | Notwithstanding any other provision of this Act,
alcoholic | ||||||
6 | liquor sold by the State park or restaurant concessionaire | ||||||

24 | The sale of alcoholic liquors pursuant to this Section does | ||||||
25 | not
authorize the establishment and operation of facilities | ||||||
26 | commonly called
taverns, saloons, bars, cocktail lounges, and | ||||||
27 | the like except as a part
of lodge and restaurant facilities in | ||||||
28 | State parks or golf courses owned
by Forest Preserve Districts | ||||||
29 | with a population of less than 3,000,000 or
municipalities or | ||||||
30 | park districts.
| ||||||
31 | Alcoholic liquors may be sold at retail in the Springfield
| ||||||
32 | Administration Building of the Department of Transportation | ||||||
33 | and the
Illinois State Armory in Springfield; provided, that | ||||||
34 | the controlling
government authority may consent to such sales |
| |||||||
| |||||||
1 | only if
| ||||||
2 | a. the request is from a not-for-profit organization;
| ||||||
3 | b. such sales would not impede normal operations of the | ||||||
4 | departments
involved;
| ||||||
5 | c. the not-for-profit organization provides dram shop | ||||||

maximum insurance coverage limits and agrees | ||||||
7 | to defend, save harmless
and indemnify the State of | ||||||
8 | Illinois from all financial loss, damage or harm;

9 | d. no such sale shall be made during normal working | ||||||

State of Illinois; and
| ||||||
11 | e. the consent is in writing.
| ||||||
12 | Alcoholic liquors may be sold at retail in buildings in | ||||||
13 | recreational
areas of river conservancy districts under the | ||||||
14 | control of, or leased
from, the river conservancy districts. | ||||||
15 | Such sales are subject to
reasonable local regulations as | ||||||
16 | provided in Article IV; however, no such
regulations may | ||||||
17 | prohibit or substantially impair the sale of alcoholic
liquors | ||||||
18 | on Sundays or Holidays.
| ||||||
19 | Alcoholic liquors may be provided in long term care | ||||||
20 | facilities owned or
operated by a county under Division 5-21 or | ||||||
21 | 5-22 of the Counties Code,
when approved by the facility | ||||||
22 | operator and not in conflict
with the regulations of the | ||||||
23 | Illinois Department of Public Health, to
residents of the | ||||||
24 | facility who have had their consumption of the alcoholic
| ||||||
25 | liquors provided approved in writing by a physician licensed to | ||||||
26 | practice
medicine in all its branches.

27 | Alcoholic liquors may be delivered to and dispensed in | ||||||
28 | State housing
assigned to employees of the Department of | ||||||
29 | Corrections.
No person shall furnish or allow to be furnished | ||||||
30 | any alcoholic
liquors to any prisoner confined in any jail, | ||||||
31 | reformatory, prison or house
of correction except upon a | ||||||
32 | physician's prescription for medicinal purposes.

consumption at the Michael Bilandic Building at | ||||||
29 | 160 North LaSalle Street,
Chicago IL 60601, after the normal | ||||||
30 | business hours of any day care or child care
facility located | ||||||
31 | in the building, by (1) a commercial tenant or subtenant
| ||||||
32 | conducting business on the premises under a lease made pursuant | ||||||
33 | to Section
405-315 of the Department of Central Management | ||||||
34 | Services Law (20 ILCS

land held in trust for any school district | ||||||

the School Code, if the building | ||||||
14 | is not used for school purposes and if the
sale or delivery is | ||||||
15 | approved by the board of education.

16 | Alcoholic liquors may be sold or delivered in buildings | ||||||

by the Community Building Complex Committee of Boone | ||||||
18 | County,
Illinois if the person or facility selling or | ||||||

alcoholic liquor has provided dram shop | ||||||
20 | liability insurance with coverage and
in amounts that the | ||||||
21 | Committee reasonably determines are necessary.
