1     AN ACT in relation to Human Services.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Human Services Act is amended
5 by changing Section 80-5 and the Article 80 heading as follows:

8 EVALUATION AND
TRANSITION PROVISIONS

10     Sec. 80-5. Task Force on the Department of Human Services
11 Consolidation.
12     (a) There is hereby established a Task Force on the
13 Department of Human Services Consolidation.
14     (b) The Task Force shall consist of 7 voting members, as
15 follows: one person appointed by the Governor, who shall serve
16 as chair of the Task Force; 2 members appointed by the
17 President of the Senate, one of whom shall be designated a vice
18 chair at the time of appointment; one member appointed by the
19 Senate Minority Leader; 2 members appointed by the Speaker of
20 the House of Representatives, one of whom shall be designated a
21 vice chair at the time of appointment; and one member appointed
22 by the House Minority Leader.
23     Members appointed by the legislative leaders shall be
24 appointed for the duration of the Task Force; in the event of a
25 vacancy, the appointment to fill the vacancy shall be made by
26 the legislative leader of the same house and party as the
27 leader who made the original appointment. The Governor may at
28 any time terminate the service of the person appointed by the
29 Governor and reappoint a different person to serve as chair of
30 the Task Force.

1 officio, as nonvoting members of the Task Force: the Director
2 of Public Health, the Director of Public Aid, the Director of
3 Children and Family Services, the Director of the Bureau of the
4 Budget, and the Secretary of Human Services , until their
5 offices are abolished, the Director of Mental Health and
6 Developmental Disabilities, the Director of Rehabilitation
7 Services, and the Director of Alcoholism and Substance Abuse.
8 The Governor may appoint up to 3 additional persons to serve as
9 nonvoting members of the Task Force, who may be technical
10 consultants from ; such persons shall be officers or employees
11 of a constitutional office or of a department or agency of the
12 executive branch.
13     The Task Force may begin to conduct business upon the
14 appointment of a majority of the voting members. If the chair
15 has not been appointed but both vice chairs have been
16 appointed, the 2 vice chairs shall preside jointly. If the
17 chair has not been appointed and only one vice chair has been
18 appointed, that vice chair shall preside.
19     Members shall serve without compensation but may be
20 reimbursed for their expenses.
21     (c) The Task Force shall gather information and make
22 recommendations relating to the performance of the Illinois
23 Department of Human Services since its creation under this Act,
24 with respect to its success in achieving the goals and
25 objectives of the human services consolidation, the
26 effectiveness of its structure and function, and its impact on
27 the delivery of programs and services. planning, organization,
28 and implementation of human services consolidation. The Task
29 Force shall work to assure that the human services delivery
30 system is meeting meets and adhering adheres to the goals of
31 quality, efficiency, accountability, and financial
32 responsibility; to make recommendations in keeping with those
33 goals concerning the design, operation, and organizational
34 structure of the new Department of Human Services; and to
35 recommend any necessary implementing legislation for the
36 improvement of programs and services under the jurisdiction of

1 the Department of Human Services.
2     The Task Force shall evaluate monitor the implementation of
3 human service program reorganization and shall study its effect
4 on the delivery of services to the citizens of Illinois. The
5 Task Force shall make recommendations to the Governor and the
6 General Assembly regarding the effect of the future
7 consolidation of human service programs and functions.
8     (d) The Task Force shall:
9         (1) review and make recommendations on the
10     organizational structure of the new Department of Human
11     Services;
12         (2) review the status of and approve plans for a
13     unified electronic management and intake information and
14     reporting system as provided in Section 1-25, and monitor
15     and guide the implementation of the system;
16         (3) review the progress that the Department has made
17     toward and make recommendations on the consolidation or
18     elimination of fragmented or duplicative programs;
19         (4) monitor and review the progress that the Department
20     has made on maximizing make recommendations on how best to
21     maximize future federal funding for the new Department of
22     Human Services, with specific specifically including
23     consideration of any federal Medicaid, welfare, or block
24     grant reforms that have been authorized to enhance State
25     programs and services reform;
26         (5) review the progress that the Department has made
27     and make recommendations on geographic regionalization;
28         (6) review the progress that the Department has made
29     and make recommendations on the development of common
30     intake and client confidentiality processes;
31         (7) review the progress that the Department has made
32     with respect and make recommendations to foster effective
33     community-based privatization;
34         (8) obtain a management audit of the Department of
35     Human Services Children and Family Services, to be
36     completed and submitted to the Task Force no later than

1     March 1, 2005, which shall include a preliminary review and
2     findings regarding the effect that the consolidation has
3     had on programs and services for the mentally ill and
4     developmentally disabled, individuals currently receiving
5     services under the Office of Rehabilitation Services, and
6     individuals in the substance abuse prevention and
7     treatment programs July 1, 1997; and
8         (9) review any other appropriate matter and make
9     recommendations to assure a high quality, efficient,
10     accountable, and financially responsible system for the
11     delivery of human services to the people of Illinois.
12     (e) The Task Force may hire any necessary staff or
13 consultants, enter into contracts, and make any expenditures
14 necessary for carrying out its duties, all out of moneys
15 appropriated for that purpose. Staff support services may be
16 provided to the Task Force by the Office of the Governor, the
17 agencies of State government represented on the Task Force by
18 ex officio members directly involved in the reorganization of
19 the delivery of human services, and appropriate legislative
20 staff.
21     (f) The Task Force may establish an advisory committee to
22 ensure maximum public participation in the Task Force's
23 planning, organization, and implementation review process. If
24 established, the advisory committee shall (1) advise and assist
25 the Task Force in its duties, (2) help the Task Force to
26 identify issues of public concern, and (3) meet at least
27 quarterly.
28     (g) The Task Force shall submit preliminary reports of its
29 findings and recommendations to the Governor and the General
30 Assembly by January 1, 2005 and March 1, 2005, and a final
31 report by September 1, 2005 February 1, 1997 and February 1,
32 1998 and a final report by January 1, 1999. It may submit other
33 reports as it deems appropriate.
34     (h) The Task Force is abolished on January 1, 2006 February
35 1, 1999.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.
