Amends the Firearm Owners Identification Card Act. Provides that it is an
affirmative defense to a violation of a municipal ordinance that regulates the
acquisition, possession, sale, or transfer of firearms that the municipality
has failed to submit a copy of that ordinance to the Department of State
Police. Effective immediately.

| AN ACT in relation to firearms.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Firearm Owners Identification Card Act is |
5 |
| amended by changing
Section 13.3 as follows:
|

| (430 ILCS 65/13.3)
|

| Sec. 13.3. Municipal ordinance submission ; affirmative |
8 |
| defense .
|

| (a) Within 6 months after the
effective date of
this |
10 |
| amendatory Act of the 92nd General Assembly, every municipality |
11 |
| must
submit
to the Department of State Police a copy of every |
12 |
| ordinance adopted by the
municipality
that regulates the |
13 |
| acquisition, possession, sale, or transfer of firearms
within |
14 |
| the
municipality
and must submit, 30 days after adoption, every |
15 |
| such ordinance
adopted
after its initial submission of |
16 |
| ordinances under this Section. The Department
of State Police |
17 |
| shall compile these ordinances and
publish
them in a form |
18 |
| available to the public free of charge and shall periodically
|
19 |
| update this
compilation of ordinances in a manner prescribed by |
20 |
| the Director of State
Police.

| (b) It is an affirmative defense to a violation of a |
22 |
| municipal ordinance
that regulates the acquisition, |
23 |
| possession, sale, or transfer of firearms that
the municipality |
24 |
| has failed to submit a copy of that ordinance to the
Department |
25 |
| of State Police.

| Section 99. Effective date. This Act takes effect upon |

| becoming law. |
