| AN ACT concerning schools.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The School Code is amended by adding Sections |
5 |
| 10-20.39 and 34-18.30 as follows: |

| Sec. 10-20.39. Vending machines; soft drinks and candy |
8 |
| prohibited. Beginning no later than January 1, 2005, each |
9 |
| school board must prohibit soft drinks and candy from being |
10 |
| dispensed to students by school vending machines. |

| Section 90. The State Mandates Act is amended by adding |

| Section 8.28 as
follows:

| Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8 |

| of this
Act, no reimbursement by the State is required for the |
21 |
| implementation of
any mandate created by this amendatory Act of |
22 |
| the 93rd General Assembly.

| Section 99. Effective date. This Act takes effect upon |
24 |
| becoming law.
