 1        AN ACT regarding education.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section    5.    The   Critical   Health   Problems   and
 5    Comprehensive Health Education Act  is  amended  by  changing
 6    Section 3 as follows:

 7        (105 ILCS 110/3) (from Ch. 122, par. 863)
 8        Sec.  3.  Comprehensive  Health  Education  Program.  The
 9    program  established under this Act shall include, but not be
10    limited to, the following major educational areas as a  basis
11    for curricula in all elementary and secondary schools in this
12    State:   human   ecology   and   health,   human  growth  and
13    development,  the  emotional,  psychological,  physiological,
14    hygienic  and  social  responsibilities   of   family   life,
15    including  sexual  abstinence  until marriage, prevention and
16    control of disease, including instruction in grades 6 through
17    12 on the prevention, transmission and spread of AIDS, public
18    and environmental health, consumer health,  safety  education
19    and  disaster  survival, mental health and illness (including
20    instruction in secondary schools on clinical  depression  and
21    suicide  prevention),  personal  health habits, alcohol, drug
22    use, and abuse including the medical and legal  ramifications
23    of  alcohol,  drug,  and tobacco use, abuse during pregnancy,
24    sexual abstinence until  marriage,  tobacco,  nutrition,  and
25    dental  health.  Notwithstanding the above educational areas,
26    the following areas may also  be  included  as  a  basis  for
27    curricula  in  all  elementary  and secondary schools in this
28    State: basic  first  aid  (including,  but  not  limited  to,
29    cardiopulmonary  resuscitation  and  the  Heimlich maneuver),
30    early prevention and  detection  of  cancer,  heart  disease,
31    diabetes, stroke, and the prevention of child abuse, neglect,

 1    and  suicide.  The school board of each public elementary and
 2    secondary school in the State shall  encourage  all  teachers
 3    and  other school personnel to acquire, develop, and maintain
 4    the knowledge and skills  necessary  to  properly  administer
 5    life-saving  techniques,  including  without  limitation  the
 6    Heimlich maneuver and rescue breathing. The training shall be
 7    in  accordance  with standards of the American Red Cross, the
 8    American Heart Association, or another nationally  recognized
 9    certifying organization.  A school board may use the services
10    of  non-governmental  entities whose personnel have expertise
11    in life-saving techniques  to  instruct  teachers  and  other
12    school  personnel  in these techniques.  Each school board is
13    encouraged to have in its employ, or on its volunteer  staff,
14    at  least  one  person  who is certified, by the American Red
15    Cross or by another qualified certifying agency, as qualified
16    to administer first aid  and  cardiopulmonary  resuscitation.
17    In  addition,  each  school  board  is authorized to allocate
18    appropriate portions of its institute or  inservice  days  to
19    conduct  training  programs  for  teachers  and  other school
20    personnel  who  have  expressed  an  interest   in   becoming
21    qualified    to    administer    emergency   first   aid   or
22    cardiopulmonary resuscitation.  School boards  are  urged  to
23    encourage their teachers and other school personnel who coach
24    school  athletic  programs  and  other extracurricular school
25    activities to acquire, develop, and  maintain  the  knowledge
26    and  skills  necessary  to  properly administer first aid and
27    cardiopulmonary resuscitation in  accordance  with  standards
28    and  requirements  established  by  the American Red Cross or
29    another  qualified  certifying  agency.  No  pupil  shall  be
30    required to take or participate in any  class  or  course  on
31    AIDS  or  family  life  instruction if his parent or guardian
32    submits written objection thereto, and  refusal  to  take  or
33    participate  in the course or program shall not be reason for
34    suspension or expulsion of the pupil.

 1        Curricula  developed  under   programs   established   in
 2    accordance  with  this  Act  in the major educational area of
 3    alcohol and  drug  use  and  abuse  shall  include  classroom
 4    instruction  in  grades  5 through 12. The instruction, which
 5    shall include matters relating to both the physical and legal
 6    effects and ramifications of drug and substance abuse,  shall
 7    be integrated into existing curricula; and the State Board of
 8    Education  shall develop and make available to all elementary
 9    and secondary schools in this State  instructional  materials
10    and guidelines which will assist the schools in incorporating
11    the  instruction into their existing curricula.  In addition,
12    school districts may offer, as  part  of  existing  curricula
13    during  the school day or as part of an after school program,
14    support services and instruction for pupils or  pupils  whose
15    parent, parents, or guardians are chemically dependent.

17        Section  90.  The State Mandates Act is amended by adding
18    Section 8.28 as follows:

19        (30 ILCS 805/8.28 new)
20        Sec. 8.28. Exempt mandate.   Notwithstanding  Sections  6
21    and  8 of this Act, no reimbursement by the State is required
22    for  the  implementation  of  any  mandate  created  by  this
23    amendatory Act of the 93rd General Assembly.
