093_HB3874 LRB093 13346 RCE 19195 b 1 AN ACT concerning education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The University of Illinois Trustees Act is 5 amended by changing Section 1 as follows: 6 (110 ILCS 310/1) (from Ch. 144, par. 41) 7 Sec. 1. The Board of Trustees of the University of 8 Illinois shall consist of the Governor and at least 12 9 trustees. Nine trustees shall be appointed by the Governor, 10 from a list of nominees as provided in this Section and by 11 and with the advice and consent of the Senate. The other 12 trustees shall be students, of whom one student shall be 13 selected from each University campus. 14 Each student trustee shall serve a term of one year, 15 beginning on July 1 or on the date of his or her selection, 16 whichever is later, and expiring on the next succeeding June 17 30. 18 Each trustee shall have all of the privileges of 19 membership, except that only one student trustee shall have 20 the right to cast a legally binding vote. The Governor shall 21 designate which one of the student trustees shall possess, 22 for his or her entire term, the right to cast a legally 23 binding vote. Each student trustee who does not possess the 24 right to cast a legally binding vote shall have the right to 25 cast an advisory vote and the right to make and second 26 motions and to attend executive sessions. 27 Each trustee shall be governed by the same conflict of 28 interest standards. Pursuant to those standards, it shall not 29 be a conflict of interest for a student trustee to vote on 30 matters pertaining to students generally, such as tuition and 31 fees. However, it shall be a conflict of interest for a -2- LRB093 13346 RCE 19195 b 1 student trustee to vote on faculty member tenure or 2 promotion. Student trustees shall be chosen by campus-wide 3 student election, and the student trustee designated by the 4 Governor to possess a legally binding vote shall be one of 5 the students selected by this method. A student trustee who 6 does not possess a legally binding vote on a measure at a 7 meeting of the Board or any of its committees shall not be 8 considered a trustee for the purpose of determining whether a 9 quorum is present at the time that measure is voted upon. 10 To be eligible for selection as a student trustee and to be 11 eligible to remain as a voting or nonvoting student trustee, 12 a student trustee must be a resident of this State, must have 13 and maintain a grade point average that is equivalent to at 14 least 2.5 on a 4.0 scale, and must be a full time student 15 enrolled at all times during his or her term of office except 16 for that part of the term which follows the completion of 17 the last full regular semester of an academic year and 18 precedes the first full regular semester of the succeeding 19 academic year at the University (sometimes commonly referred 20 to as the summer session or summer school). If a voting or 21 nonvoting student trustee fails to continue to meet or 22 maintain the residency, minimum grade point average, or 23 enrollment requirement established by this Section, his or 24 her membership on the Board shall be deemed to have 25 terminated by operation of law. 26 If a voting student trustee resigns or otherwise ceases 27 to serve on the Board, the Governor shall, within 30 days, 28 designate one of the remaining student trustees to possess 29 the right to cast a legally binding vote for the remainder of 30 his or her term. If a nonvoting student trustee resigns or 31 otherwise ceases to serve on the Board, the chief executive 32 of the student government from that campus shall, within 30 33 days, select a new nonvoting student trustee to serve for the 34 remainder of the term. -3- LRB093 13346 RCE 19195 b 1 No more than 5 of the 9 appointed trustees shall be 2 affiliated with the same political party. Each trustee 3 appointed by the Governor must be a resident of this State. 4 A failure to meet or maintain this residency requirement 5 constitutes a resignation from and creates a vacancy in the 6 Board. The term of office of each appointed trustee shall be 7 6 years from the third Monday in January of each odd numbered 8 year. The regular terms of office of the appointed trustees 9 shall be staggered so that 3 terms expire in each 10 odd-numbered year. 11 Vacancies for appointed trustees shall be filled for the 12 unexpired term in the same manner as original appointments. 13 If a vacancy in membership occurs at a time when the Senate 14 is not in session, the Governor shall make temporary 15 appointments until the next meeting of the Senate, when he 16 shall appoint persons to fill such memberships for the 17 remainder of their respective terms. If the Senate is not in 18 session when appointments for a full term are made, 19 appointments shall be made as in the case of vacancies. 20 No action of the board shall be invalidated by reason of 21 any vacancies on the board, or by reason of any failure to 22 select student trustees. 23 The Governor must make appointments from a list of 24 nominees submitted to the Governor by the university's alumni 25 association. If a vacancy will occur because a member's term 26 will end, then the alumni association must submit its list of 27 nominees to the Governor at least 90 days before the end of 28 the term. If a vacancy otherwise occurs, then the Board of 29 Trustees must notify the alumni association of the vacancy as 30 soon as possible; the alumni association must then submit its 31 list of nominees to the Governor within 60 days after 32 receiving notice. The Southern Illinois University Management 7 Act is amended by changing Section 2 as follows: 8 (110 ILCS 520/2) (from Ch. 144, par. 652) 9 Sec. 2. The Board shall consist of 7 members appointed 10 by the Governor, from a list of nominees as provided in this 11 Section and by and with the advice and consent of the Senate, 12 the Superintendent of Public Instruction, or his chief 13 assistant for liaison with higher education when designated 14 to serve in his place, ex-officio, and one voting student 15 member designated by the Governor from one campus of the 16 University and one nonvoting student member from the campus 17 of the University not represented by the voting student 18 member. The Governor shall designate one of the student 19 members serving on the Board to serve as the voting student 20 member. Each student member shall be chosen by the 21 respective campuses of Southern Illinois University at 22 Carbondale and Edwardsville. The method of choosing these 23 student members shall be by campus-wide student election, and 24 any student designated by the Governor to be a voting student 25 member shall be one of the students chosen by this method. 26 The student members shall serve terms of one year beginning 27 on July 1 of each year, except that the student members 28 initially selected shall serve a term beginning on the date 29 of such selection and expiring on the next succeeding June 30 30. The 17 student member shall be chosen by a campus-wide student 18 election. The student member shall serve a term of one year 19 beginning on July 1 of each year, except that the student 20 member initially selected shall serve a term beginning on the 21 date of his or her selection and expiring on the next 22 succeeding June 30. The student member shall serve a term of one year 19 beginning on July 1 of each year, except that the student 20 member initially selected shall serve a term beginning on the 21 date of his or her selection and expiring on the next 22 succeeding June 30. To be eligible for selection as a 23 student member and to be eligible to remain as a student 24 member of the Board, the student member must be a resident of 25 this State, must have and maintain a grade point average that 26 is equivalent to at least 2.5 on a 4.0 scale, and must be a 27 student enrolled at all times during his or her term of 28 office except for that part of the term which follows the 29 completion of the last full regular semester of an academic 30 year and precedes the first full regular semester of the 31 succeeding academic year at the university (sometimes 32 commonly referred to as the spring/summer semester). Of the members first 6 appointed by the Governor, 4 shall be appointed for terms to 7 expire on the third Monday in January, 1999, and 3 shall be 8 appointed for terms to expire on the third Monday in January, 9 2001. The 17 student member shall be chosen by a campus-wide student 18 election. The student member shall serve a term of one year 19 beginning on July 1 of each year, except that the student 20 member initially selected shall serve a term beginning on the 21 date of his or her selection and expiring on the next 22 succeeding June 30. The Northeastern Illinois University Law is 9 amended by changing Section 25-15 as follows: 10 (110 ILCS 680/25-15) 11 Sec. 25-15. Membership; terms; vacancies. The Board 12 shall consist of 9 voting members who are residents of this 13 State and are appointed by the Governor, from a list of 14 nominees as provided in this Section and by and with the 15 advice and consent of the Senate, and one voting member who 16 is a student at Northeastern Illinois University. The 17 student member shall be elected by a campus-wide election of 18 all students of the University. The student member shall 19 serve a term of one year beginning on July 1 of each year, 20 except that the student member initially selected under this 21 amendatory Act of the 91st General Assembly shall serve a 22 term beginning on the date of his or her selection and 23 expiring on the next succeeding June 30. To be eligible to 24 remain as a student member of the Board, the student member 25 must be a resident of this State, must have and maintain a 26 grade point average that is equivalent to at least 2.5 on a 27 4.0 scale, and must be a full time undergraduate student 28 enrolled at all times during his or her term of office except 29 for that part of the term which follows the completion of the 30 last full regular semester of an academic year and precedes 31 the first full regular semester of the succeeding academic 32 year at the university (sometimes commonly referred to as the -15- LRB093 13346 RCE 19195 b 1 summer session or summer school). If a student member 2 serving on the Board fails to continue to meet or maintain 3 the residency, minimum grade point average, or enrollment 4 requirement established by this Section, his or her 5 membership on the Board shall be deemed to have terminated by 6 operation of law. If any member of the Board appointed by 7 the Governor fails to continue to meet or maintain the 8 residency requirement established by this Section, he or she 9 shall resign membership on the Board within 30 days 10 thereafter and, failing submission of this resignation, his 11 or her membership on the Board shall be deemed to have 12 terminated by operation of law. Of the members first 13 appointed by the Governor, 4 shall be appointed for terms to 14 expire on the third Monday in January, 1999 and until their 15 successors are appointed and qualified, and 3 shall be 16 appointed for terms to expire on the third Monday in January, 17 2001 and until their successors are appointed and qualified. 18 The 2 additional members appointed by the Governor, by and 19 with the advice and consent of the Senate, under this 20 amendatory Act of the 91st General Assembly, shall not be 21 from the same political party and shall be appointed for 22 terms to expire on the third Monday in January, 2003 and 23 until their successors are appointed and qualified. Any 24 vacancy in membership existing on January 1, 1999 shall be 25 filled by appointment by the Governor, with the advice and 26 consent of the Senate, for a term to expire on the third 27 Monday in January, 2003. If the Senate is not in session on 28 the effective date of this Article, or if a vacancy in an 29 appointive membership occurs at a time when the Senate is not 30 in session, the Governor shall make temporary appointments to 31 fill the vacancy. Members with these temporary appointments 32 shall be deemed qualified to serve upon appointment and shall 33 continue to serve until the next meeting of the Senate when 34 the Governor shall appoint persons to fill such memberships, -16- LRB093 13346 RCE 19195 b 1 by and with the advice and consent of the Senate, for the 2 remainder of their respective terms. No more than 5 of the 3 members appointed by the Governor shall be affiliated with 4 the same political party. Each member appointed by the 5 Governor must be a resident of this State. A failure to meet 6 or maintain this residency requirement constitutes a 7 resignation from and creates a vacancy in the Board. Upon 8 the expiration of the terms of members appointed by the 9 Governor for other than temporary appointments, their 10 respective successors shall be appointed, by and with the 11 advice and consent of the Senate, for terms of 6 years from 12 the third Monday in January of each odd-numbered year. To be eligible to remain as a student 14 member of the Board, the student member must be a resident of 15 this State, must have and maintain a grade point average that 16 is equivalent to at least 2.5 on a 4.0 scale, and must be a 17 full time student enrolled at all times during his or her 18 term of office except for that part of the term which follows 19 the completion of the last full regular semester of an 20 academic year and precedes the first full regular semester of 21 the succeeding academic year at the university (sometimes 22 commonly referred to as the summer session or summer school). 23 If a student member serving on the Board fails to continue to 24 meet or maintain the residency, minimum grade point average, 25 or enrollment requirement established by this Section, his or 26 her membership on the Board shall be deemed to have 27 terminated by operation of law. Of the members first 28 appointed by the Governor, 4 shall be appointed for terms to 29 expire on the third Monday in January, 1999, and 3 shall be 30 appointed for terms to expire on the third Monday in January, 31 2001.
