 1        AN ACT concerning finance.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The State Prompt Payment Act  is  amended  by
 5    adding Section 8 as follows:

 6        (30 ILCS 540/8 new)
 7        Sec. 8.  Priority of payment.
 8        (a)  Definition.  As  used  in  this  Section, "qualified
 9    goods  or  services"  means  goods  or  services  for   which
10    reimbursement  is  paid  by the Illinois Department of Public
11    Aid under Article V of the Illinois Public Aid Code.
12        (b)  Processing by official or agency. Except as provided
13    in subsection (d), a bill or invoice for qualified  goods  or
14    services  provided to a recipient of medical assistance under
15    Article V of the Illinois  Public  Aid  Code  must  be  given
16    priority  in  processing.  Any  bill or invoice meeting these
17    criteria that is submitted to an official or agency  must  be
18    processed  and forwarded for payment before any other bill or
19    invoice or any grant award payment is processed or  forwarded
20    for payment.
21        (c)  Payment   by  Comptroller.  Except  as  provided  in
22    subsection (d), a voucher for payment for qualified goods  or
23    services  provided to a recipient of medical assistance under
24    Article V of the Illinois Public Aid Code and submitted by an
25    official or agency to the Comptroller  for  payment  must  be
26    given priority in payment. Any voucher meeting these criteria
27    that is submitted to the Comptroller by an official or agency
28    for  payment  from a given fund must be paid before any other
29    bill, invoice, or grant award is paid from that fund. If 2 or
30    more  vouchers  eligible  for  priority  payment  under  this
31    Section are received by the Comptroller in the same  day  for

 1    payment out of the same fund and there is not enough money in
 2    the  fund to pay them all, then each bill or invoice shall be
 3    paid in the order in which it is received.
 4        (d)  The processing  and  payment  of  (i)  debt  service
 5    obligations  of  the  State,  (ii) payroll obligations of the
 6    State, and (iii) payments  to  school  districts  shall  have
 7    priority over the processing and payment of items as required
 8    by this Section.

 9        Section  99.  Effective date.  This Act takes effect upon
10    becoming law.
