093_HB3835 LRB093 13274 DRH 18543 b 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Sections 3-609, 3-609.1, 3-620, 3-621, 3-622, 3-623, 6 3-624, 3-625, 3-626, 3-628, 3-638, 3-647, 3-650, and 3-651 as 7 follows: 8 (625 ILCS 5/3-609) (from Ch. 95 1/2, par. 3-609) 9 Sec. 3-609. Disabled Veterans' Plates. Any disabled 10 veteran who has been or declared eligible for funds for the 11 purchase of a motor vehicle of the first division or for a 12 motor vehicle of the second division weighing not more than 13 8,000 pounds by the United States Federal Government because 14 of his disability, may make application for the registration 15 of one such vehicle, to the Secretary of State without the 16 payment of any registration fee. Registration shall be for a 17 multi-year period effective in 1980 and may be issued 18 staggered registration. 19 Any disabled veteran of World War I, of World War II, of 20 the National Emergency between June 25, 1950 and January 31, 21 1955 or of the period beginning February 1, 1955 and ending 22 on the day before the first day thereafter in which 23 individuals (other than individuals liable for induction by 24 reason of prior deferment) are no longer liable for induction 25 for training and service into the armed forces under the 26 Military Selective Service Act of 1967, or of any armed 27 conflict involving the armed forces of the United States, who 28 has a service-connected disability of such a nature that it 29 would, if it had been incurred in World War II, have entitled 30 him to be awarded an automobile by the United States Federal 31 Government, or who is receiving compensation from the -2- LRB093 13274 DRH 18543 b 1 Veterans Administration for total service-connected 2 disability, may make application to the Secretary of State 3 for the registration of one motor vehicle of the first 4 division without accompanying such application with the 5 payment of any fee. 6 Renewal of such registration must be accompanied with 7 documentation for eligibility of registration without fee 8 unless the applicant has a permanent qualifying disability, 9 and such registration plates may not be issued to any person 10 not eligible therefor. 11 The Illinois Veterans Commission may assist in providing 12 the documentation of disability. 13 Any license plate manufactured on or after January 1, 14 2005 and issued under this Section must: 15 (1) be manufactured in the United States; and 16 (2) if a suitable manufacturing facility is 17 available in this State, be manufactured in this State. 18 (Source: P.A. 86-444; 87-895.) 19 (625 ILCS 5/3-609.1) (from Ch. 95 1/2, par. 3-609.1) 20 Sec. 3-609.1. Congressional Medal of Honor plates. Any 21 resident of the State of Illinois who has been awarded the 22 Congressional Medal of Honor may make application for the 23 registration of a motor vehicle owned solely or in part by 24 such recipient, to the Secretary of State without the payment 25 of any registration fee. Registration shall be for a 26 multi-year period effective from issuance. The Secretary of 27 State shall furnish at his office at no cost to such 28 Congressional Medal of Honor recipients, plates bearing up to 29 3 letters designating the recipient's initials followed by 30 the letters C M H signifying the Congressional Medal of 31 Honor. The plate shall be suitable for attachment to a motor 32 vehicle or motorcycle registered under this Code. 33 Any license plate manufactured on or after January 1, -3- LRB093 13274 DRH 18543 b 1 2005 and issued under this Section must: 2 (1) be manufactured in the United States; and 3 (2) if a suitable manufacturing facility is 4 available in this State, be manufactured in this State. 5 (Source: P.A. 92-545, eff. 6-12-02.) 6 (625 ILCS 5/3-620) (from Ch. 95 1/2, par. 3-620) 7 Sec. 3-620. The Secretary, upon receipt of an 8 application made on the form prescribed by the Secretary of 9 State, may issue special registration plates to United 10 States citizens, who are present or former members of the 11 United States armed forces or any of its allies, and who were 12 prisoners of war of World War I, World War II, the Korean 13 Conflict, and the Vietnamese conflict, or to the widowed 14 spouse of a former member of the United States armed forces, 15 providing that widowed spouse was married to the POW at the 16 time of death, and is a single person at the time of 17 application. The special plates issued pursuant to this 18 Section shall be affixed only to passenger vehicles of the 19 first division subject to the staggered registration system, 20 motorcycles, and vehicles of the second division having a 21 gross weight of 8,000 pounds or less and shall be issued 22 without charge. Only one set of plates may be issued at no 23 fee. 24 The design and color of the prisoner of war plates shall 25 be wholly within the discretion of the Secretary of State. 26 Any license plate manufactured on or after January 1, 27 2005 and issued under this Section must: 28 (1) be manufactured in the United States; and 29 (2) if a suitable manufacturing facility is 30 available in this State, be manufactured in this State. 31 (Source: P.A. 92-545, eff. 6-12-02.) 32 (625 ILCS 5/3-621) (from Ch. 95 1/2, par. 3-621) -4- LRB093 13274 DRH 18543 b 1 Sec. 3-621. The Secretary, upon receipt of an 2 application, made in the form prescribed by the Secretary of 3 State, may issue to members of the Illinois National Guard, 4 and to Illinois residents who are either former members of 5 the Illinois National Guard or the surviving spouses of 6 Illinois National Guard members, special registration plates. 7 The special plates issued pursuant to this Section shall be 8 affixed only to passenger vehicles of the first division, 9 motorcycles, or motor vehicles of the second division 10 weighing not more than 8,000 pounds subject to the staggered 11 registration system. 12 The design and color of such plates shall be wholly 13 within the discretion of the Secretary of State. 14 Any license plate manufactured on or after January 1, 15 2005 and issued under this Section must: 16 (1) be manufactured in the United States; and 17 (2) if a suitable manufacturing facility is 18 available in this State, be manufactured in this State. 19 (Source: P.A. 92-545, eff. 6-12-02; 92-699, 1-1-03; revised 20 8-23-02.) 21 (625 ILCS 5/3-622) (from Ch. 95 1/2, par. 3-622) 22 Sec. 3-622. The Secretary, upon receipt of an 23 application made in the form prescribed by the Secretary of 24 State, may issue to members of the United States Armed Forces 25 Reserves who reside in Illinois, and to Illinois residents 26 who are either former members of the United States Armed 27 Forces Reserves or the surviving spouses of United States 28 Armed Forces Reserve members who resided in Illinois, special 29 registration plates. The special plates issued pursuant to 30 this Section shall be affixed only to passenger vehicles of 31 the first division, motorcycles, or motor vehicles of the 32 second division weighing not more than 8,000 pounds subject 33 to the staggered registration system. The design and color -5- LRB093 13274 DRH 18543 b 1 of such plates shall be wholly within the discretion of the 2 Secretary of State. 3 Any license plate manufactured on or after January 1, 4 2005 and issued under this Section must: 5 (1) be manufactured in the United States; and 6 (2) if a suitable manufacturing facility is 7 available in this State, be manufactured in this State. 8 (Source: P.A. 92-545, eff. 6-12-02; 92-699, eff. 1-1-03; 9 revised 8-23-02.) 10 (625 ILCS 5/3-623) (from Ch. 95 1/2, par. 3-623) 11 Sec. 3-623. Purple Heart Plates. The Secretary, upon 12 receipt of an application made in the form prescribed by the 13 Secretary of State, may issue to recipients awarded the 14 Purple Heart by a branch of the armed forces of the United 15 States who reside in Illinois, special registration plates. 16 The special plates issued pursuant to this Section should be 17 affixed only to passenger vehicles of the 1st division, 18 including motorcycles, or motor vehicles of the 2nd division 19 weighing not more than 8,000 pounds. 20 The design and color of such plates shall be wholly 21 within the discretion of the Secretary of State. Appropriate 22 documentation, as determined by the Secretary, and the 23 appropriate registration fee shall accompany the application. 24 However, for an individual who has been issued Purple Heart 25 plates for a vehicle and who has claimed and received a grant 26 under the Senior Citizens and Disabled Persons Property Tax 27 Relief and Pharmaceutical Assistance Act, the annual fee for 28 the registration of the vehicle shall be as provided in 29 Section 3-806.3 of this Code. 30 Any license plate manufactured on or after January 1, 31 2005 and issued under this Section must: 32 (1) be manufactured in the United States; and 33 (2) if a suitable manufacturing facility is -6- LRB093 13274 DRH 18543 b 1 available in this State, be manufactured in this State. 2 (Source: P.A. 91-25, eff. 6-9-99; 92-82, eff. 1-1-02; 92-699, 3 eff. 1-1-03.) 4 (625 ILCS 5/3-624) (from Ch. 95 1/2, par. 3-624) 5 Sec. 3-624. The Secretary, upon receipt of an application 6 made in the form prescribed by the Secretary of State, may 7 issue to retired members of the United States Armed Forces 8 who reside in Illinois, special registration plates. The 9 special plates issued pursuant to this Section shall be 10 affixed only to passenger vehicles of the first division, 11 motorcycles, or motor vehicles of the second division 12 weighing not more than 8,000 pounds and subject to the 13 staggered registration system. The design and color of such 14 plates shall be wholly within the discretion of the Secretary 15 of State. 16 Any license plate manufactured on or after January 1, 17 2005 and issued under this Section must: 18 (1) be manufactured in the United States; and 19 (2) if a suitable manufacturing facility is 20 available in this State, be manufactured in this State. 21 (Source: P.A. 92-545, eff. 6-12-02.) 22 (625 ILCS 5/3-625) (from Ch. 95 1/2, par. 3-625) 23 Sec. 3-625. Pearl Harbor Plates. The Secretary, upon 24 receipt of an application made in the form prescribed by the 25 Secretary of State, may issue special registration plates to 26 any Illinois resident who, while a member of the armed forces 27 of the United States, participated in the battle of Pearl 28 Harbor on December 7, 1941, or to the widowed spouse of any 29 Illinois resident who, while a member of the armed forces of 30 the United States, participated in the battle of Pearl Harbor 31 on December 7, 1941, provided that the widowed spouse was 32 married to the battle of Pearl Harbor participant at the time -7- LRB093 13274 DRH 18543 b 1 of the participant's death and is a single person at the time 2 of application. The special plates issued pursuant to this 3 Section should be affixed only to passenger vehicles of the 4 1st division, motorcycles, or motor vehicles of the 2nd 5 division weighing not more than 8,000 pounds. 6 The design and color of such plates shall be wholly 7 within the discretion of the Secretary of State. Appropriate 8 documentation, as determined by the Secretary, and the 9 appropriate registration fee shall accompany the application. 10 Any license plate manufactured on or after January 1, 11 2005 and issued under this Section must: 12 (1) be manufactured in the United States; and 13 (2) if a suitable manufacturing facility is 14 available in this State, be manufactured in this State. 15 (Source: P.A. 92-545, eff. 6-12-02; 92-699, eff. 1-1-03; 16 revised 8-23-02.) 17 (625 ILCS 5/3-626) 18 Sec. 3-626. Korean War Veteran license plates. 19 (a) In addition to any other special license plate, the 20 Secretary, upon receipt of all applicable fees and 21 applications made in the form prescribed by the Secretary of 22 State, may issue special registration plates designated as 23 Korean War Veteran license plates to residents of Illinois 24 who participated in the United States Armed Forces during the 25 Korean War. The special plate issued under this Section 26 shall be affixed only to passenger vehicles of the first 27 division, motorcycles, motor vehicles of the second division 28 weighing not more than 8,000 pounds, and recreational 29 vehicles as defined by Section 1-169 of this Code. Plates 30 issued under this Section shall expire according to the 31 staggered multi-year procedure established by Section 3-414.1 32 of this Code. 33 (b) The design, color, and format of the plates shall be -8- LRB093 13274 DRH 18543 b 1 wholly within the discretion of the Secretary of State. The 2 Secretary may, in his or her discretion, allow the plates to 3 be issued as vanity plates or personalized in accordance with 4 Section 3-405.1 of this Code. The plates are not required to 5 designate "Land Of Lincoln", as prescribed in subsection (b) 6 of Section 3-412 of this Code. The Secretary shall prescribe 7 the eligibility requirements and, in his or her discretion, 8 shall approve and prescribe stickers or decals as provided 9 under Section 3-412. 10 (c) An applicant shall be charged a $15 fee for original 11 issuance in addition to the applicable registration fee. Of 12 this additional fee, $13 shall be deposited into the 13 Secretary of State Special License Plate Fund and $2 shall be 14 deposited into the Korean War Memorial Construction Fund. 15 (d) The Korean War Memorial Construction Fund is created 16 as a special fund in the State treasury. All moneys in the 17 Korean War Memorial Construction Fund shall, subject to 18 appropriation, be used by the Department of Veteran Affairs 19 to provide grants for construction of the Korean War Memorial 20 to be located at Oak Ridge Cemetery in Springfield, Illinois. 21 Upon the completion of the Memorial, the Department of 22 Veteran Affairs shall certify to the State Treasurer that the 23 construction of the Memorial has been completed. Upon the 24 certification by the Department of Veteran Affairs, the State 25 Treasurer shall transfer all moneys in the Fund and any 26 future deposits into the Fund into the Secretary of State 27 Special License Plate Fund. 28 (e) An individual who has been issued Korean War Veteran 29 license plates for a vehicle and who has claimed and received 30 a grant under the Senior Citizens and Disabled Persons 31 Property Tax Relief and Pharmaceutical Assistance Act shall 32 pay the original issuance and the regular annual fee for the 33 registration of the vehicle as provided in Section 3-806.3 of 34 this Code in addition to the fees specified in subsection (c) -9- LRB093 13274 DRH 18543 b 1 of this Section. 2 (f) Any license plate manufactured on or after January 3 1, 2005 and issued under this Section must: 4 (1) be manufactured in the United States; and 5 (2) if a suitable manufacturing facility is 6 available in this State, be manufactured in this State. 7 (Source: P.A. 92-545, eff. 6-12-02; 93-140, eff. 1-1-04.) 8 (625 ILCS 5/3-628) 9 Sec. 3-628. Bronze Star plates. 10 (a) Beginning January 1, 1996, in addition to any other 11 special license plate, the Secretary, upon receipt of all 12 applicable fees and applications made in the form prescribed 13 by the Secretary of State, may issue special registration 14 plates to residents of Illinois who have been awarded the 15 Bronze Star by the United States Armed Forces. The special 16 plate issued under this Section shall be affixed only to 17 passenger vehicles of the first division, motorcycles, or 18 motor vehicles of the second division weighing not more than 19 8,000 pounds. Plates issued under this Section shall expire 20 according to the staggered multi-year procedure established 21 by Section 3-414.1 of this Code. 22 (b) The design, color, and format of the plates shall be 23 wholly within the discretion of the Secretary of State. The 24 Secretary may, in his or her discretion, allow the plates to 25 be issued as vanity plates or personalized in accordance with 26 Section 3-405.1 of this Code. The plates are not required to 27 designate "Land Of Lincoln", as prescribed in subsection (b) 28 of Section 3-412 of this Code. The Secretary shall prescribe 29 the eligibility requirements and, in his or her discretion, 30 shall approve and prescribe stickers or decals as provided 31 under Section 3-412. 32 (c) An applicant shall be charged a $15 fee for original 33 issuance in addition to the appropriate registration fee. -10- LRB093 13274 DRH 18543 b 1 This additional fee shall be deposited into the Secretary 2 of State Special License Plate Fund. 3 (d) Any license plate manufactured on or after January 4 1, 2005 and issued under this Section must: 5 (1) be manufactured in the United States; and 6 (2) if a suitable manufacturing facility is 7 available in this State, be manufactured in this State. 8 (Source: P.A. 92-545, eff. 6-12-02; 93-140, eff. 1-1-04.) 9 (625 ILCS 5/3-638) 10 Sec. 3-638. U.S. Veteran License Plates. 11 (a) In addition to any other special license plate, the 12 Secretary, upon receipt of all applicable fees and 13 applications made in the form prescribed by the Secretary of 14 State, may issue U.S. Veteran license plates to residents of 15 Illinois who meet eligibility requirements prescribed by the 16 Secretary of State. The special U.S. Veteran plate issued 17 under this Section shall be affixed only to passenger 18 vehicles of the first division, motorcycles, and motor 19 vehicles of the second division weighing not more than 8,000 20 pounds. Plates issued under this Section shall expire 21 according to the staggered multi-year procedure established 22 by Section 3-414.1 of this Code. 23 (b) The design, color, and format of the plates shall be 24 wholly within the discretion of the Secretary of State. The 25 Secretary may, in his or her discretion, allow the plates to 26 be issued as vanity plates or personalized in accordance with 27 Section 3-405.1 of this Code. The plates are not required to 28 designate "Land Of Lincoln", as prescribed in subsection (b) 29 of Section 3-412 of this Code. World War II Veteran License Plates. 12 (a) In addition to any other special license plate, the 13 Secretary, upon receipt of all applicable fees and 14 applications made in the form prescribed by the Secretary of 15 State, may issue World War II Veteran license plates to 16 residents of Illinois who meet eligibility requirements 17 prescribed by the Secretary of State. The special World War 18 II Veteran plate issued under this Section shall be affixed 19 only to passenger vehicles of the first division, 20 motorcycles, and motor vehicles of the second division 21 weighing not more than 8,000 pounds. Plates issued under this 22 Section shall expire according to the staggered multi-year 23 procedure established by Section 3-414.1 of this Code. 24 (b) The design, color, and format of the plates shall be 25 wholly within the discretion of the Secretary of State. The 26 Secretary may, in his or her discretion, allow the plates to 27 be issued as vanity plates or personalized in accordance with 28 Section 3-405.1 of this Code. The plates are not required to 29 designate "Land Of Lincoln", as prescribed in subsection (b) 30 of Section 3-412 of this Code. The Secretary shall prescribe 31 the eligibility requirements and, in his or her discretion, 32 shall approve and prescribe stickers or decals as provided 33 under Section 3-412. -12- LRB093 13274 DRH 18543 b 1 (c) An applicant shall be charged a $15 fee for original 2 issuance in addition to the applicable registration fee. 3 This additional fee shall be deposited into the Secretary of 4 State Special License Plate Fund. 5 (d) Any license plate manufactured on or after January 6 1, 2005 and issued under this Section must: 7 (1) be manufactured in the United States; and 8 (2) if a suitable manufacturing facility is 9 available in this State, be manufactured in this State. 10 (Source: P.A. 92-545, eff. 6-12-02; 93-140, eff. 1-1-04.) 11 (625 ILCS 5/3-650) 12 Sec. 3-650. Army Combat Veteran license plates. 13 (a) In addition to any other special license plate, the 14 Secretary, upon receipt of all applicable fees and 15 applications made in the form prescribed by the Secretary of 16 State, may issue Army Combat Veteran license plates to 17 residents of Illinois who meet eligibility requirements 18 prescribed by the Secretary of State. The special Army 19 Combat Veteran plate issued under this Section shall be 20 affixed only to passenger vehicles of the first division, 21 motorcycles, and motor vehicles of the second division 22 weighing not more than 8,000 pounds. Plates issued under 23 this Section shall expire according to the staggered 24 multi-year procedure established by Section 3-414.1 of this 25 Code. 26 (b) The plates shall display the Army Combat Infantry 27 Badge. In all other respects, the design, color, and format 28 of the plates shall be within the discretion of the Secretary 29 of State. The Secretary may, in his or her discretion, allow 30 the plates to be issued as vanity plates or personalized in 31 accordance with Section 3-405.1 of this Code. The plates are 32 not required to designate "Land Of Lincoln", as prescribed in 33 subsection (b) of Section 3-412 of this Code. The Secretary -13- LRB093 13274 DRH 18543 b 1 shall prescribe the eligibility requirements and, in his or 2 her discretion, shall approve and prescribe stickers or 3 decals as provided under Section 3-412. 4 (c) An applicant shall be charged a $15 fee for original 5 issuance in addition to the applicable registration fee. 6 This additional fee shall be deposited into the Secretary of 7 State Special License Plate Fund. 8 (d) Any license plate manufactured on or after January 9 1, 2005 and issued under this Section must: 10 (1) be manufactured in the United States; and 11 (2) if a suitable manufacturing facility is 12 available in this State, be manufactured in this State. 13 (Source: P.A. 92-79, eff. 1-1-02; 92-545, eff. 6-12-02; 14 92-651, eff. 7-11-02; 92-699, eff. 1-1-03; 93-140, eff. 15 1-1-04.) 16 (625 ILCS 5/3-651) 17 Sec. 3-651. U.S. Marine Corps license plates. 18 (a) In addition to any other special license plate, the 19 Secretary, upon receipt of all applicable fees and 20 applications made in the form prescribed by the Secretary of 21 State, may issue special registration plates designated as 22 U.S. Marine Corps license plates to residents of Illinois who 23 meet eligibility requirements prescribed by the Secretary of 24 State. The special plate issued under this Section shall be 25 affixed only to passenger vehicles of the first division, 26 motorcycles, motor vehicles of the second division weighing 27 not more than 8,000 pounds, and recreational vehicles as 28 defined by Section 1-169 of this Code. Plates issued under 29 this Section shall expire according to the staggered 30 multi-year procedure established by Section 3-414.1 of this 31 Code. 32 (b) The design, color, and format of the plates shall be 33 wholly within the discretion of the Secretary of State, -14- LRB093 13274 DRH 18543 b 1 except that the U.S. Marine Corps emblem shall appear on the 2 plates. The Secretary may, in his or her discretion, allow 3 the plates to be issued as vanity or personalized plates in 4 accordance with Section 3-405.1 of this Code. The plates are 5 not required to designate "Land Of Lincoln", as prescribed in 6 subsection (b) of Section 3-412 of this Code. The Secretary 7 shall prescribe the eligibility requirements and, in his or 8 her discretion, shall approve and prescribe stickers or 9 decals as provided under Section 3-412. 10 (c) An applicant shall be charged a $20 fee for original 11 issuance in addition to the applicable registration fee. Of 12 this additional fee, $15 shall be deposited into the 13 Secretary of State Special License Plate Fund and $5 shall be 14 deposited into the Marine Corps Scholarship Fund. For each 15 registration renewal period, a $20 fee, in addition to the 16 appropriate registration fee, shall be charged. Of this 17 additional fee, $2 shall be deposited into the Secretary of 18 State Special License Plate Fund and $18 shall be deposited 19 into the Marine Corps Scholarship Fund. 20 (d) The Marine Corps Scholarship Fund is created as a 21 special fund in the State treasury. All moneys in the Marine 22 Corps Scholarship Fund shall, subject to appropriation by the 23 General Assembly and approval by the Secretary, be used by 24 the Marine Corps Scholarship Foundation, Inc., a recognized 25 charitable organization that meets the requirements of Title 26 26, Section 501(c)(3) of the United States Code, to provide 27 grants for scholarships for higher education. The 28 scholarship recipients must be the children of current or 29 former members of the United States Marine Corps who meet the 30 academic, financial, and other requirements established by 31 the Marine Corps Scholarship Foundation. In addition, the 32 recipients must be Illinois residents and must attend a 33 college or university located within the State of Illinois. 34 The State Treasurer shall require the Marine Corps -15- LRB093 13274 DRH 18543 b 1 Scholarship Foundation to establish a separate account for 2 receipt of the proceeds of the Marine Corps Scholarship Fund. 3 That account shall be subject to audit either annually or at 4 another interval, as determined by the State Treasurer. 5 Proceeds from the Marine Corps Scholarship Fund shall be 6 transferred on a quarterly basis by the State Treasurer's 7 office to this separate account. 8 (e) Any license plate manufactured on or after January 9 1, 2005 and issued under this Section must: 10 (1) be manufactured in the United States; and 11 (2) if a suitable manufacturing facility is 12 available in this State, be manufactured in this State. 13 (Source: P.A. 92-467, eff. 1-1-02; 92-545, eff. 6-12-02; 14 92-651, eff. 7-11-02; 92-699, eff. 1-1-03.)
