093_HB3633 LRB093 06278 JAM 06391 b 1 AN ACT concerning intergovernmental cooperation. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Intergovernmental Cooperation Act is 5 amended by changing Section 3 as follows: 6 (5 ILCS 220/3) (from Ch. 127, par. 743) 7 Sec. 3. Intergovernmental cooperation. Any power or 8 powers, privileges, functions, or authority exercised or 9 which may be exercised by a public agency of this State may 10 be exercised, combined, transferred, and enjoyed jointly with 11 any other public agency of this State and jointly with any 12 public agency of any other state or of the United States to 13 the extent that laws of such other state or of the United 14 States do not prohibit joint exercise or enjoyment and except 15 where specifically and expressly prohibited by law. This 16 includes, but is not limited to, (i) arrangements between the 17 Illinois Student Assistance Commission and agencies in other 18 states which issue professional licenses and (ii) agreements 19 between the Illinois Department of Public Aid and public 20 agencies for the establishment and enforcement of child 21 support orders and for the exchange of information that may 22 be necessary for the enforcement of those child support 23 orders. It is not intended that any task force, cooperative 24 group, or delivery of services created under this Act become 25 a separate suable entity. This Act does not contemplate that 26 any task force, cooperative group, or service delivery 27 created under this Act become a separate suable entity. It 28 is not the intention of this Act to create additional 29 liability exposure for the individual agencies participating 30 in any task force, cooperative group, or service delivery 31 created pursuant to an intergovernmental agreement authorized -2- LRB093 06278 JAM 06391 b 1 by the provisions of this Act. 2 (Source: P.A. 90-18, eff. 7-1-97; 91-298, eff. 7-29-99.) 3 Section 99.
