The State Finance Act is amended by adding 5 Section 5.595 as follows: 6 (30 ILCS 105/5.595 new) 7 Sec. 5.595. The Early Childhood Education Trust Fund. 8 Section 10. The Illinois Vehicle Code is amended by 9 amending Section 3-421 and adding Sections 3-421.1 and 10 3-421.2 as follows: 11 (625 ILCS 5/3-421) (from Ch. 95 1/2, par. 3-421) 12 Sec. 3-421. Right of reassignment. (a) Except as 13 provided in Sections 3-421.1 and 3-421.2 of this Code, every 14 natural person shall have the right of reassignment of the 15 license number issued to him during the current registration 16 plate term, for the ensuing registration plate term, provided 17 his application for reassignment is received in the Office of 18 the Secretary of State on or before September 30 of the final 19 year of the registration plate term as to a vehicle 20 registered on a calendar year, and on or before March 31 as -2- LRB093 06605 DRH 13958 a 1 to a vehicle registered on a fiscal year. The right of 2 reassignment shall apply to every natural person under the 3 staggered registration system provided the application for 4 reassignment is received in the Office of the Secretary of 5 State by the 1st day of the month immediately preceding the 6 applicant's month of expiration. 7 In addition, every natural person shall have the right of 8 reassignment of the license number issued to him for a 9 two-year registration, for the ensuing two-year period. 10 Where the two-year period is for two calendar years, the 11 application for reassignment must be received by the 12 Secretary of State on or before September 30th of the year 13 preceding commencement of the two-year period. Where the 14 two-year period is for two fiscal years commencing on July 1, 15 the application for reassignment must be received by the 16 Secretary of State on or before April 30th immediately 17 preceding commencement of the two-year period. 18 (b) Notwithstanding the above provision, the Secretary 19 of State shall, subject to the existing right of 20 reassignment, have the authority to designate new specific 21 combinations of numerical, alpha-numerical, and 22 numerical-alpha licenses for vehicles registered on a 23 calendar year or on a fiscal year, whether the license be 24 issued for one or more years. The new combinations so 25 specified shall not be subject to the right of reassignment, 26 and no right of reassignment thereto may at any future time 27 be acquired. 28 (Source: P.A. 80-230; 80-1185.) 29 (625 ILCS 5/3-421.1 new) 30 Sec. 3-421.1. Open outcry bids. 31 (a) The right of reassignment of a license plate 32 provided by Section 3-421 of this Act does not apply to the 33 natural persons holding a license plate with a number ranging -3- LRB093 06605 DRH 13958 a 1 from 1 through 9,999 or a license plate containing only 2 single, double, or triple letters. Reassignment of those 3 license plates, except those ending in 2 zeros, for a period 4 of 10 years, beginning with registration years that begin in 5 2004, shall be made on an open bid basis. 6 (b) The Secretary of State shall establish and maintain 7 an open outcry auction system to award the plates described 8 in subsection (a) to the highest bidder. The auction system 9 shall include: 10 (1) a database for reception and recordation of 11 bids on plates; 12 (2) an internet site that will accept and track all 13 bids for specific plates; 14 (3) a telephone system that will accept and track 15 all bids for specific plates; 16 (4) a process by which bids can be placed on 17 specific plates by mail; 18 (5) safeguards to prevent public disclosure of the 19 identity of bidders; 20 (6) minimum bids; 21 (7) a closing date and time at least one month 22 prior to the end of the relevant registration period; and 23 (8) a method to award license plates when the 24 winning bidder fails to pay for his or her plate. 25 (c) Natural persons wishing to be assigned one of the 26 license plates with a number ranging from 1 through 9,999 or 27 a license plate containing only single, double, or triple 28 letters, except those ending in two zeros, for a period of 10 29 years, including the natural person to whom the license plate 30 is currently assigned, shall submit an open bid for that 31 plate to the Secretary of State via any of the methods 32 described in paragraphs (2) through (4) of subsection (b). 33 (d) When the current registration term for a particular 34 license plate expires, the Secretary of State shall examine -4- LRB093 06605 DRH 13958 a 1 the database established by paragraph (1) of subsection (b), 2 determine the highest bid for the particular license plate, 3 and assign the license plate, for a period of 10 years, to 4 the natural person who submitted the highest bid upon receipt 5 of the amount stated in the bid. 6 (e) The fees established in Section 3-806 of this Act 7 shall be required in addition to the amount of the open bid. 8 Moneys generated by the procedure established by this 9 Section, other than those fees required by Section 3-806 of 10 this Code, shall be deposited into the Early Childhood 11 Education Trust Fund. 12 (f) The Secretary of State shall adopt rules for 13 implementing this Section, including rules for renewed 14 bidding for and reassignment of the license plates upon 15 expiration of each 10-year reassignment period. In adopting 16 the rules, the Secretary of State shall consult with the 17 License Plate Auction Advisory Board. The Secretary of State 18 shall ensure that the rulemaking process is open to the 19 public and shall actively solicit public comments regarding 20 the auction before final adoption of the rules. 21 (g) The License Plate Auction Advisory Board is 22 established. The Board shall consist of 5 members, appointed 23 by the Governor. The term of Board members shall be for 2 24 years or until the rules referred to in subsection (f) of 25 this Section and subsection (c) of Section 3-421.2 are 26 adopted, whichever occurs sooner. Two members of the Board 27 shall have a background in economics that includes at least 28 10 years of professional experience in the field and an 29 advanced degree in the subject. Three members of the Board 30 shall have a background in marketing that includes at least 31 10 years of professional experience in the field and an 32 advanced degree in the subject. The duty of the Board is to 33 provide the Secretary of State and the Department of the 34 Lottery guidance and advice on how to conduct the auction -5- LRB093 06605 DRH 13958 a 1 authorized by this Section and the lottery authorized by 2 Section 3-421.2 in a fashion that generates significant 3 revenue without becoming unduly burdensome administratively. 4 (h) The Early Childhood Education Trust Fund is created 5 as a special fund in the State Treasury. All moneys deposited 6 into the Early Childhood Education Trust Fund shall be placed 7 into an interest-bearing account. Subject to annual 8 appropriation by the General Assembly, the moneys in the 9 Early Childhood Education Trust Fund shall be distributed on 10 an annual basis as follows: 60% to Great START (Strategy to 11 Attract and Retain Teachers) under Section 10-22 of the 12 Department of Human Services Act; 30% to the Department of 13 Human Services for grants to the Illinois Network of Child 14 Care Resource & Referral Agencies for the TEACH (Teacher 15 Education and Compensation Helps) program under Section 10-22 16 of the Department of Human Services Act; and 10% to fund the 17 Child Care Capital Investment Program under Section 10-26 of 18 the Department of Human Services Act. The amount of the 19 annual appropriation shall be at least 10% of all moneys 20 deposited into the Early Childhood Education Trust Fund, plus 21 any accrued interest. The General Assembly shall not be 22 required to appropriate the entire amount of the funds 23 deposited into the Early Childhood Education Trust Fund, plus 24 any accrued interest, in any annual appropriation. 25 (i) Moneys from the Early Childhood Education Trust Fund 26 shall not supplement any existing appropriations, including 27 regular increases to those appropriations, for the designated 28 programs. 29 (625 ILCS 5/3-421.2 new) 30 Sec. 3-421.2. Lottery. 31 (a) The right of reassignment of a license plate 32 provided by Section 3-421 of this Act does not apply to the 33 natural persons holding those license plate with numbers -6- LRB093 06605 DRH 13958 a 1 ranging from 100 through 10,000 and ending in 2 zeros, with 2 no letters. Reassignment of those numbers for a period of 10 3 years, beginning with registration years that begin in 2004, 4 shall be on the basis of an instant lottery game conducted 5 jointly by the Secretary of State and the Department of the 6 Lottery. 7 (b) Persons assigned license plates through the instant 8 lottery game established under this Section shall pay the 9 fees required under Section 3-806 of this Code. 10 (c) The Secretary of State and the Department of the 11 Lottery shall adopt rules for implementing a new instant 12 lottery game for these plate numbers in the 2004 registration 13 year and in each 10th succeeding registration year. 14 (d) Moneys generated by the instant lottery game 15 established by this Section shall be deposited into the Early 16 Childhood Education Trust Fund. 17 Section 99. Effective date. This Act takes effect upon 18 becoming law.".
