093_HB2924 LRB093 07591 NHT 07770 b 1 AN ACT in relation to higher education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Tuition Increase Limitation Act. 6 Section 5. Definition. As used in this Act, "public 7 institution of higher education" has the meaning ascribed to 8 it in Section 1 of the Board of Higher Education Act, except 9 it does not include any public community college of this 10 State. 11 Section 10. Limitation of tuition increase. 12 Notwithstanding any other law of this State, beginning with 13 the 2003-2004 academic year and in each academic year 14 thereafter the governing board of a public institution of 15 higher education shall not increase or authorize an increase 16 in the rate of undergraduate tuition charged at any campus of 17 a university under its jurisdiction by an amount that is 18 greater than the result obtained when the applicable rate of 19 tuition that was charged in the immediately preceding 20 academic year is multiplied by a percentage that equals 2% 21 plus the percentage increase, if any, in the Consumer Price 22 Index for All Urban Consumers for all items published by the 23 United States Department of Labor for the calendar year in 24 which that preceding academic year began. 25 Section 15. Suspension of limit. If the State is in 26 financial crisis in any fiscal year, the General Assembly, by 27 joint resolution, may suspend the limitation set forth in 28 Section 10 of this Act for that fiscal year. -2- LRB093 07591 NHT 07770 b 1 Section 99. Effective date. This Act takes effect effect 2 on July 1, 2003.
