093_HB2885 LRB093 04366 JAM 04416 b 1 AN ACT concerning animal disease laboratories. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Animal Disease Laboratories Act is 5 amended by changing Section 1 as follows: 6 (510 ILCS 10/1) (from Ch. 8, par. 105.11) 7 Sec. 1. Laboratory services. 8 (a) The Department of Agriculture is authorized to 9 establish such additional number of animal disease 10 laboratories, not exceeding five, as may be necessary to 11 serve the livestock and poultry industry of the State. 12 (b) Such laboratories each shall be in charge of a 13 licensed veterinarian, who in addition to making serological 14 blood tests, shall be competent to make diagnoses of such 15 cases of livestock and poultry diseases as may be submitted 16 to such laboratories. 17 (c) The Department may enter into an arrangement with 18 the College of Veterinary Medicine of the University of 19 Illinois whereby any cases submitted to such laboratories 20 which are not susceptible of diagnosis in the field or by 21 common laboratory procedure, or upon which research is 22 required, may be submitted to such College of Veterinary 23 Medicine for diagnosis or research. 24 (d) The Department may establish and collect reasonable 25 fees for diagnostic services performed by such animal disease 26 laboratories.However, no fees may be collected for27diagnostic tests required by Illinois law.28 (e) The Department may establish and collect reasonable 29 fees for providing analyses of research samples out-of-state 30 samples, non-agricultural samples,andsurvey project 31 samples, and diagnostic tests required by Illinois law. -2- LRB093 04366 JAM 04416 b 1 These samples and tests shall be defined by rule. The fees 2 shall be deposited into the Illinois Department of 3 Agriculture Laboratory Services Revolving Fund. The fees 4 collected shall not exceed the Department's actual cost to 5 provide these services. 6 (f) Moneys collected under subsection (e) shall be 7 appropriated from the Illinois Department of Agriculture 8 Laboratory Services Revolving Fund solely for the purposes of 9 (1) testing specimens submitted in support of Department 10 programs established for animal health, welfare, and safety, 11 and the protection of Illinois consumers of Illinois 12 agricultural products, and (2) testing specimens submitted by 13 veterinarians and agency personnel to determine whether 14 chemically hazardous or biologically infectious substances or 15 other disease causing conditions are present. 16 (g) The Director may issue rules, consistent with the 17 provisions of this Act, for the administration and 18 enforcement of this Act. These rules shall be approved by 19 the Advisory Board of Livestock Commissioners. 20 (Source: P.A. 90-403, eff. 1-1-98.) 21 Section 99. Effective date. This Act takes effect upon 22 becoming law.
