1 AN ACT in relation to Human Services.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of Human Services Act is
5 amended by changing Section 80-5 and the Article 80 heading
6 as follows:

10 Sec. 80-5. Task Force on the Department of Human Services
11 Consolidation.
12 (a) There is hereby established a Task Force on the
13 Department of Human Services Consolidation.
14 (b) The Task Force shall consist of 7 voting members, as
15 follows: one person appointed by the Governor, who shall
16 serve as chair of the Task Force; 2 members appointed by the
17 President of the Senate, one of whom shall be designated a
18 vice chair at the time of appointment; one member appointed
19 by the Senate Minority Leader; 2 members appointed by the
20 Speaker of the House of Representatives, one of whom shall be
21 designated a vice chair at the time of appointment; and one
22 member appointed by the House Minority Leader.
23 Members appointed by the legislative leaders shall be
24 appointed for the duration of the Task Force; in the event of
25 a vacancy, the appointment to fill the vacancy shall be made
26 by the legislative leader of the same house and party as the
27 leader who made the original appointment. The Governor may
28 at any time terminate the service of the person appointed by
29 the Governor and reappoint a different person to serve as
30 chair of the Task Force.

1 The following persons (or their designees) shall serve,
2 ex officio, as nonvoting members of the Task Force: the
3 Director of Public Health, the Director of Public Aid, the
4 Director of Children and Family Services, the Director of the
5 Bureau of the Budget, and the Secretary of Human Services,
6 until their offices are abolished, the Director of Mental
7 Health and Developmental Disabilities, the Director of
8 Rehabilitation Services, and the Director of Alcoholism and
9 Substance Abuse. The Governor may appoint up to 3 additional
10 persons to serve as nonvoting members of the Task Force, who
11 may be technical consultants from; such persons shall be
12 officers or employees of a constitutional office or of a
13 department or agency of the executive branch.
14 The Task Force may begin to conduct business upon the
15 appointment of a majority of the voting members. If the
16 chair has not been appointed but both vice chairs have been
17 appointed, the 2 vice chairs shall preside jointly. If the
18 chair has not been appointed and only one vice chair has been
19 appointed, that vice chair shall preside.
20 Members shall serve without compensation but may be
21 reimbursed for their expenses.
22 (c) The Task Force shall gather information and make
23 recommendations relating to the performance of the Illinois
24 Department of Human Services since its creation under this
25 Act, with respect to its success in achieving the goals and
26 objectives of the human services consolidation, the
27 effectiveness of its structure and function, and its impact
28 on the delivery of programs and services. planning,
29 organization, and implementation of human services
30 consolidation. The Task Force shall work to assure that the
31 human services delivery system is meeting meets and adhering
32 adheres to the goals of quality, efficiency, accountability,
33 and financial responsibility; to make recommendations in
34 keeping with those goals concerning the design, operation,

1 and organizational structure of the new Department of Human
2 Services; and to recommend any necessary implementing
3 legislation for the improvement of programs and services
4 under the jurisdiction of the Department of Human Services.
5 The Task Force shall evaluate monitor the implementation
6 of human service program reorganization and shall study its
7 effect on the delivery of services to the citizens of
8 Illinois. The Task Force shall make recommendations to the
9 Governor and the General Assembly regarding the effect of the
10 future consolidation of human service programs and functions.
11 (d) The Task Force shall:
12 (1) review and make recommendations on the
13 organizational structure of the new Department of Human
14 Services;
15 (2) review the status of and approve plans for a
16 unified electronic management and intake information and
17 reporting system as provided in Section 1-25, and monitor
18 and guide the implementation of the system;
19 (3) review the progress that the Department has
20 made toward and make recommendations on the consolidation
21 or elimination of fragmented or duplicative programs;
22 (4) monitor and review the progress that the
23 Department has made on maximizing make recommendations on
24 how best to maximize future federal funding for the new
25 Department of Human Services, with specific specifically
26 including consideration of any federal Medicaid, welfare,
27 or block grant reforms that have been authorized to
28 enhance State programs and services reform;
29 (5) review the progress that the Department has
30 made and make recommendations on geographic
31 regionalization;
32 (6) review the progress that the Department has
33 made and make recommendations on the development of
34 common intake and client confidentiality processes;

1 (7) review the progress that the Department has
2 made with respect and make recommendations to foster
3 effective community-based privatization;
4 (8) obtain a management audit of the Department of
5 Human Services Children and Family Services, to be
6 completed and submitted to the Task Force no later than
7 March 1, 2004, which shall include a preliminary review
8 and findings regarding the effect that the consolidation
9 has had on programs and services for the mentally ill and
10 developmentally disabled, individuals currently receiving
11 services under the Office of Rehabilitation Services, and
12 individuals in the substance abuse prevention and
13 treatment programs July 1, 1997; and
14 (9) review any other appropriate matter and make
15 recommendations to assure a high quality, efficient,
16 accountable, and financially responsible system for the
17 delivery of human services to the people of Illinois.
18 (e) The Task Force may hire any necessary staff or
19 consultants, enter into contracts, and make any expenditures
20 necessary for carrying out its duties, all out of moneys
21 appropriated for that purpose. Staff support services may be
22 provided to the Task Force by the Office of the Governor, the
23 agencies of State government represented on the Task Force by
24 ex officio members directly involved in the reorganization of
25 the delivery of human services, and appropriate legislative
26 staff.
27 (f) The Task Force may establish an advisory committee
28 to ensure maximum public participation in the Task Force's
29 planning, organization, and implementation review process.
30 If established, the advisory committee shall (1) advise and
31 assist the Task Force in its duties, (2) help the Task Force
32 to identify issues of public concern, and (3) meet at least
33 quarterly.
34 (g) The Task Force shall submit preliminary reports of

1 its findings and recommendations to the Governor and the
2 General Assembly by January 1, 2004 and March 1, 2004, and a
3 final report by September 1, 2004 February 1, 1997 and
4 February 1, 1998 and a final report by January 1, 1999. It
5 may submit other reports as it deems appropriate.
6 (h) The Task Force is abolished on January 1, 2005
7 February 1, 1999.

9 Section 99. Effective date. This Act takes effect upon
10 becoming law.
