093_HB2844 LRB093 06699 RLC 06833 b 1 AN ACT in relation to criminal law. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Code of 1961 is amended by adding 5 Sections 12-4.10 and 12-4.11 as follows: 6 (720 ILCS 5/12-4.10 new) 7 Sec. 12-4.10. Drug related child endangerment. 8 (a) A person commits the offense of drug related child 9 endangerment when he or she endangers the life and health of 10 a child by knowingly exposing the child to a clandestine drug 11 laboratory environment by performing any of the following 12 acts: 13 (1) producing, manufacturing, or preparing a 14 controlled substance; or 15 (2) producing, manufacturing, or preparing an 16 ingredient required to manufacture a controlled 17 substance; or 18 (3) storing chemicals used in the controlled 19 substance manufacturing process in a structure to which 20 the child has access; or 21 (4) storing contaminated apparatus used in the 22 controlled substance manufacturing process in a structure 23 to which the child has access; or 24 (5) storing chemical waste and other by-products 25 created during the controlled substance manufacturing 26 process in a structure to which the child has access; or 27 (6) storing any device used for the ingestion of 28 controlled substances in a structure to which the child 29 has access. 30 (b) In this Section: 31 "Child" means a person under the age of 18 years. -2- LRB093 06699 RLC 06833 b 1 "Structure" means any house, apartment building, shop, 2 barn, warehouse, building, vessel, railroad car, cargo 3 container, motor vehicle, house car, trailer, trailer coach, 4 camper, mine, floating home, watercraft, any structure 5 capable of holding a clandestine laboratory or any real 6 property. 7 (c) Sentence. A person convicted of drug related child 8 endangerment is guilty of a Class 2 felony. 9 (720 ILCS 5/12-4.11 new) 10 Sec. 12-4.11. Aggravated drug related child endangerment. 11 (a) A person commits the offense of aggravated drug 12 related child endangerment when he or she: 13 (1) commits a violation of drug related child 14 endangerment; and 15 (2) the child experiences death, great bodily harm, 16 disability or disfigurement as a result of the drug 17 related child endangerment. 18 (b) Sentence. Aggravated drug related child endangerment 19 is a Class X felony. 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
