093_HB2463 LRB093 07497 JAM 07669 b 1 AN ACT concerning legislative oversight of State 2 contracts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Business Enterprise for Minorities, 6 Females, and Persons with Disabilities Act is amended by 7 adding Section 7.5 as follows: 8 (30 ILCS 575/7.5 new) 9 Sec. 7.5. Legislative Contract Compliance Oversight 10 Panel. 11 (a) The Legislative Contract Compliance Oversight Panel 12 is created, consisting of 8 members of the General Assembly 13 who serve by virtue of their office and are appointed as 14 follows: 15 (1) 2 Representatives appointed by the Speaker of 16 the House of Representatives. 17 (2) 2 Representatives appointed by the Minority 18 Leader of the House of Representatives. 19 (3) 2 Senators appointed by the President of the 20 Senate. 21 (4) 2 Senators appointed by the Minority Leader of 22 the Senate. 23 Members serve at the pleasure of their appointing 24 authority. Annually, the members must select 2 from among 25 themselves to serve as co-chairs of the Panel. Members 26 receive no compensation for their service on the Panel. 27 (b) The Panel must oversee the compliance of the 28 Illinois Department of Transportation with the goals and 29 requirements of this Act in the awarding of State 30 construction contracts involving federal moneys or federal 31 reimbursement in whole or in part, directly or indirectly. -2- LRB093 07497 JAM 07669 b 1 The Illinois Department of Transportation must provide the 2 Panel with copies of its compliance plan, contract notices, 3 and requests for exemptions and waivers under this Act. The 4 Illinois Department of Transportation must report quarterly 5 in writing to the Panel on its progress in meeting the goals 6 and requirements of this Act in its awarding of State 7 construction contracts involving federal moneys or federal 8 reimbursement. 9 (c) The Panel must conduct public forums periodically 10 throughout the State at which contractors subject to this Act 11 and other interested parties may comment upon and question 12 the compliance of the Illinois Department of Transportation 13 with the goals and requirements of this Act. The Panel may 14 request the attendance at the public forums of appropriate 15 representatives of the Department. 16 (d) The Panel must periodically report to the Business 17 Enterprise Council its findings and any recommendations 18 regarding the compliance of the Illinois Department of 19 Transportation with the goals and requirements of this Act. 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
