093_HB2284 LRB093 06451 BDD 06574 b 1 AN ACT concerning fire protection. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Fire Protection District Act is amended 5 by changing Section 11f as follows: 6 (70 ILCS 705/11f) (from Ch. 127 1/2, par. 31f) 7 Sec. 11f. Charge against non-residents. 8 (a) The board of trustees of a fire protection district 9 may fix, charge, and collect fees not exceeding the 10 reasonable cost of the service for all services rendered by 11 the district against persons, businesses and other entities 12 who are not residents of the fire protection district. 13 Additionally, the board of trustees of a fire protection 14 district may fix, charge, and collect fees, not exceeding the 15 reasonable cost of the service, from the State arising from 16 all services rendered by the district in response to 17 emergency calls at State highway and Interstate highway rest 18 areas that are not located on a toll highway within the 19 State; claims for fees shall be filed with the Court of 20 Claims. 21 (b) Such charge may not be assessed against residents of 22 the fire protection district or persons who request fire 23 protection coverage for an unprotected area and who pay to 24 the fire protection district an amount equal to the 25 district's Fire Protection Tax pursuant to Section 4 of the 26 Fire Protection of Unprotected Area Act. 27 (c) The charge for such services shall be computed at a 28 rate not to exceed $125 per hour per vehicle and not to 29 exceed $35 per hour per firefighter responding to a call for 30 assistance. An additional charge may be levied to reimburse 31 the district for extraordinary expenses of materials used in -2- LRB093 06451 BDD 06574 b 1 rendering such services. No charge shall be made for services 2 for which the total charge would be less than $50. 3 (d) All revenue from the charges assessed pursuant to 4 this Section shall be deposited to the general fund of the 5 fire protection district. 6 (Source: P.A. 89-180, eff. 7-19-95.)
