093_HB2250eng HB2250 Engrossed LRB093 06748 MKM 06883 b 1 AN ACT concerning criminal law. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Code of 1961 is amended by 5 changing Section 20-1 as follows: 6 (720 ILCS 5/20-1) (from Ch. 38, par. 20-1) 7 Sec. 20-1. Arson. 8 (a) A person commits arson when, by means of fire or 9 explosive, he knowingly: 10 (1)(a)Damages any real property, or any personal 11 property having a value of $150 or more, of another 12 without his consent; or 13 (2)(b)With intent to defraud an insurer, damages 14 any property or any personal property having a value of 15 $150 or more. 16 (b) A person commits arson when, by means of fire or 17 explosive and as a result of manufacturing or attempting to 18 manufacture a controlled substance in violation of State law, 19 he or she negligently damages any building or property. 20 Property "of another" means a building or other property, 21 whether real or personal, in which a person other than the 22 offender has an interest which the offender has no authority 23 to defeat or impair, even though the offender may also have 24 an interest in the building or property. 25 (c) Sentence. 26 Arson is a Class 2 felony, except that arson, as defined 27 in subsection (b), that results in the death or injury of any 28 firefighter, police officer, or emergency medical personnel 29 is a Class X felony. 30 (Source: P.A. 77-2638.)
