 1                    AMENDMENT TO HOUSE BILL 2185

 2        AMENDMENT NO.     .  Amend House Bill 2185  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The  State Finance Act is amended by adding
 5    Section 5.595 as follows:

 6        (30 ILCS 105/5.595 new)
 7        Sec. 5.595.  The Blindness Prevention Fund.

 8        Section 10.  The  Illinois  Identification  Card  Act  is
 9    amended by changing Section 5 as follows:

10        (15 ILCS 335/5) (from Ch. 124, par. 25)
11        Sec. 5.  Applications.
12        (a)  Any natural person who is a resident of the State of
13    Illinois,  may file an application for an identification card
14    or for the renewal thereof, in a  manner  prescribed  by  the
15    Secretary.   Each  original application shall be completed by
16    the applicant in full and shall set forth the  name,  address
17    and  zip  code, social security number, birth date, sex and a
18    brief description of the applicant.  The applicant  shall  be
19    photographed  and  he shall also submit any other information
20    as the Secretary may deem necessary or such documentation  as

 1    the  Secretary  may  require to determine the identity of the
 2    applicant.  An applicant for a  disabled  persons  card  must
 3    also  submit  with  each  original or renewal application, on
 4    forms prescribed by the Secretary, such documentation as  the
 5    Secretary  may  require, establishing that the applicant is a
 6    "disabled person" as defined in Section 4A of this  Act,  and
 7    setting forth the applicant's type and class of disability as
 8    set forth in Section 4A of this Act.
 9        (b)  In  addition  to the fees collected under Section 12
10    of this Act, the Secretary of State  shall  ask  each  person
11    applying  for or renewing a State identification card whether
12    the person wishes to make a $1 voluntary contribution to  the
13    Blindness  Prevention Fund established under Section 6-106 of
14    the Illinois Vehicle Code. All donations collected under this
15    subsection  (b)  shall  be  deposited  into   the   Blindness
16    Prevention Fund.

18        Section  15.   The  Illinois  Vehicle  Code is amended by
19    changing Sections 6-106 and 6-510 as follows:

20        (625 ILCS 5/6-106) (from Ch. 95 1/2, par. 6-106)
21        Sec.  6-106.  Application  for  license  or   instruction
22    permit.
23        (a)  Every   application   for   any  permit  or  license
24    authorized to be issued under this Act shall be made  upon  a
25    form  furnished  by the Secretary of State. Every application
26    shall be accompanied by the proper fee and  payment  of  such
27    fee  shall  entitle the applicant to not more than 3 attempts
28    to pass the examination within a period of 1 year  after  the
29    date of application.
30        (b)  Every  application  shall  state  the  name,  social
31    security  number, zip code, date of birth, sex, and residence
32    address of the applicant;  briefly  describe  the  applicant;

 1    state  whether the applicant has theretofore been licensed as
 2    a driver, and, if so, when and by what state or country,  and
 3    whether  any such license has ever been cancelled, suspended,
 4    revoked or refused, and, if so, the date and reason for  such
 5    cancellation,   suspension,   revocation  or  refusal;  shall
 6    include an affirmation by the applicant that all  information
 7    set forth is true and correct; and shall bear the applicant's
 8    signature.    The  application  form  may  also  require  the
 9    statement of such  additional  relevant  information  as  the
10    Secretary  of  State  shall  deem  necessary to determine the
11    applicant's competency  and  eligibility.  The  Secretary  of
12    State  may  in his discretion substitute a federal tax number
13    in lieu of a social security number, or he may instead assign
14    an additional distinctive number in lieu  thereof,  where  an
15    applicant  is  prohibited  by bona fide religious convictions
16    from applying  or  is  exempt  from  applying  for  a  social
17    security  number.  The  Secretary  of  State  shall, however,
18    determine which religious orders or sects have such bona fide
19    religious convictions. The Secretary of  State  may,  in  his
20    discretion,   by   rule   or   regulation,  provide  that  an
21    application for a drivers license or  permit  may  include  a
22    suitable  photograph  of the applicant in the form prescribed
23    by the Secretary,  and  he  may  further  provide  that  each
24    drivers license shall include a photograph of the driver. The
25    Secretary of State may utilize a photograph process or system
26    most suitable to deter alteration or improper reproduction of
27    a  drivers  license  and  to  prevent substitution of another
28    photo thereon.
29        (c)  The application form shall include a notice  to  the
30    applicant  of  the  registration obligations of sex offenders
31    under the Sex Offender Registration Act.  The notice shall be
32    provided in a form and manner prescribed by the Secretary  of
33    State.   For  purposes of this subsection (c), "sex offender"
34    has the meaning ascribed to  it  in  Section  2  of  the  Sex

 1    Offender Registration Act.
 2        (d)  Any  male  United  States  citizen  or immigrant who
 3    applies for any permit or license  authorized  to  be  issued
 4    under this Act or for a renewal of any permit or license, and
 5    who  is  at  least  18 years of age but less than 26 years of
 6    age, must be registered in compliance with  the  requirements
 7    of  the federal Military Selective Service Act. The Secretary
 8    of State must forward in an electronic format  the  necessary
 9    personal  information  regarding the applicants identified in
10    this subsection (d) to  the  Selective  Service  System.  The
11    applicant's   signature  on  the  application  serves  as  an
12    indication that the applicant either has  already  registered
13    with  the  Selective Service System or that he is authorizing
14    the Secretary to forward to the Selective Service System  the
15    necessary  information  for  registration. The Secretary must
16    notify the applicant at the  time  of  application  that  his
17    signature   constitutes  consent  to  registration  with  the
18    Selective Service System, if he is not already registered.
19        (e)  In addition to  the  fees  collected  under  Section
20    6-118  of  this  Act,  the  Secretary of State shall ask each
21    person applying for or  renewing  a  license  or  instruction
22    permit  whether  the  person  wishes  to  make a $1 voluntary
23    contribution to the  Blindness  Prevention  Fund  established
24    under  this  Section.  All  donations  collected  under  this
25    subsection   (e)   shall  be  deposited  into  the  Blindness
26    Prevention Fund.
27        (f)  The  Blindness  Prevention  Fund  is  created  as  a
28    special fund in the State treasury. All moneys  in  the  Fund
29    shall,  subject  to appropriation by the General Assembly, be
30    used by the  Department  of  Human  Services  for  grants  to
31    provide blindness education, screening, and treatment.

 1        Sec.  6-510.  Application for Commercial Driver's License
 2    (CDL).
 3        (a)  The application  for  a  CDL  or  commercial  driver
 4    instruction  permit,  must  include,  but  not necessarily be
 5    limited to, the following:
 6             (1)  the full name and current Illinois  domiciliary
 7        address  (unless  the  application  is for a Non-resident
 8        CDL) of the applicant;
 9             (2)  a  physical  description   of   the   applicant
10        including  sex,  height,  weight,  color of eyes and hair
11        color;
12             (3)  date of birth;
13             (4)  the applicant's social security number or other
14        identifying number acceptable to the Secretary of State;
15             (5)  the applicant's signature;
16             (6)  certifications  required  by  49  C.F.R.   Part
17        383.71; and
18             (7)  any other information required by the Secretary
19        of State.
20        (b)  In  addition  to  the  fees  collected under Section
21    6-118 of this Act, the Secretary  of  State  shall  ask  each
22    person   applying   for  or  renewing  a  CDL  or  commercial
23    instruction permit whether the person wishes  to  make  a  $1
24    voluntary  contribution  to  the  Blindness  Prevention  Fund
25    established  under  Section 6-106 of this Code. All donations
26    collected under this subsection (b) shall be  deposited  into
27    the Blindness Prevention Fund.
