093_HB1460 LRB093 03992 EFG 04031 b 1 AN ACT in relation to the Metropolitan Water Reclamation 2 District. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Metropolitan Water Reclamation District 6 Act is amended by changing Section 4.32 as follows: 7 (70 ILCS 2605/4.32) (from Ch. 42, par. 323.32) 8 Sec. 4.32. Veteran's preference. 9 (a) A person who served on active duty in the United 10 States Army, Navy, Air Force, Marine Corps, or Coast Guard 11 for a period of more than 180 consecutive days and was 12 honorably discharged from that service is entitled to a 13 veteran's preference under this Section. 14 For the purpose of this Section, "active duty" does not 15 include training or inactive duty performed as a member of 16 the National Guard or a Reserve component of the armed 17 forces. 18 (b) The Director of Personnel shall give preference for 19 an original or promotional appointment to a person qualifying 20 for a veteran's preference under this Section whose name 21 appears on an original or promotional eligible register by 22 adding 5 points to the final grade that the person receives 23 as the result of any original or promotional examination held 24 on or after the effective date of this amendatory Act of the 25 93rd General Assembly. 26 (c) The changes made to this Section by this amendatory 27 Act of the 93rd General Assembly are not intended to affect 28 any preference granted under this Section before the 29 effective date of this amendatory Act. 30Persons who were engaged in the military or naval service31of the United States during the years 1898, 1899, 1900, 1901,-2- LRB093 03992 EFG 04031 b 11902, 1914, 1915, 1916, 1917, 1918, or 1919, any time between2September 16, 1940 and July 25, 1947, or any time during the3national emergency between June 25, 1950 and January 31,41955, and who were honorably discharged therefrom, and all5persons who were engaged in such military or naval service6during any of said years, any time between September 16, 19407and July 25, 1947, or any time during the national emergency8between June 25, 1950 and January 31, 1955, or any time from9August 5, 1964 until the date determined by the Congress of10the United States as the end of Viet Nam hostilities, or at11any time between August 6, 1990 and the date the Persian Gulf12Conflict ends as prescribed by Presidential proclamation or13order, who are now or may hereafter be on inactive or reserve14duty in such military or naval service, not including,15however, persons who were convicted by court-martial of16disobedience of orders, where such disobedience consisted in17the refusal to perform military service on the ground of18alleged religious or conscientious objections against war,19shall be preferred for appointments to offices, positions and20places of employment in the classified service of the21District, provided they are found to possess the business22capacity necessary for the proper discharge of the duties of23such office, position, or place of employment as determined24by examination for original entrance. The Director of25Personnel on certifying from any existing register of26eligibles resulting from the holding of an examination for27original entrance or any register of eligibles that may be28hereafter created of persons who have taken and successfully29passed the examinations provided for in this Act for original30entrance commenced prior to September 1, 1949, shall place31the name or names of such persons at the head of any existing32eligible register or list of eligibles that shall be created33under the provisions of this Act to be certified for34appointment. The Director of Personnel shall give preference-3- LRB093 03992 EFG 04031 b 1for original appointment to persons as hereinabove designated2whose names appear on any register of eligibles resulting3from an examination for original entrance held under the4provisions of this Act and commenced on or after September 1,51949 by adding to the final grade average which they received6or will receive as the result of any examination held for7original entrance, five points. The numerical result thus8attained shall be applied by the Director of Personnel in9determining the position of such persons on any eligible list10which has been created as the result of any examination for11original entrance commenced on or after September 1, 1949 for12purposes of preference in certification and appointment from13such eligible list.14Every certified Civil Service employee who was called to,15or who volunteered for, the military or naval service of the16United States at any time during the years specified in this17Act, or at any time between September 16, 1940 and July 25,181947 or any time during the national emergency between June1925, 1950 and January 31, 1955, or any time from August 5,201964 until the date determined by Congress of the United21States as the end of Viet Nam hostilities, or at any time22between August 6, 1990 and the date the Persian Gulf conflict23ends as prescribed by Presidential proclamation or order, and24who were honorably discharged therefrom or who are now or who25may hereafter be on inactive or reserve duty in such military26or naval service, not including, however, persons who were27convicted by court martial of disobedience of orders where28such disobedience consisted in the refusal to perform29military service on the ground of alleged religious or30conscientious objections against war, and whose names appear31on existing promotional eligible registers or any promotional32eligible register that may hereafter be created, as provided33for by this Act, shall be preferred for promotional34appointment to civil offices, positions and places of-4- LRB093 03992 EFG 04031 b 1employment in the classified civil service of the District2coming under the provisions of this Act.3The Director of Personnel shall give preference for4promotional appointment to persons as hereinabove designated5whose names appear on existing promotional eligible registers6or promotional eligible registers that may hereafter be7created by adding to the final grade average which they8received or will receive as the result of any promotional9examination commencing prior to September 1, 194910three-fourths of one point for each 6 months or fraction11thereof of military or naval service not exceeding 48 months,12and by adding to the final grade average which they will13receive as the result of any promotional examination held14commencing on or after September 1, 1949 seven-tenths of one15point for each 6 months or fraction thereof of military or16naval service not exceeding 30 months. The numerical result17thus attained shall be applied by the Director of Personnel18in determining the position of such persons on any eligible19list which has been created or will be created as the result20of any promotional examination held hereunder for purposes of21preference in certification and appointment from such22eligible list.23No person shall receive the preference for a promotional24appointment granted by this Section after he has received one25promotion from an eligible list on which he was allowed such26preference and which was prepared as a result of an27examination held on or after September 1, 1949.28No person entitled to preference or credit for military29or naval service hereunder shall be required to furnish30evidence or record of honorable discharge from the armed31forces before any examination held under the provisions of32this Act but such preference shall be given after the posting33or publication of the eligible list or register and before34any certification or appointments are made from the eligible-5- LRB093 03992 EFG 04031 b 1register.2 (Source: P.A. 86-324; 87-945.) 3 Section 99.
