093_HB1367 LRB093 05303 MBS 05393 b 1 AN ACT concerning environmental protection. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Illinois Stadium Clean Air Act. 6 Section 5. Findings. The General Assembly finds that 7 smoking at stadiums is a hazard and a danger to public safety 8 and that tobacco smoke is annoying, harmful, and dangerous to 9 human beings and a hazard to public health. 10 Section 10. Definition. As used in this Act: 11 "Stadium" means a publicly or privately owned or operated 12 sports or entertainment arena, community or convention hall, 13 special event center, or amusement facility, including a 14 special event center in a public park. 15 Section 15. No smoking in stadiums. No person shall 16 smoke or possess a lighted cigarette, cigar, pipe or any 17 other form of tobacco or similar substance used for smoking 18 at any stadium in this State. 19 Section 20. Penalties. Any person who violates the 20 provisions of this Act is guilty of a petty offense 21 punishable by a fine of not less than $25 nor more than $250. 22 Section 800. The Illinois Clean Indoor Air Act is 23 amended by changing Section 4 as follows: 24 (410 ILCS 80/4) (from Ch. 111 1/2, par. 8204) 25 Sec. 4. Smoking in public places; exception. No person 26 shall smoke in any of the following: (i) a hospital, -2- LRB093 05303 MBS 05393 b 1 including entrances and exits or on the hospital grounds, 2 (ii) an ambulatory surgical treatment center, (iii) a 3 post-surgical recovery center, (iv) a dentist's or 4 physician's office, (v) any other health care professional 5 office or health care facility, except that residents may 6 smoke in their rooms in a facility licensed under the Nursing 7 Home Care Act, or (vi) a restaurant. No person shall smoke in 8 any otherapublic place except in that portion of a public 9 place which may be established and posted under Section 5 as 10 a smoking area. This prohibition does not apply in cases in 11 which an entire room or hall is used for a private social 12 function and seating arrangements are under the control of 13 the sponsor of the function and not of the proprietor or 14 person in charge of the place. Furthermore, this prohibition 15 shall not apply to factories, warehouses and similar places 16 of work not usually frequented by the general public. 17 (Source: P.A. 86-1018.) 18 Section 999.
