 1        AN ACT in relation to property.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Conveyances  Act is amended by changing
 5    Section 4 as follows:

 6        (765 ILCS 5/4) (from Ch. 30, par. 4)
 7        Sec. 4.  Conveyor not in possession of lands.  Any person
 8    claiming right or title to lands, tenements or hereditaments,
 9    although he, she or  they  may  be  out  of  possession,  and
10    notwithstanding  there  may be an adverse possession thereof,
11    may sell, convey and transfer his or her interest in  and  to
12    the  same,  in  as full and complete a manner as if he or she
13    were in the actual  possession  of  the  lands  and  premises
14    intended  to  be  conveyed; and the grantee or grantees shall
15    have the same right of action for the recovery  thereof,  and
16    shall  in  all respects derive the same benefit and advantage
17    therefrom, as if the grantor or  grantors  had  been  in  the
18    actual possession at the time of executing the conveyance.
