 1        AN ACT concerning elections.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Election  Code  is  amended by changing
 5    Sections 9-8.15 and 9-25.5 as follows:

 6        (10 ILCS 5/9-8.15)
 7        Sec.   9-8.15.    Contributions   on   State    property.
 8    Contributions  shall  not be knowingly solicited, offered, or
 9    accepted on a  face-to-face  basis  by  public  officials  or
10    employees  or  by  candidates  on  State  property  except as
11    provided in this  Section.  For  purposes  of  this  Section,
12    "State  property"  means any building or structure located on
13    real  property  owned,  leased,   managed,   controlled,   or
14    otherwise occupied by any governmental entity of the State.
15        Contributions  may  be solicited, offered, or accepted on
16    State property on a face-to-face basis by public officials or
17    employees or by candidates at a fundraising event  for  which
18    the State property is leased or rented.
19        Anyone   who   knowingly  solicits,  offers,  or  accepts
20    contributions on State property in violation of this  Section
21    is  guilty of a business offense subject to a fine of $5,000,
22    except that for contributions solicited, offered, or accepted
23    for State officers and candidates  and  political  committees
24    formed  for  statewide  office,  the  fine  shall  not exceed
25    $10,000.  For the purpose of this Section, "statewide office"
26    and "State officer" means the Governor, Lieutenant  Governor,
27    Attorney   General,  Secretary  of  State,  Comptroller,  and
28    Treasurer.

 1        Sec. 9-27.5.  Fundraising in or within 50  miles  of  the
 2    State  Capitol  building  Springfield.  Except as provided in
 3    this Section, any executive  branch  constitutional  officer,
 4    any  candidate for an executive branch constitutional office,
 5    any member of the General Assembly,  any  candidate  for  the
 6    General   Assembly,  any  political  caucus  of  the  General
 7    Assembly, or any political committee on behalf of any of  the
 8    foregoing may not hold a fundraising function in or within 50
 9    miles  of  the  State Capitol building Springfield on any day
10    the legislature is in session (i) during the period beginning
11    90 days before the later of the  dates  scheduled  by  either
12    house  of  the  General  Assembly  for the adjournment of the
13    spring  session  and  ending  on  the  later  of  the  actual
14    adjournment dates of either house of the spring  session  and
15    (ii)  during fall veto session. For purposes of this Section,
16    the legislature is not considered to be in session on  a  day
17    that  is  solely  a  perfunctory session day or on a day when
18    only a committee is meeting.
19        This Section does not  apply  to  members  and  political
20    committees of members of the General Assembly whose districts
21    are  located,  in  whole or in part, in or within 50 miles of
22    the State Capitol building  Springfield  and  candidates  and
23    political  committees  of candidates for the General Assembly
24    from districts located, in whole or in part, in or within  50
25    miles  of  the  State  Capitol building Springfield, provided
26    that the fundraising function takes place within the member's
27    or candidate's district.
