 1        AN ACT concerning agriculture.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section   5.  The  Agricultural  Areas  Conservation  and
 5    Protection Act is amended by changing Section 5 as follows:

 6        (505 ILCS 5/5) (from Ch. 5, par. 1005)
 7        Sec. 5.   Agricultural  Areas;  Creation.  Any  owner  or
 8    owners  of land may submit a proposal to the county board for
 9    the creation of an agricultural area within such  county.  An
10    agricultural  area,  at  the creation of any such area, shall
11    not be less than 350 acres in all counties with a  population
12    under  600,000  and  not  less than 100 acres in all counties
13    with a population of 600,000 or  more.  Such  proposal  shall
14    include  a  description  of  the proposed area, including the
15    boundaries thereof. Such territory shall be  as  compact  and
16    nearly contiguous as feasible. An area created under this Act
17    shall  be  established  for  a  period of ten years.  No land
18    shall be included in an agricultural area without the consent
19    of the owner.  No land within an agricultural area  shall  be
20    used  for  other than agricultural production as described in
21    Sections 3.01 and 3.02  of  this  Act.   Agreements  for  the
22    extraction of mineral resources duly agreed upon prior to the
23    creation  of  an agricultural area shall be exempted from the
24    use provisions of this Section.  In addition, the  extraction
25    of  mineral  resources conducted pursuant to The Surface Coal
26    Mining  Land  Conservation  and  Reclamation  Act  shall   be
27    considered  temporary land use and shall be exempted from the
28    use provisions of this Section.
