1 AN ACT concerning hazardous materials.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Hazardous Material Emergency Response
5 Reimbursement Act is amended by changing Section 3 as
6 follows:
7 (430 ILCS 55/3) (from Ch. 127 1/2, par. 1003)
8 Sec. 3. Definitions. As used in this Act:
9 (a) "Emergency action" means any action taken at or near
10 the scene of a hazardous materials emergency incident to
11 prevent or minimize harm to human health, to property, or to
12 the environments from the unintentional release of a
13 hazardous material.
14 (b) "Emergency response agency" means a unit of local
15 government or volunteer fire protection organization that
16 provides:
17 (1). firefighting services;
18 (2). emergency rescue services;
19 (3). emergency medical services;
20 (4). hazardous materials response teams; or
21 (5). civil defense; or
22 (6) technical rescue teams.
23 (c) "Responsible party" means a person who:
24 (1) owns or has custody of hazardous material that
25 is involved in an incident requiring emergency action by
26 an emergency response agency; or
27 (2) owns or has custody of bulk or non-bulk
28 packaging or a transport vehicle that contains hazardous
29 material that is involved in an incident requiring
30 emergency action by an emergency response agency; and
31 (3) who causes or substantially contributed to the

1 cause of the incident.
2 (d) "Person" means an individual, a corporation, a
3 partnership, an unincorporated association, or any unit of
4 federal, State or local government.
5 (e) "Annual budget" means the cost to operate an
6 emergency response agency excluding personnel costs, which
7 include salary, benefits and training expenses; and costs to
8 acquire capital equipment including buildings, vehicles and
9 other such major capital cost items.
10 (f) "Hazardous material" means a substance or material
11 in a quantity and form determined by the United States
12 Department of Transportation to be capable of posing an
13 unreasonable risk to health and safety or property when
14 transported in commerce.
15 (g) "Panel" means administrative panel.
