 1                    AMENDMENT TO HOUSE BILL 1045

 2        AMENDMENT NO.     .  Amend House Bill 1045  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The  Director  of Agriculture, on behalf of
 5    the State of Illinois, is authorized to exchange certain real
 6    property in Perry County, Illinois, hereinafter  referred  to
 7    as  Parcel  1,  for  certain  real property of equal value in
 8    Perry County, Illinois, hereinafter referred to as Parcel  2,
 9    with the NOTFA Land Trust #1, such Parcels being described as
10    follows:

11        PARCEL 1
12                         GENERAL DESCRIPTION
13        A  part of the Northwest Quarter of the Northeast Quarter
14        of Section 29, Township 6 South,  Range  1  West  of  the
15        Third Principal Meridian, Perry County, Illinois
16                        DETAILED DESCRIPTION
17        Commencing  at the Southwest Corner of the said Northwest
18        Quarter of the Northeast Quarter; thence  Easterly  along
19        the  South  line  of  the  said  Northwest Quarter of the
20        Northeast Quarter a distance of 62.62  feet  to  an  iron
21        rebar  found  in the East Right-of-Way line of U.S. Route
22        51; thence Northerly along  the  said  East  Right-of-Way

 1        said  line  being  60  feet Easterly of the centerline of
 2        U.S. Route 51 a distance of 854.56 feet to an iron  rebar
 3        found  being the point of beginning for this description;
 4        from said point of beginning continuing  Northerly  along
 5        said  Right-of-Way  line  a  distance of 438.91 feet to a
 6        point on the proposed  South  Right-of-Way  line  of  Bob
 7        Green  Drive;  thence  Easterly  along the proposed South
 8        Right-of-Way line of Bob Green Drive  with  a  deflection
 9        angle  of  90 degrees 24 minutes 35 seconds a distance of
10        576.05 feet to a point; thence  Southerly  along  a  line
11        with  a  deflection of 89 degrees 35 minutes 25 seconds a
12        distance of 435.46 feet to a point; thence Westerly along
13        a line with a deflection of  90  degrees  03  minutes  56
14        seconds  a  distance  of  576.04  feet  to  the  point of
15        beginning containing 5.78 acres more or less.

17        Part of the NW 1/4 of the NE 1/4 of Section 20,  Township
18        6  South,  Range  1 West of the Third Principal Meridian,
19        Perry County, Illinois, more  particularly  described  as
20        follows, to wit:
21        Commencing  at  the Northwest corner of the NW 1/4 of the
22        NE 1/4 of Section 20, Township 6 South, Range 1  West  of
23        the  Third  Principal Meridian, Perry County, thence S 00
24        degrees 02 minutes 14 seconds E, an assumed bearing along
25        the West line of the NW 1/4 of the NE 1/4 of said Section
26        20, a distance of 1132.54 feet, to the point of beginning
27        for the tract herein described; thence  continuing  S  00
28        degrees  02  minutes 14 seconds E, along the West line of
29        the NW 1/4 of the NE 1/4 of said Section 20,  a  distance
30        of 143.52 feet; thence S 89 degrees 04 minutes 51 seconds
31        E, a distance of 175.04 feet, to an iron pin; thence S 00
32        degrees  00  minutes  30  seconds  E, a distance of 75.00

 6        thence N 89 degrees 03 minutes 51 seconds W,  a  distance
 7        of  654.24  feet,  to an iron pin; thence S 00 degrees 12
 8        minutes 17 seconds E, a distance of 112.02  feet,  to  an
 9        iron  pin; thence N 88 degrees 46 minutes 16 seconds W, a
10        distance of 420.40 feet, to an  iron  pin;  thence  S  41
11        degrees  29  minutes  05  seconds  W, a distance of 38.74
12        feet, to an iron pin; thence S 89 degrees 03  minutes  07
13        seconds  W,  a  distance  of 154.42 feet, to the point of
14        beginning, containing 8.80 acres, more or less.

15        Section  10.  Whereas,  the  transaction   described   in
16    Section  5  will be to the mutual advantages of both parties,
17    each party shall be responsible for any and all  title  costs
18    associated with their respective properties.

19        Section  15.  The Director of Agriculture shall obtain an
20    opinion  of  title  from  the   Illinois   Attorney   General
21    certifying   that   the   State   of  Illinois  will  receive
22    merchantable title to the real property referred to as Parcel
23    2 in Section 5.

24        Section 20.  The Director of Agriculture shall  obtain  a
25    certified  copy  of  the  portions of this Act containing the
26    title,  the  enacting  clause,  the   effective   date,   the
27    appropriate  Sections  containing  the  land  descriptions of
28    property to be transferred, and this Section within  60  days
29    after  this Act's effective date and, upon receipt of payment
30    or other consideration required by the appropriate  Sections,
31    shall  record the certified document in the Recorder's office

 1    in the county in which the land is located.

 2        Section 99.  Effective date.  This Act takes effect  upon
 3    becoming law.".
