AMENDMENT TO HOUSE BILL 966

2     AMENDMENT NO. ______. Amend House Bill 966 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. If and only if Executive Order No. 2004-6
5 becomes effective in accordance with Section 11 of Article V of
6 the Illinois Constitution, then the Civil Administrative Code
7 of Illinois is amended by adding Section 5-710 as follows:
 
8     (20 ILCS 5/5-710 new)
9     Sec. 5-710. Executive Order provision superseded.
10     (a) Executive Order No. 2004-6 creates the Department of
11 Financial and Professional Regulation and, in subdivision
12 I(B), provides in part: "The New Agency shall have an officer
13 as its head known as the Secretary who shall be responsible for
14 all agency Functions. Appointment to this office shall be made
15 by the Governor, by and with the advice and consent of the
16 Senate.".
17     (b) Executive Order No. 2004-6, in subdivision I(C),
18 provides in part: "None of the four Directors, nor any such
19 assistants or deputies, shall be state officers subject to
20 Senate confirmation.".
21     (c) The sentence of subdivision I(C) of Executive Order
22 2004-6 that is quoted in subsection (b), to the extent that it
23 exempts the appointments of the 4 Directors of the Department
24 of Financial and Professional Regulation from Senate

1 confirmation, is superseded by subsection (d) of this Section
2 and is of no force or effect as to the appointment of the 4
3 Directors of the Department of Financial and Professional
4 Regulation.
5     (d) In addition to appointments to the office of Secretary
6 of Financial and Professional Regulation, appointments to the 4
7 offices of Director of Financial and Professional Regulation
8 must each be made by the Governor, by and with the advice and
9 consent of the Senate.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.".
