093_HB0721sam003 LRB093 05825 RCE 17313 a 1 AMENDMENT TO HOUSE BILL 721 2 AMENDMENT NO. . Amend House Bill 721, AS AMENDED, 3 after the end of Section 30, by inserting the following: 4 "Section 40. Meigs Field. 5 (a) The General Assembly finds all of the following: 6 (1) Prior to its closure on March 31, 2003, Meigs 7 Field served an important role to the State and national 8 air transportation system. 9 (2) The closure of Meigs Field adversely affects 10 air traffic and airports throughout the Chicago region, 11 presently and significantly in the future with the 12 planned expansion of Chicago O'Hare International 13 Airport. 14 (3) Meigs Field, if reopened, would immediately 15 serve a vital role for air transportation in this State 16 that would include medical flights, emergency services, 17 and business and personal air travel. 18 (4) It is estimated that the cost to repair and 19 reopen Meigs Field is approximately $500,000. 20 (b) The City of Chicago and the Chicago Park District 21 shall forthwith restore and reopen Meigs Field as an airport 22 for public use. 23 (c) The City of Chicago and the Chicago Park District -2- LRB093 05825 RCE 17313 a 1 may not take any action regarding Meigs Field or the property 2 upon which it is located that is inconsistent with this 3 Section. This subsection is a limitation under subsection (i) 4 of section 6 of Article VII of the Illinois Constitution on 5 the concurrent exercise of powers and functions exercised by 6 the state. 7 (d) Notwithstanding Sections 6 and 8 of the State 8 Mandates Act, no reimbursement by the State is required for 9 the implementation of any mandate created by this Section. 10 Section 45. South Suburban Airport; Peotone, Illinois. 11 (a) The Governor and the State of Illinois must 12 immediately, expeditiously, and continuously take all action 13 necessary for the construction and operation of a south 14 suburban airport located in the vicinity of Peotone, 15 Illinois. This includes, without limitation, expeditiously 16 negotiating and settling, if possible, with land owners to 17 acquire property for the airport in order to avoid hardships 18 on the landowners. The Governor must direct the Illinois 19 Department of Transportation and all other executive branch 20 agencies under the Governor's control to comply with this 21 Section. 22 (b) The Governor and the Illinois Department of 23 Transportation shall expeditiously seek approval of the 24 Federal Aviation Administration for an airport runway layout 25 plan, including an inaugural runway of a minimum of 10,000 26 feet, for the south suburban airport located in the vicinity 27 of Peotone, Illinois. The State shall not enact or enforce 28 any law respecting aeronautics that interferes with, or has 29 the effect of interfering with, that runway design."; and 30 after the end of Section 95, by inserting the following: 31 "Section 95.1. The Code of Civil Procedure is amended by 32 adding Section 7-103.150 as follows: -3- LRB093 05825 RCE 17313 a 1 (735 ILCS 5/7-103.150 new) 2 Sec. 7-103.150. Quick-take; Peotone airport. Eminent 3 domain proceedings, including quick-take proceedings under 4 Section 7-103, may be used by the Department of 5 Transportation for the purpose of acquiring property for the 6 construction of an airport in the vicinity of Peotone, 7 Illinois within the following described area: 8 ALL OR A PART OF SECTIONS 1, 2, 3, 4, 5, 6, 8, 9, 10, 11, 9 AND 12, TOWNSHIP 33 NORTH, RANGE 13 EAST, THIRD PRINCIPAL 10 MERIDIAN, WILL TOWNSHIP; ALL OR A PART OF SECTION 31, 11 TOWNSHIP 34 NORTH, RANGE 13 EAST, THIRD PRINCIPAL 12 MERIDIAN, MONEE TOWNSHIP; AND ALL OR A PART OF SECTIONS 7 13 AND 8, TOWNSHIP 33 NORTH, RANGE 14 EAST, THIRD PRINCIPAL 14 MERIDIAN, WASHINGTON TOWNSHIP, ALL SITUATED IN WILL 15 COUNTY, ILLINOIS. 16 Section 95.2. The State Mandates Act is amended by adding 17 section 8.27 as follows: 18 (30 ILCS 805/8.27 new) 19 Sec. 8.27. Exempt mandate. Notwithstanding Sections 6 20 and 8 of this Act, no reimbursement by the State is required 21 for the implementation of any mandate created by Section 40 22 of the O'Hare Modernization Act.".
