 1        AN ACT in relation to health.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section   5.    The   Mental   Health  and  Developmental
 5    Disabilities Code is amended by  changing  Section  1-102  as
 6    follows:

 7        (405 ILCS 5/1-102) (from Ch. 91 1/2, par. 1-102)
 8        Sec. 1-102.  "Care and custody" means authorization to an
 9    appropriate  person,  with his consent, to provide or arrange
10    for proper and adequate treatment of another  person  who  is
11    subject  to  involuntary  admission  but does not include the
12    authority to require hospitalization of the recipient  unless
13    that  such  authority  is  expressly  granted  by court order
14    pursuant to Article VII of Chapter III.
