093_HB0413eng HB0413 Engrossed LRB093 04931 LCB 04990 b 1 AN ACT concerning vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Sections 1-182 and 11-1414.1 as follows: 6 (625 ILCS 5/1-182) (from Ch. 95 1/2, par. 1-182) 7 Sec. 1-182. School bus. 8 (a) "School bus" means every motor vehicle, except as 9 provided in paragraph (b) of this Section, owned or operated 10 by or for any of the following entities for the 11 transportation of persons regularly enrolled as students in 12 grade 12 or below in connection with any activity of such 13 entity: 14 Any public or private primary or secondary school; 15 Any primary or secondary school operated by a religious 16 institution; or 17 Any public, private or religious nursery school. 18 (b) This definition shall not include the following: 19 1. A bus operated by a public utility, municipal 20 corporation or common carrier authorized to conduct local 21 or interurban transportation of passengers when such bus 22 is not traveling a specific school bus route but is: 23 On a regularly scheduled route for the 24 transportation of other fare paying passengers; 25 Furnishing charter service for the transportation of 26 groups on field trips or other special trips or in 27 connection with other special events; or 28 Being used for shuttle service between attendance 29 centers or other educational facilities. 30 2. A motor vehicle of the First Division. 31 3. A motor vehicle designed for the transportation HB0413 Engrossed -2- LRB093 04931 LCB 04990 b 1 of not less than 7 nor more than 16 persons that is 2 operated by or for a public or private primary or 3 secondary school, including any primary or secondary 4 school operated by a religious institution, for the 5 purpose of transporting not more than 15 students to and 6 from interscholastic athletic or other interscholastic or 7 school sponsored activities. 8 4. A truck as defined in Section 1-211 when 9 students are being transported within the passenger 10 compartment to a school related instructional program. 11 The number of students being transported may not exceed 12 the number of actual seating positions within the 13 passenger compartment of the truck. 14 (Source: P.A. 89-132, eff. 7-14-95.) 15 (625 ILCS 5/11-1414.1) (from Ch. 95 1/2, par. 11-1414.1) 16 Sec. 11-1414.1. School transportation of students. 17 (a) Every student enrolled in grade 12 or below in any 18 entity listed in paragraph (a) of Section 1-182 of this Code 19 who is transported in a second division motor vehicle owned 20 or operated by or for that entity, in connection with any 21 official activity of such entity, must be transported in a 22 school bus or a bus described in subparagraph (1) of 23 paragraph (b) of Section 1-182. 24 (b) This Section shall not apply to any second division 25 vehicle being used by such entity in a parade, homecoming or 26 similar school activity, or to a truck used in a school 27 related instructional program if authorized by the school 28 board and supervised by the school district, nor to a motor 29 vehicle designed for the transportation of not less than 7 30 nor more than 16 persons while that vehicle is being operated 31 by or for a public or private primary or secondary school, 32 including any primary or secondary school operated by a 33 religious institution, for the purpose of transporting not HB0413 Engrossed -3- LRB093 04931 LCB 04990 b 1 more than 15 students to and from interscholastic athletic or 2 other interscholastic or school sponsored activities, nor to 3 any truck, as defined in Section 1-211, when students are 4 being transported within the passenger compartment to a 5 school related instructional program. The number of students 6 being transported may not exceed the number of actual seating 7 positions within the passenger compartment of the truck. A 8 school board that authorizes a truck, as defined in Section 9 1-211, to transport students enrolled in grade 12 or below 10 for a school related instructional program shall accept 11 liability for any injury or damage resulting from the 12 transportation of the students. 13 (Source: P.A. 89-132, eff. 7-14-95.) 14 Section 99. Effective date. This Act takes effect upon 15 becoming law.
