 1        AN ACT concerning environmental safety.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The Environmental Protection Act is amended
 5    by changing Section 39.4 as follows:

 6        (415 ILCS 5/39.4) (from Ch. 111 1/2, par. 1039.4)
 7        Sec.  39.4.  Agrichemical  facility  permit  or  lawncare
 8    containment permit endorsement.
 9        (a)  Upon receipt of a joint application transmitted from
10    the Department of Agriculture for  an  agrichemical  facility
11    construction  or  operation  permit or a lawncare containment
12    permit, the Agency may provide a written endorsement  of  the
13    permit  to  be issued by the Department for such agrichemical
14    facility  or  lawncare  wash  water  containment  area.   The
15    Agency's endorsement may be provided at  any  time  prior  to
16    final action by the Department regarding the subject permit.
17        (b)  For  all  purposes  of  this  Act,  an  agrichemical
18    facility  permit  or  lawncare containment permit endorsed by
19    the Agency pursuant to this Section shall be deemed to  be  a
20    permit  issued  by  the  Agency pursuant to subsection (b) of
21    Section 9 and subsection (b) of Section 12 of  this  Act.  An
22    agrichemical  facility  or  a lawncare wash water containment
23    area remains subject to all  applicable  permit  requirements
24    under   this   Act   if   the   Department  of  Agriculture's
25    agrichemical facility permit or lawncare  containment  permit
26    has  not  been  endorsed  pursuant  to subsection (a) of this
27    Section.
28        (c)  An  agrichemical  facility  permit  or  a   lawncare
29    containment  permit  endorsed  by  the  Agency  shall  not be
30    subject to the annual fee provisions of Section 9.6  of  this
31    Act.
