1 AMENDMENT TO HOUSE BILL 318
2 AMENDMENT NO. . Amend House Bill 318 as follows:
3 on page 1, by replacing lines 7 and 8 with the following:
4 ""Age restricted area" means an enclosed designated area
5 in a retail establishment that is directly visible to the
6 cashier, separated from the other areas of the establishment,
7 with a single separate entrance through which no one under 18
8 years of age is allowed to enter.
9 "Tobacco product" means a cigar, loose tobacco,
10 cigarette, packs of cigarettes, or smokeless tobacco,
11 excluding cartons of cigarettes."; and
12 on page 1, by replacing lines 11 through 25 with the
13 following:
14 "Section 10. Tobacco product displays.
15 (a) It is unlawful to sell, offer for sale, give away,
16 or display tobacco products for sale at any location unless
17 the tobacco products are displayed from behind a sales or
18 service counter or in an age restricted area of a retail
19 establishment or in an enclosed display case so that a
20 consumer cannot access tobacco products without the
21 assistance of an employee of the retail establishment
22 authorized to sell tobacco products. At the entrance of the

1 age restricted area shall be posted a legible sign at least
2 12 inches high by 12 inches wide stating:
3 "Age Restricted Area. No One Under the Age of 18
4 Permitted to Enter."
5 (b) The restrictions described in subsection (a) do not
6 apply to a retail tobacco store that (i) derives at least 90%
7 of its revenue from tobacco and tobacco related products;
8 (ii) does not permit persons under the age of 18 to enter the
9 premises; and (iii) posts a sign on the main entrance way
10 stating that persons under the age of 18 are prohibited from
11 entering.".
