093_HB0317 LRB093 04615 EFG 04668 b 1 AN ACT in relation to public employee benefits. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Pension Code is amended by 5 changing Section 6-128.4 and adding Section 6-141.2 as 6 follows: 7 (40 ILCS 5/6-128.4) (from Ch. 108 1/2, par. 6-128.4) 8 Sec. 6-128.4. Minimum widow's annuities. 9 (a) Notwithstanding any other provision of this Article, 10 beginning January 1, 1996, the minimum amount of widow's 11 annuity payable to any person who is entitled to receive a 12 widow's annuity under this Article is $700 per month, without 13 regard to whether the deceased fireman is in service on or 14 after the effective date of this amendatory Act of 1995. 15 (b) Notwithstanding Section 6-128.3, beginning January 16 1, 1994, the minimum widow's annuity under this Article shall 17 be $700 per month for (1) all persons receiving widow's 18 annuities on that date who are survivors of employees who 19 retired at age 50 or over with at least 20 years of service, 20 and (2) persons who become eligible for widow's annuities and 21 are survivors of employees who retired at age 50 or over with 22 at least 20 years of service. 23 (c) Notwithstanding Section 6-128.3, beginning January 24 1, 1999, the minimum widow's annuity under this Article shall 25 be $800 per month for (1) all persons receiving widow's 26 annuities on that date who are survivors of employees who 27 retired at age 50 or over with at least 20 years of service, 28 and (2) persons who become eligible for widow's annuities and 29 are survivors of employees who retired at age 50 or over with 30 at least 20 years of service. 31 (d) Notwithstanding Section 6-128.3 and the other -2- LRB093 04615 EFG 04668 b 1 provisions of this Article, beginning January 1, 2004, the 2 minimum widow's annuity under this Article shall be: 3 (1) $1200 per month for all persons receiving 4 widow's annuities on or after that date who are survivors 5 of employees who retired at age 50 or over with at least 6 20 years of service, and 7 (2) $800 per month for all persons receiving 8 widow's annuities who do not qualify under subdivision 9 (d)(1). 10 This subsection (d) applies to all persons receiving a 11 widow's annuity, without regard to whether the deceased 12 fireman is in service on or after the effective date of this 13 amendatory Act of the 93rd General Assembly. 14 (Source: P.A. 89-136, eff. 7-14-95; 90-766, eff. 8-14-98.) 15 (40 ILCS 5/6-141.2 new) 16 Sec. 6-141.2. Widow's annuity for surviving spouse of 17 deferred annuitant. The widow of a fireman with at least 20 18 years of service who dies after withdrawal from service and 19 after the effective date of this Section, but before 20 beginning to receive a retirement annuity under this Article 21 and before attaining age 50, may elect to receive a widow's 22 annuity equal to 50% of the retirement annuity the deceased 23 fireman would have been eligible to receive if he had 24 attained age 50 on the day of his death. 25 This Section applies without regard to whether the 26 deceased fireman is in service on or after the effective date 27 of this amendatory Act of the 93rd General Assembly. 28 Section 90. The State Mandates Act is amended by adding 29 Section 8.27 as follows: 30 (30 ILCS 805/8.27 new) 31 Sec. 8.27. Exempt mandate. Notwithstanding Sections 6 -3- LRB093 04615 EFG 04668 b 1 and 8 of this Act, no reimbursement by the State is required 2 for the implementation of any mandate created by this 3 amendatory Act of the 93rd General Assembly. 4 Section 99. Effective date. This Act takes effect upon 5 becoming law.
