093_HB0263 LRB093 02163 ACG 02170 b 1 AN ACT concerning ports. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois International Port District Act 5 is amended by changing Sections 5 and 12 as follows: 6 (70 ILCS 1810/5) (from Ch. 19, par. 156) 7 Sec. 5. The Port District shall have the following rights 8 and powers: 9 (a) To issue permits: for the construction of all 10 wharves, piers, dolphins, booms, weirs, breakwaters, 11 bulkheads, jetties, bridges or other structures of any kind, 12 over, under, in, or within 40 feet of any navigable waters 13 within the Port District; for the deposit of rock, earth, 14 sand or other material, or any matter of any kind or 15 description in said waters; 16 (b) To prevent or remove obstructions, including the 17 removal of wrecks; 18 (c) To locate and establish dock lines and shore or 19 harbor lines; 20 (d) Beyond the limits or jurisdiction of any 21 municipality to regulate the anchorage, moorage and speed of 22 vessels and to establish and enforce regulations for the 23 operation of bridges and to regulate the anchorage, moorage, 24 and speed of water borne vessels in the entrance channel, 25 anchorage basin and slips in the Senator Dan Dougherty Harbor 26 at Lake Calumet; 27 (e) To acquire, own, construct, sell, lease, operate, 28 and maintain port and harbor, water, and land terminal 29 facilities, and, subject to the provisions of Section 5.01 to 30 operate or contract for the operation of such facilities, and 31 to fix and collect just, reasonable and non-discriminatory -2- LRB093 02163 ACG 02170 b 1 charges, rentals or fees for the use of such facilities. The 2 charges, rentals or fees so collected shall be made available 3 to defray the reasonable expenses of the Port District and to 4 pay the principal of and interest on any revenue bonds issued 5 by the District; 6 (f) To enter into contracts dealing in any manner with 7 the objects and purposes of this Act. 8 (g) To police its property and exercise police powers in 9 respect thereto or in respect to the enforcement of any rule 10 or regulation provided by the ordinances of the District and 11 employ and commission police officers and other qualified 12 persons to enforce the same. The use of any property of the 13 District or property under the regulation of the District for 14 activities including, but not limited to, vehicular traffic 15 or commercial maritime traffic shall be subject to the 16 reasonable regulation and control of the District and upon 17 such reasonable terms and conditions as shall be established 18 by its Board. A regulatory ordinance of the District adopted 19 under any provision of this Section or Section 21 may provide 20 for a suspension or revocation of any rights or privileges 21 within the control of the District for a violation of any 22 such regulatory ordinance. 23 (Source: P.A. 88-539.) 24 (70 ILCS 1810/12) (from Ch. 19, par. 163) 25 Sec. 12. The governing and administrative body of the 26 District shall be a board consisting of 9 members, to be 27 known as the Illinois International Port District Board. 28 Members of the Board shall be residents of a county whose 29 territory, in whole or in part, is embraced by the District 30 and persons of recognized business ability. The members of 31 the Board shall receive compensation for their services, set 32 by the Board at an amount not to exceed $20,000.00 annually, 33 except the Chairman may receive an additional $5,000.00 -3- LRB093 02163 ACG 02170 b 1 annually, if approved by the Board. All such compensation 2 shall be paid directly from the Port District's operating 3 funds. The members shall receive no other compensation 4 whatever, whether in form of salary, per diem allowance or 5 otherwise, for or in connection with his service as a member. 6 The preceding sentence shall not prevent any member from 7 receiving any non-salary benefit of the type received by 8 employees of the District. Each member shall be reimbursed 9 for actual expenses incurred by them in the performance of 10 their duties. Any person who is appointed to the office of 11 secretary or treasurer of the Board may receive compensation 12 for services as such officer, as determined by the Board, 13 provided such person is not a member of the Board. No member 14 of the Board or employee of the District shall have any 15 private financial interest, profit or benefit in any 16 contract, work or business of the District nor in the sale or 17 lease of any property to or from the District. 18 (Source: P.A. 84-892.) 19 Section 99. Effective date. This Act takes effect upon 20 becoming law.
