Amend House Bill 134, AS AMENDED, by 3 replacing everything after the enacting clause with the 4 following: 5 "Section 5. The State Finance Act is amended by adding 6 Sections 5.595 and 6z-59 as follows: 7 (30 ILCS 105/5.595 new) 8 Sec. 5.595. The Safe Student Driver Initiative Fund. 9 (30 ILCS 105/6z-59 new) 10 Sec. 6z-59. The Safe Student Driver Initiative Fund. The 11 Safe Student Driver Initiative Fund is created as a special 12 fund in the State treasury. Subject to appropriation by the 13 General Assembly and approval by the Secretary of State, the 14 Secretary of State shall use all moneys in the Safe Student 15 Driver Initiative Fund to cover all costs associated with the 16 manufacture, distribution, and administration of the Student 17 Driver signs and any other costs associated with the 18 Graduated Licensing Program. 19 Section 10. The Illinois Vehicle Code is amended by 20 changing Sections 6-107.1 and 6-118 as follows: -2- LRB093 03918 DRH 13995 a 1 (625 ILCS 5/6-107.1) 2 Sec. 6-107.1. Instruction permit for a minor. 3 (a) The Secretary of State, upon receiving proper 4 application and payment of the required fee, may issue an 5 instruction permit to any person under the age of 18 years 6 who is not ineligible for a license under paragraphs 1, 3, 4, 7 5, 7, or 8 of Section 6-103, after the applicant has 8 successfully passed such examination as the Secretary of 9 State in his discretion may prescribe. 10 (1) An instruction permit issued under this Section 11 shall be valid for a period of 24 months after the date 12 of its issuance and shall be restricted, by the Secretary 13 of State, to the operation of a motor vehicle by the 14 minor only when accompanied by the adult instructor of a 15 driver education program during enrollment in the program 16 or when practicing with a parent, legal guardian, family 17 member, or a person in loco parentis who is 21 years of 18 age or more, has a license classification to operate such 19 vehicle and at least one year of driving experience, and 20 who is occupying a seat beside the driver. 21 (2) A 24 month instruction permit for a motor 22 driven cycle may be issued to a person 16 or 17 years of 23 age and entitles the holder to drive upon the highways 24 during daylight under direct supervision of a licensed 25 motor driven cycle operator or motorcycle operator 21 26 years of age or older who has a license classification to 27 operate such motor driven cycle or motorcycle and at 28 least one year of driving experience. 29 (3) A 24 month instruction permit for a motorcycle 30 other than a motor driven cycle may be issued to a person 31 16 or 17 years of age in accordance with the provisions 32 of paragraph 2 of Section 6-103 and entitles a holder to 33 drive upon the highways during daylight under the direct 34 supervision of a licensed motorcycle operator 21 years of -3- LRB093 03918 DRH 13995 a 1 age or older who has at least one year of driving 2 experience. 3 (4) When issuing an instruction permit under 4 paragraph (1) of this subsection (a) for a vehicle other 5 than a motorcycle, the Secretary of State may, subject to 6 appropriation, also make available to the applicant a 7 sign with the words "Student Driver" printed on it. The 8 Secretary shall adopt rules for implementing this 9 paragraph (4). 10 (a-1) The sign issued under this Section may be 11 displayed on the rear of a vehicle other than a motorcycle in 12 a clearly visible location whenever the holder of the 13 instruction permit is driving the vehicle. 14 (b) An instruction permit issued under this Section when 15 issued to a person under the age of 17 years shall, as a 16 matter of law, be invalid for the operation of any motor 17 vehicle during the same time the child is prohibited from 18 being on any street or highway under the provisions of the 19 Child Curfew Act. 20 (c) Any person under the age of 16 years who possesses 21 an instruction permit and whose driving privileges have been 22 suspended or revoked under the provisions of this Code shall 23 not be granted a Family Financial Responsibility Driving 24 Permit or a Restricted Driving Permit. 25 (Source: P.A. 90-369, eff. 1-1-98.) 26 (625 ILCS 5/6-118) (from Ch. 95 1/2, par. 6-118) 27 Sec. 6-118. 6 $20 for the Motor Carrier Safety Inspection Fund; 7 $10 for the driver's license; 8 and $24 for the CDL:.............................$60 9 Renewal commercial driver's license: 10 $6 for the CDLIS/AAMVAnet Trust Fund; 11 $20 for the Motor Carrier Safety Inspection Fund; 12 $10 for the driver's license; and 13 $24 for the CDL:.................................$60 14 Commercial driver instruction permit 15 issued to any person holding a valid 16 Illinois driver's license for the 17 purpose of changing to a 18 CDL classification: $6 for the 19 CDLIS/AAMVAnet Trust Fund; 20 $20 for the Motor Carrier 21 Safety Inspection Fund; and 22 $24 for the CDL classification...................$50 23 Commercial driver instruction permit 24 issued to any person holding a valid 25 Illinois CDL for the purpose of 26 making a change in a classification, 27 endorsement or restriction........................$5 28 CDL duplicate or corrected license.....................$5 29 In order to ensure the proper implementation of the 30 Uniform Commercial Driver License Act, Article V of this 31 Chapter, the Secretary of State is empowered to pro-rate the 32 $24 fee for the commercial driver's license proportionate to 33 the expiration date of the applicant's Illinois driver's 34 license. -6- LRB093 03918 DRH 13995 a 1 The fee for any duplicate license or permit shall be 2 waived for any person age 60 or older who presents the 3 Secretary of State's office with a police report showing that 4 his license or permit was stolen. 5 No additional fee shall be charged for a driver's 6 license, or for a commercial driver's license, when issued to 7 the holder of an instruction permit for the same 8 classification or type of license who becomes eligible for 9 such license. 10 (b) Any person whose license or privilege to operate a 11 motor vehicle in this State has been suspended or revoked 12 under any provision of Chapter 6, Chapter 11, or Section 13 7-702 of the Family Financial Responsibility Law of this 14 Code, shall in addition to any other fees required by this 15 Code, pay a reinstatement fee as follows: 16 Summary suspension under Section 11-501.1.............$60 17 Other suspension......................................$30 18 Revocation............................................$60 19 However, any person whose license or privilege to operate 20 a motor vehicle in this State has been suspended or revoked 21 for a second or subsequent time for a violation of Section 22 11-501 or 11-501.1 of this Code or a similar provision of a 23 local ordinance or a similar out-of-state offense or Section 24 9-3 of the Criminal Code of 1961 and each suspension or 25 revocation was for a violation of Section 11-501 or 11-501.1 26 of this Code or a similar provision of a local ordinance or a 27 similar out-of-state offense or Section 9-3 of the Criminal 28 Code of 1961 shall pay, in addition to any other fees 29 required by this Code, a reinstatement fee as follows: 30 Summary suspension under Section 11-501.1............$250 31 Revocation...........................................$250 32 (c) All fees collected under the provisions of this 33 Chapter 6 shall be paid into the Road Fund in the State 34 Treasury except as follows: -7- LRB093 03918 DRH 13995 a 1 1. The following amounts shall be paid into the 2 Driver Education Fund: 3 (A) $16 of the $20 fee for an original 4 driver's instruction permit; 5 (B) $5 of the $10 fee for an original driver's 6 license; 7 (C) $5 of the $10 fee for a 4 year renewal 8 driver's license; and 9 (D) $4 of the $8 fee for a restricted driving 10 permit. 11 2. $30 of the $60 fee for reinstatement of a 12 license summarily suspended under Section 11-501.1 shall 13 be deposited into the Drunk and Drugged Driving 14 Prevention Fund. However, for a person whose license or 15 privilege to operate a motor vehicle in this State has 16 been suspended or revoked for a second or subsequent time 17 for a violation of Section 11-501 or 11-501.1 of this 18 Code or Section 9-3 of the Criminal Code of 1961, $190 of 19 the $250 fee for reinstatement of a license summarily 20 suspended under Section 11-501.1, and $190 of the $250 21 fee for reinstatement of a revoked license shall be 22 deposited into the Drunk and Drugged Driving Prevention 23 Fund. 24 3. $6 of such original or renewal fee for a 25 commercial driver's license and $6 of the commercial 26 driver instruction permit fee when such permit is issued 27 to any person holding a valid Illinois driver's license, 28 shall be paid into the CDLIS/AAMVAnet Trust Fund. 29 4. The fee for reinstatement of a license suspended 30 under the Family Financial Responsibility Law shall be 31 paid into the Family Responsibility Fund. 32 5.
