The State Finance Act is amended by adding 5 Sections 5.595 and 6z-59 as follows: 6 (30 ILCS 105/5.595 new) 7 Sec. 5.595. The Safe Student Driver Initiative Fund. 8 (30 ILCS 105/6z-59 new) 9 Sec. 6z-59. The Safe Student Driver Initiative Fund. The 10 Safe Student Driver Initiative Fund is created as a special 11 fund in the State treasury. Subject to appropriation by the 12 General Assembly and approval by the Secretary of State, the 13 Secretary of State shall use all moneys in the Safe Student 14 Driver Initiative Fund to cover all costs associated with the 15 manufacture, distribution, and administration of the Student 16 Driver signs and any other costs associated with the 17 Graduated Licensing Program. 18 Section 10. The Illinois Vehicle Code is amended by 19 changing Sections 6-107.1 and 6-118 as follows: -2- LRB093 03918 DRH 13004 a 1 (625 ILCS 5/6-107.1) 2 Sec. 6-107.1. Instruction permit for a minor. 3 (a) The Secretary of State, upon receiving proper 4 application and payment of the required fee, may issue an 5 instruction permit to any person under the age of 18 years 6 who is not ineligible for a license under paragraphs 1, 3, 4, 7 5, 7, or 8 of Section 6-103, after the applicant has 8 successfully passed such examination as the Secretary of 9 State in his discretion may prescribe. 10 (1) An instruction permit issued under this Section 11 shall be valid for a period of 24 months after the date 12 of its issuance and shall be restricted, by the Secretary 13 of State, to the operation of a motor vehicle by the 14 minor only when accompanied by the adult instructor of a 15 driver education program during enrollment in the program 16 or when practicing with a parent, legal guardian, family 17 member, or a person in loco parentis who is 21 years of 18 age or more, has a license classification to operate such 19 vehicle and at least one year of driving experience, and 20 who is occupying a seat beside the driver. 21 (2) A 24 month instruction permit for a motor 22 driven cycle may be issued to a person 16 or 17 years of 23 age and entitles the holder to drive upon the highways 24 during daylight under direct supervision of a licensed 25 motor driven cycle operator or motorcycle operator 21 26 years of age or older who has a license classification to 27 operate such motor driven cycle or motorcycle and at 28 least one year of driving experience. 29 (3) A 24 month instruction permit for a motorcycle 30 other than a motor driven cycle may be issued to a person 31 16 or 17 years of age in accordance with the provisions 32 of paragraph 2 of Section 6-103 and entitles a holder to 33 drive upon the highways during daylight under the direct 34 supervision of a licensed motorcycle operator 21 years of -3- LRB093 03918 DRH 13004 a 1 age or older who has at least one year of driving 2 experience. 3 (4) When issuing an instruction permit under 4 paragraph (1) of this subsection (a), the Secretary of 5 State may, subject to appropriation, also make available 6 to the applicant a sign with the words "Student Driver" 7 printed on it. The Secretary shall adopt rules for 8 implementing this paragraph (4). 9 (a-1) The sign issued under this Section may be 10 displayed on the rear of a vehicle in a clearly visible 11 location whenever the holder of the instruction permit is 12 driving the vehicle. 13 (b) An instruction permit issued under this Section when 14 issued to a person under the age of 17 years shall, as a 15 matter of law, be invalid for the operation of any motor 16 vehicle during the same time the child is prohibited from 17 being on any street or highway under the provisions of the 18 Child Curfew Act. 19 (c) Any person under the age of 16 years who possesses 20 an instruction permit and whose driving privileges have been 21 suspended or revoked under the provisions of this Code shall 22 not be granted a Family Financial Responsibility Driving 23 Permit or a Restricted Driving Permit. 24 (Source: P.A. 90-369, eff. 1-1-98.) 25 (625 ILCS 5/6-118) (from Ch. 95 1/2, par. 6-118) 26 Sec. 6-118. 5 $20 for the Motor Carrier Safety Inspection Fund; 6 $10 for the driver's license; 7 and $24 for the CDL:.............................$60 8 Renewal commercial driver's license: 9 $6 for the CDLIS/AAMVAnet Trust Fund; 10 $20 for the Motor Carrier Safety Inspection Fund; 11 $10 for the driver's license; and 12 $24 for the CDL:.................................$60 13 Commercial driver instruction permit 14 issued to any person holding a valid 15 Illinois driver's license for the 16 purpose of changing to a 17 CDL classification: $6 for the 18 CDLIS/AAMVAnet Trust Fund; 19 $20 for the Motor Carrier 20 Safety Inspection Fund; and 21 $24 for the CDL classification...................$50 22 Commercial driver instruction permit 23 issued to any person holding a valid 24 Illinois CDL for the purpose of 25 making a change in a classification, 26 endorsement or restriction........................$5 27 CDL duplicate or corrected license.....................$5 28 In order to ensure the proper implementation of the 29 Uniform Commercial Driver License Act, Article V of this 30 Chapter, the Secretary of State is empowered to pro-rate the 31 $24 fee for the commercial driver's license proportionate to 32 the expiration date of the applicant's Illinois driver's 33 license. 34 The fee for any duplicate license or permit shall be -6- LRB093 03918 DRH 13004 a 1 waived for any person age 60 or older who presents the 2 Secretary of State's office with a police report showing that 3 his license or permit was stolen. 4 No additional fee shall be charged for a driver's 5 license, or for a commercial driver's license, when issued to 6 the holder of an instruction permit for the same 7 classification or type of license who becomes eligible for 8 such license. 9 (b) Any person whose license or privilege to operate a 10 motor vehicle in this State has been suspended or revoked 11 under any provision of Chapter 6, Chapter 11, or Section 12 7-702 of the Family Financial Responsibility Law of this 13 Code, shall in addition to any other fees required by this 14 Code, pay a reinstatement fee as follows: 15 Summary suspension under Section 11-501.1.............$60 16 Other suspension......................................$30 17 Revocation............................................$60 18 However, any person whose license or privilege to operate 19 a motor vehicle in this State has been suspended or revoked 20 for a second or subsequent time for a violation of Section 21 11-501 or 11-501.1 of this Code or a similar provision of a 22 local ordinance or a similar out-of-state offense or Section 23 9-3 of the Criminal Code of 1961 and each suspension or 24 revocation was for a violation of Section 11-501 or 11-501.1 25 of this Code or a similar provision of a local ordinance or a 26 similar out-of-state offense or Section 9-3 of the Criminal 27 Code of 1961 shall pay, in addition to any other fees 28 required by this Code, a reinstatement fee as follows: 29 Summary suspension under Section 11-501.1............$250 30 Revocation...........................................$250 31 (c) All fees collected under the provisions of this 32 Chapter 6 shall be paid into the Road Fund in the State 33 Treasury except as follows: 34 1. The following amounts shall be paid into the -7- LRB093 03918 DRH 13004 a 1 Driver Education Fund: 2 (A) $16 of the $20 fee for an original 3 driver's instruction permit; 4 (B) $5 of the $10 fee for an original driver's 5 license; 6 (C) $5 of the $10 fee for a 4 year renewal 7 driver's license; and 8 (D) $4 of the $8 fee for a restricted driving 9 permit. 10 2. $30 of the $60 fee for reinstatement of a 11 license summarily suspended under Section 11-501.1 shall 12 be deposited into the Drunk and Drugged Driving 13 Prevention Fund. However, for a person whose license or 14 privilege to operate a motor vehicle in this State has 15 been suspended or revoked for a second or subsequent time 16 for a violation of Section 11-501 or 11-501.1 of this 17 Code or Section 9-3 of the Criminal Code of 1961, $190 of 18 the $250 fee for reinstatement of a license summarily 19 suspended under Section 11-501.1, and $190 of the $250 20 fee for reinstatement of a revoked license shall be 21 deposited into the Drunk and Drugged Driving Prevention 22 Fund. 23 3. $6 of such original or renewal fee for a 24 commercial driver's license and $6 of the commercial 25 driver instruction permit fee when such permit is issued 26 to any person holding a valid Illinois driver's license, 27 shall be paid into the CDLIS/AAMVAnet Trust Fund. 28 4. The fee for reinstatement of a license suspended 29 under the Family Financial Responsibility Law shall be 30 paid into the Family Responsibility Fund. 31 5. The $5 fee for each original or renewal M or L 32 endorsement shall be deposited into the Cycle Rider 33 Safety Training Fund. 34 6. $20 of any original or renewal fee for a -8- LRB093 03918 DRH 13004 a 1 commercial driver's license or commercial driver 2 instruction permit shall be paid into the Motor Carrier 3 Safety Inspection Fund. 4 7. $1 of the $21 fee for an original instruction 5 permit shall be paid into the Safe Student Driver 6 Initiative Fund. 7 (Source: P.A. 91-357, eff. 7-29-99; 91-537, eff. 8-13-99; 8 92-458, eff. 8-22-01.)".
