The State Finance Act is amended by adding 5 Sections 5.595 and 6z-59 as follows: 6 (30 ILCS 105/5.595 new) 7 Sec. 5.595. The Safe Student Driver Initiative Fund. 8 (30 ILCS 105/6z-59 new) 9 Sec. 6z-59. The Safe Student Driver Initiative Fund. The 10 Safe Student Driver Initiative Fund is created as a special 11 fund in the State treasury. Subject to appropriation by the 12 General Assembly and approval by the Secretary of State, the 13 Secretary of State shall use all moneys in the Safe Student 14 Driver Initiative Fund to cover all costs associated with the 15 manufacture, distribution, and administration of the Student 16 Driver signs and any other costs associated with the 17 Graduated Licensing Program. 18 Section 10. The Illinois Vehicle Code is amended by 19 changing Sections 6-107.1 and 6-118 as follows: 20 (625 ILCS 5/6-107.1) 21 Sec. 6-107.1. Instruction permit for a minor. 22 (a) The Secretary of State, upon receiving proper 23 application and payment of the required fee, may issue an 24 instruction permit to any person under the age of 18 years 25 who is not ineligible for a license under paragraphs 1, 3, 4, 26 5, 7, or 8 of Section 6-103, after the applicant has 27 successfully passed such examination as the Secretary of 28 State in his discretion may prescribe. HB0134 Engrossed -2- LRB093 03918 DRH 03955 b 1 (1) An instruction permit issued under this Section 2 shall be valid for a period of 24 months after the date 3 of its issuance and shall be restricted, by the Secretary 4 of State, to the operation of a motor vehicle by the 5 minor only when accompanied by the adult instructor of a 6 driver education program during enrollment in the program 7 or when practicing with a parent, legal guardian, family 8 member, or a person in loco parentis who is 21 years of 9 age or more, has a license classification to operate such 10 vehicle and at least one year of driving experience, and 11 who is occupying a seat beside the driver. 12 (2) A 24 month instruction permit for a motor 13 driven cycle may be issued to a person 16 or 17 years of 14 age and entitles the holder to drive upon the highways 15 during daylight under direct supervision of a licensed 16 motor driven cycle operator or motorcycle operator 21 17 years of age or older who has a license classification to 18 operate such motor driven cycle or motorcycle and at 19 least one year of driving experience. 20 (3) A 24 month instruction permit for a motorcycle 21 other than a motor driven cycle may be issued to a person 22 16 or 17 years of age in accordance with the provisions 23 of paragraph 2 of Section 6-103 and entitles a holder to 24 drive upon the highways during daylight under the direct 25 supervision of a licensed motorcycle operator 21 years of 26 age or older who has at least one year of driving 27 experience. 28 (4) When issuing an instruction permit under 29 paragraph (1) of this subsection (a) for a vehicle other 30 than a motorcycle, the Secretary of State may, subject to 31 appropriation, also make available to the applicant a 32 sign with the words "Student Driver" printed on it. The 33 Secretary shall adopt rules for implementing this 34 paragraph (4). HB0134 Engrossed -3- LRB093 03918 DRH 03955 b 1 (a-1) The sign issued under this Section may be 2 displayed on the rear of a vehicle other than a motorcycle in 3 a clearly visible location whenever the holder of the 4 instruction permit is driving the vehicle. 5 (b) An instruction permit issued under this Section when 6 issued to a person under the age of 17 years shall, as a 7 matter of law, be invalid for the operation of any motor 8 vehicle during the same time the child is prohibited from 9 being on any street or highway under the provisions of the 10 Child Curfew Act. 11 (c) Any person under the age of 16 years who possesses 12 an instruction permit and whose driving privileges have been 13 suspended or revoked under the provisions of this Code shall 14 not be granted a Family Financial Responsibility Driving 15 Permit or a Restricted Driving Permit. 16 (Source: P.A. 90-369, eff. 1-1-98.) 17 (625 ILCS 5/6-118) (from Ch. 95 1/2, par. 6-118) 18 Sec. 6-118. HB0134 Engrossed -6- LRB093 03918 DRH 03955 b 1 (b) Any person whose license or privilege to operate a 2 motor vehicle in this State has been suspended or revoked 3 under any provision of Chapter 6, Chapter 11, or Section 4 7-702 of the Family Financial Responsibility Law of this 5 Code, shall in addition to any other fees required by this 6 Code, pay a reinstatement fee as follows: 7 Summary suspension under Section 11-501.1.............$60 8 Other suspension......................................$30 9 Revocation............................................$60 10 However, any person whose license or privilege to operate 11 a motor vehicle in this State has been suspended or revoked 12 for a second or subsequent time for a violation of Section 13 11-501 or 11-501.1 of this Code or a similar provision of a 14 local ordinance or a similar out-of-state offense or Section 15 9-3 of the Criminal Code of 1961 and each suspension or 16 revocation was for a violation of Section 11-501 or 11-501.1 17 of this Code or a similar provision of a local ordinance or a 18 similar out-of-state offense or Section 9-3 of the Criminal 19 Code of 1961 shall pay, in addition to any other fees 20 required by this Code, a reinstatement fee as follows: 21 Summary suspension under Section 11-501.1............$250 22 Revocation...........................................$250 23 (c) All fees collected under the provisions of this 24 Chapter 6 shall be paid into the Road Fund in the State 25 Treasury except as follows: 26 1. The following amounts shall be paid into the 27 Driver Education Fund: 28 (A) $16 of the $20 fee for an original 29 driver's instruction permit; 30 (B) $5 of the $10 fee for an original driver's 31 license; 32 (C) $5 of the $10 fee for a 4 year renewal 33 driver's license; and 34 (D) $4 of the $8 fee for a restricted driving HB0134 Engrossed -7- LRB093 03918 DRH 03955 b 1 permit. 2 2. $30 of the $60 fee for reinstatement of a 3 license summarily suspended under Section 11-501.1 shall 4 be deposited into the Drunk and Drugged Driving 5 Prevention Fund. However, for a person whose license or 6 privilege to operate a motor vehicle in this State has 7 been suspended or revoked for a second or subsequent time 8 for a violation of Section 11-501 or 11-501.1 of this 9 Code or Section 9-3 of the Criminal Code of 1961, $190 of 10 the $250 fee for reinstatement of a license summarily 11 suspended under Section 11-501.1, and $190 of the $250 12 fee for reinstatement of a revoked license shall be 13 deposited into the Drunk and Drugged Driving Prevention 14 Fund. 15 3. $6 of such original or renewal fee for a 16 commercial driver's license and $6 of the commercial 17 driver instruction permit fee when such permit is issued 18 to any person holding a valid Illinois driver's license, 19 shall be paid into the CDLIS/AAMVAnet Trust Fund. 20 4. The fee for reinstatement of a license suspended 21 under the Family Financial Responsibility Law shall be 22 paid into the Family Responsibility Fund. 23 5. The $5 fee for each original or renewal M or L 24 endorsement shall be deposited into the Cycle Rider 25 Safety Training Fund. 26 6. $20 of any original or renewal fee for a 27 commercial driver's license or commercial driver 28 instruction permit shall be paid into the Motor Carrier 29 Safety Inspection Fund. 30 7. $1 of the $21 fee for an original instruction 31 permit shall be paid into the Safe Student Driver 32 Initiative Fund. 33 (Source: P.A. 91-357, eff. 7-29-99; 91-537, eff. 8-13-99; 34 92-458, eff. 8-22-01.)
