Amend House Bill 60, AS AMENDED, by 3 replacing everything after the enacting clause with the 4 following: 5 "Section 5. The University of Illinois Act is amended by 6 adding Section 7e-5 as follows: 7 (110 ILCS 305/7e-5 new) 8 Sec. 7e-5. In-state tuition charge. 9 (a) Notwithstanding any other provision of law to the 10 contrary, for tuition purposes, the Board of Trustees shall 11 deem an individual an Illinois resident, until the individual 12 establishes a residence outside of this State, if all of the 13 following conditions are met: 14 (1) The individual resided with his or her parent 15 or guardian while attending a public or private high 16 school in this State. 17 (2) The individual graduated from a public or 18 private high school or received the equivalent of a high 19 school diploma in this State. 20 (3) The individual attended school in this State 21 for at least 3 years as of the date the individual 22 graduated from high school or received the equivalent of -2- LRB093 02651 NHT 12434 a 1 a high school diploma. 2 (4) The individual registers as an entering student 3 in the University not earlier than the 2003 fall 4 semester. 5 (5) In the case of an individual who is not a 6 citizen or a permanent resident of the United States, the 7 individual provides the University with an affidavit 8 stating that the individual will file an application to 9 become a permanent resident of the United States at the 10 earliest opportunity the individual is eligible to do so. 11 (b) This Section applies only to tuition for a term or 12 semester that begins on or after the effective date of this 13 amendatory Act of the 93rd General Assembly. 14 Section 10. The Southern Illinois University Management 15 Act is amended by adding Section 8d-5 as follows: 16 (110 ILCS 520/8d-5 new) 17 Sec. 8d-5. In-state tuition charge. 18 (a) Notwithstanding any other provision of law to the 19 contrary, for tuition purposes, the Board shall deem an 20 individual an Illinois resident, until the individual 21 establishes a residence outside of this State, if all of the 22 following conditions are met: 23 (1) The individual resided with his or her parent 24 or guardian while attending a public or private high 25 school in this State. 26 (2) The individual graduated from a public or 27 private high school or received the equivalent of a high 28 school diploma in this State. 29 (3) The individual attended school in this State 30 for at least 3 years as of the date the individual 31 graduated from high school or received the equivalent of 32 a high school diploma. -3- LRB093 02651 NHT 12434 a 1 (4) The individual registers as an entering student 2 in the University not earlier than the 2003 fall 3 semester. 4 (5) In the case of an individual who is not a 5 citizen or a permanent resident of the United States, the 6 individual provides the University with an affidavit 7 stating that the individual will file an application to 8 become a permanent resident of the United States at the 9 earliest opportunity the individual is eligible to do so. 10 (b) This Section applies only to tuition for a term or 11 semester that begins on or after the effective date of this 12 amendatory Act of the 93rd General Assembly. 13 Section 15. The Eastern Illinois University Law is 13 amended by adding Section 10-88 as follows: 14 (110 ILCS 665/10-88 new) 15 Sec. 10-88. The Public Community College Act is amended 7 by adding Section 6-4a as follows: 8 (110 ILCS 805/6-4a new) 9 Sec. 6-4a. In-state tuition charge. 10 (a) Notwithstanding any other provision of law to the 11 contrary, for tuition purposes, a board shall deem an 12 individual an Illinois resident, until the individual 13 establishes a residence outside of this State, if all of the 14 following conditions are met: 15 (1) The individual resided with his or her parent or 16 guardian while attending a public or private high school 17 in this State. 18 (2) The individual graduated from a public or 19 private high school or received the equivalent of a high 20 school diploma in this State. 21 (3) The individual attended school in this State for 22 at least 3 years as of the date the individual graduated 23 from high school or received the equivalent of a high 24 school diploma. 25 (4) The individual registers as an entering student 26 in the community college not earlier than the 2003 fall 27 semester. 28 (5) In the case of an individual who is not a 29 citizen or a permanent resident of the United States, the 30 individual provides the community college with an 31 affidavit stating that the individual will file an 32 application to become a permanent resident of the United -11- LRB093 02651 NHT 12434 a 1 States at the earliest opportunity the individual is 2 eligible to do so. 3 (b) This Section applies only to tuition for a term or 4 semester that begins on or after the effective date of this 5 amendatory Act of the 93rd General Assembly. 6 Section 99.
