Synopsis As Introduced
Amends the Toll Highway Act. Requires the Governor to appoint an Inspector General to investigate waste, fraud, or financial mismanagement in Authority operations involving Authority employees or contractors. Provides for the Inspector General's powers and duties. Makes failure to cooperate in specified ways with the investigation a Class A misdemeanor.

House Amendment No. 1
Deletes everything after the enacting clause. Amends the Toll Highway Act. Requires the Governor to appoint, with the advice and consent of the Senate, an Inspector General. Provides that the Governor may designate the Inspector General and members of the Inspector General's office as peace officers after those persons have completed basic police training. Allows the Inspector General to conduct investigations and make reports concerning fraud, corruption, and mismanagement in the Authority; subpoena witnesses and evidence necessary to carry out the duties of the Inspector General, within specified limitations; and have direct access to the Board of Directors of the Authority. Provides that a person who knowingly and intentionally fails to comply with a subpoena issued by the Inspector General is guilty of a Class A misdemeanor. Prohibits reprisals against employees of the Authority who make complaints to or disclose information to the Inspector General. Requires the Inspector General to adopt rules establishing requirements for investigations. Provides that any employee of the Authority who is subject to investigation or inquiry by the Inspector General must be informed of his or her right to remain silent and to be represented by a representative of a labor organization.

 Fiscal Note (H-AM 1) (Illinois State Toll Highway Authority)
 Establishing an Inspector General position would increase the expenditure of toll revenue by approximately $250,000 per year based upon an estimated salary, investigative staff, clerical assistance, equipment and benefits necessary for this position.
