1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Code is amended by changing
5Section 3-6 as follows:
 
6    (70 ILCS 1205/3-6)  (from Ch. 105, par. 3-6)
7    Sec. 3-6. Petition to disconnect park district territory;
8waiver of assessment payment.
9    (a) Any park district territory that , within any park
10district, which (1) is located upon the border of the park
11district, and that, (2) if disconnected from the park
12district, would not separate any part of the park district
13from any other part, may be disconnected from the park
14district, in the discretion of its corporate authorities as
15follows:
16    A written petition, signed by the majority of the owners
17of record of land and the owners of record of more than
18one-half of the area of land in the territory described in the
19petition, shall be filed with the secretary of the governing
20board of the park district, requesting that the specified
21territory be disconnected from the park district. The petition
22shall be filed at least 30 days before it is considered by the
23corporate authorities. Except as provided in subsection (b),

1the The petition shall be accompanied with the certificate of
2the proper county clerk, or county clerks as the case may be,
3showing that all park district assessments due up to the time
4of presenting the petition are fully paid. The corporate
5authorities may, in their discretion, disconnect the territory
6from the park district by an ordinance passed by a majority of
7the members of the governing board.
8    (b) Prior to the submission of the petition specified in
9subsection (a), the governing board of the park district may,
10at its discretion, adopt, by ordinance, a determination to
11waive the full payment of any unpaid park district assessments
12outstanding at the time the petition is submitted. If a waiver
13is adopted by park district ordinance under this subsection
14(b), the county clerk or county clerks shall certify the
15petition for the disconnection of the property identified in
16the petition for the purpose of allowing the park district to
17approve disconnection of all the property in the petition
18without requiring the payment of any assessments that have
19been waived.
