| 1 | | AN ACT concerning State government.
|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Nuclear Safety Law of 2004 is amended by |
| 5 | | adding Section 95 as follows:
|
| 6 | | (20 ILCS 3310/95 new) |
| 7 | | Sec. 95. Right of entry. |
| 8 | | (a) As used in this Section, "disaster" and "incident" |
| 9 | | have the meanings given to those terms in Section 4 of the |
| 10 | | Illinois Emergency Management Agency Act. |
| 11 | | (b) IEMA-OHS has the right to enter on public and private |
| 12 | | property in order to take environmental samples in response to |
| 13 | | a disaster or incident that causes, or threatens to cause, |
| 14 | | radioactive contamination consistent with the regulatory |
| 15 | | requirements of the U.S. Nuclear Regulatory Commission.

| 16 | | Section 99. Effective date. This Act takes effect upon |
| 17 | | becoming law. |
