1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Early Learning Council Act is
5amended by changing Sections 5, 10, and 15 and by adding
6Section 20 as follows:
 
7    (20 ILCS 3933/5)
8    Sec. 5. Illinois Early Learning Council. The Illinois
9Early Learning Council is hereby created to advise on
10statewide coordinate existing programs and services for
11children from the prenatal period birth to 5 years of age in
12order to better meet the early learning needs of children and
13their families. The goal of the Council is to fulfill the
14vision of Illinois being the best state in the nation to raise
15young children by providing a statewide, high-quality,
16accessible, and comprehensive early learning system to benefit
17all young children whose parents choose it. The Council shall
18guide collaborative efforts to improve and expand upon
19existing early childhood programs and services, including
20those related to education and care, such as nutrition,
21nutrition education, and physical activity, in coordination
22with the Interagency Nutrition Council. This work shall
23include making use of existing reports, research, and planning

1efforts.

4    Sec. 10. Membership. The Illinois Early Learning Council
5shall include representation from both public and private
6organizations, and its membership shall reflect regional,
7racial, and cultural diversity to ensure representation of the
8needs of all Illinois children. One member shall be appointed
9by the President of the Senate; , one member shall be appointed
10by the Minority Leader of the Senate; , one member shall be
11appointed by the Speaker of the House of Representatives; , one
12member shall be appointed by the Minority Leader of the House
13of Representatives; , and other members shall be appointed by
14the Governor. The Governor's appointments shall include,
15without limitation, the following:
16        (1) The Secretary of Early Childhood or the
17    Secretary's designee, who shall serve as co-chairperson of
18    the Council.
19        (2) (1) A leader of stature from the Governor's
20    office, to serve as co-chairperson of the Council.
21        (3) (2) The chief administrators of the following
22    State agencies or their designees: Department of Early
23    Childhood, the State Board of Education; the Department of
24    Human Services; the Department of Children and Family
25    Services; the Department of Public Health; the Department

1    of Healthcare and Family Services; the Board of Higher
2    Education; and the Illinois Community College Board.
3        (4) Parents and caregivers of children 5 years of age
4    or younger.
5        (5) A representative of a statewide advocacy
6    organization that represents multiple Head Start and Early
7    Head Start providers.
8        (6) The State Director of Head Start Collaboration.
9        (7) (3) Local government stakeholders and
10    nongovernment stakeholders with an interest in early
11    childhood care and education, including representation
12    from the following private-sector fields and
13    constituencies: early childhood education and development;
14    child care; child advocacy; parenting support; local
15    community collaborations among early care and education
16    programs and services; maternal and child health; children
17    with special needs; business; labor; and law enforcement.
18    The Governor shall designate one of the members who is a
19    nongovernment stakeholder to serve as co-chairperson of
20    the Council.
21In addition, the Governor shall request that the Region V
22office of the U.S. Department of Health and Human Services'
23Administration for Children and Families appoint a member to
24the Council to represent federal children's programs and
25services.

1appointed by the Governor who are local government or
2nongovernment stakeholders shall serve 3-year terms, except
3that of the initial appointments, half of these members, as
4determined by lot, shall be appointed to 2-year terms so that
5terms are staggered. Members shall serve on a voluntary,
6unpaid basis.

9    Sec. 15. Management and accountability Accountability. The
10Department of Early Childhood shall provide staffing and
11administrative support to the Council. The Illinois Early
12Learning Council shall annually report to the Governor, the
13and General Assembly, and the Department of Early Childhood on
14the Council's progress toward towards its goals and
15objectives.

18    Sec. 20. Conflicts of interest. No member of the Council
19shall cast a vote on or participate substantially in any
20matter that would provide a direct financial benefit to that
21member or otherwise give the appearance of a conflict of
22interest under State law. All provisions and reporting
23requirements of the Illinois Governmental Ethics Act shall
24apply to Council members.

1    Section 10. The Early Childhood Access Consortium for
2Equity Act is amended by changing Section 25 as follows:
 
3    (110 ILCS 28/25)
4    Sec. 25. Advisory committee; membership.
5    (a) The Board of Higher Education, the Illinois Community
6College Board, the State Board of Education, the Department of
7Human Services, and the Department of Early Childhood shall
8jointly convene a Consortium advisory committee to provide
9guidance on the operation of the Consortium.
10    (b) Membership on the advisory committee shall be
11comprised of employers and experts appointed by the Board of
12Higher Education, the Illinois Community College Board, the
13Department of Early Childhood, the Department of Human
14Services, and the State Board of Education. Membership shall
15also include all of the following members:
16        (1) An employer from a community-based child care
17    provider, appointed by the Department of Early Childhood
18    Human Services.
19        (2) An employer from a for-profit child care provider,
20    appointed by the Department of Early Childhood Human
21    Services.
22        (3) An employer from a nonprofit child care provider,
23    appointed by the Department of Early Childhood Human
24    Services.

1        (4) A provider of family child care, appointed by the
2    Department of Early Childhood Human Services.
3        (5) An employer located in southern Illinois,
4    appointed by the Department of Early Childhood.
5        (6) An employer located in central Illinois, appointed
6    by the Department of Early Childhood.
7        (7) At least one member who represents an urban school
8    district, appointed by the State Board of Education.
9        (8) At least one member who represents a suburban
10    school district, appointed by the State Board of
11    Education.
12        (9) At least one member who represents a rural school
13    district, appointed by the State Board of Education.
14        (10) At least one member who represents a school
15    district in a city with a population of 500,000 or more,
16    appointed by the State Board of Education.
17        (11) Two early childhood advocates with statewide
18    expertise in early childhood workforce issues, appointed
19    by the Department of Early Childhood.
20        (12) The Chairperson or Vice-Chairperson and the
21    Minority Spokesperson or a designee of the Senate
22    Committee on Higher Education.
23        (13) The Chairperson or Vice-Chairperson and the
24    Minority Spokesperson or a designee of the House Committee
25    on Higher Education.
26        (14) One member representing the Illinois Community

1    College Board, who shall serve as co-chairperson,
2    appointed by the Illinois Community College Board.
3        (15) One member representing the Board of Higher
4    Education, who shall serve as co-chairperson, appointed by
5    the Board of Higher Education.
6        (16) One member representing the Illinois Student
7    Assistance Commission, appointed by the Illinois Student
8    Assistance Commission.
9        (17) One member representing the State Board of
10    Education, who shall serve as co-chairperson, appointed by
11    the State Board of Education.
12        (18) One member representing the Department of Early
13    Childhood, who shall serve as co-chairperson, appointed by
14    the Department of Early Childhood.
15        (19) One member representing the Department of Human
16    Services, who shall serve as co-chairperson, appointed by
17    the Department of Human Services.
18        (20) One member representing INCCRRA, appointed by the
19    Department of Early Childhood.
20        (21) One member representing the Department of
21    Children and Family Services, appointed by the Department
22    of Children and Family Services.
23        (22) One member representing an organization that
24    advocates on behalf of community college trustees,
25    appointed by the Illinois Community College Board.

1    early childhood providers, appointed by the Department of
2    Early Childhood Human Services.
3        (24) Two members of unions representing higher
4    education faculty, appointed by the Board of Higher
5    Education.
6        (25) A representative from the College of Education of
7    an urban public university, appointed by the Board of
8    Higher Education.
9        (26) A representative from the College of Education of
10    a suburban public university, appointed by the Board of
11    Higher Education.
12        (27) A representative from the College of Education of
13    a rural public university, appointed by the Board of
14    Higher Education.
15        (28) A representative from the College of Education of
16    a private university, appointed by the Board of Higher
17    Education.
18        (29) A representative of an urban community college,
19    appointed by the Illinois Community College Board.
20        (30) A representative of a suburban community college,
21    appointed by the Illinois Community College Board.
22        (31) A representative of a rural community college,
23    appointed by the Illinois Community College Board.
24    (c) The advisory committee shall meet at least twice a
25year. The committee meetings shall be open to the public in
26accordance with the provisions of the Open Meetings Act.

1    (d) Except for the co-chairpersons of the advisory
2committee, the initial terms for advisory committee members
3after June 5, 2024 (the effective date of Public Act 103-588)
4shall be set by lottery at the first meeting after June 5, 2024
5(the effective date of Public Act 103-588) as follows:
6        (1) One-third of members shall serve a one-year term.
7        (2) One-third of members shall serve a 2-year term.
8        (3) One-third of members shall serve a 3-year term.
9    (e) The initial term of co-chairpersons of the advisory
10committee shall be for 3 years.
11    (f) After the initial term, each subsequent term for the
12members of the advisory committee shall be for 3 years or until
13a successor is appointed.
14    (g) The members of the advisory committee shall serve
15without compensation, but shall be entitled to reimbursement
16for all necessary expenses incurred in the performance of
17their official duties as members of the advisory committee
18from funds appropriated for that purpose.
